1975年12月19日,澳葡政府以第705/75號法令提升澳門司法警察廳為澳門司法警察司。澳門司法警察司在行政上直屬澳門總督,而在刑事訴訟的運作上由葡萄牙檢察長指導。為了明確司法警察司的運作,1979年8月4日澳門立法會頒佈了第19/79/M號法律,即司法警察司組織法,規定司法警察司為一負責刑事偵查、犯罪預防及協助司法當局的直屬澳門總督的警察部門,在進行刑事偵查時接受檢察院的指導,但有權對所有不予起訴的案件進行歸檔。司法警察司司長由法院或檢察院的司法官出任,副司長一職則按1986年通過的第34/86/M號法令規定,必須由澳門總督任命法院或檢察院的司法官,或一等督察,或至少從事法律工作五年的法學士擔任。 |

自2006年規範司法警察局組織及運作的第9/2006號行政法規頒佈後,澳門特區的社會經濟和技術現代化一直保持快速發展,但同時博彩及資訊犯罪也無可避免地有所上升,尤其是以高新科技手段進行的犯罪,以及跨境有組織犯罪均有所增加。 為應對犯罪模式的轉變,司法警察局透過第20/2010號行政法規,對其組織法作出了一系列的調整,以便更有效執行法律賦予的職責。 法規修訂的內容主要包括將情報處升格為情報及支援廳、在刑事技術廳下設立三個處級部門,以及將原來由經濟罪案調查處負責的資訊犯罪調查工作獨立出來,轉由新設立的資訊罪案調查處負責。以上調整能加強司法警察局打擊犯罪的能力,更好地回應社會和市民的需要。 |

2020年,為健全維護國家安全相關法律制度和執行機制,滿足調查與國家安全、網絡安全、恐怖主義、高科技相關犯罪的執法工作需要,提升執法效率,特區政府制定和頒佈第14/2020號法律以及第35/2020號行政法規,調整司法警察局的職能及組織架構,以便充實和穩定專業人員隊伍,從而進一步加強澳門維護國家安全的執法力量,提高預警、防範和抵禦各類安全風險的能力,更加有效維護國家主權、安全和發展利益。 第14/2020號法律明確規定調查危害國家安全的犯罪屬司法警察局專屬權限;按照第35/2020號行政法規的規定,司法警察局增設保安廳及其轄下四個處級附屬單位:國家安全情報工作處、國家安全罪案調查處、國家安全行動支援處,以及國家安全事務綜合處;同時新設恐怖主義罪案預警及調查處和網絡安全處,並撤銷行動支援處。司法警察局架構調整後共有八廳25處,因應職責增加而增設一名副局長;司法警察局未來將按重整的新架構依法開展維護總體國家安全的工作,更有效地履行打擊和預防犯罪的職責。 此外,為促進刑偵專業發展和增強執法能力,特區政府對司法警察局原有的刑事偵查員職程進行優化,增設督察長和刑事偵查主任兩個新職級,提高督察及副督察職級的學歷要求,以提升執法成效;同時增設物證、電子證據範疇的法證高級技術員和法證技術員兩個特別職程,以構建專業法證隊伍,全力支援刑事偵查和執行維護網絡安全的工作。 |

The Division of Macao Judiciary Police was established following the enactment of the Decree-Law No. 43125 on 19th August 1960 by the Macao-Portuguese Government, with the view to consolidate the overseas (i.e. Macao) investigative procedures and the handling of preliminary hearings. This was carried out to boost the protection of the society against criminal activities, in light of the Constitution of the Portuguese Republic and the Portuguese Code of Criminal Procedures.
Such a Division was led by an Assistant Coordinator of Criminal Investigation, whose office included additional tasks equivalent to those performed by deputy directors or coordinators of the Portuguese Judiciary Police. Holders of degrees of Bachelor of Law, who were experienced in the field, and magistrates of the Public Prosecution were eligible to take up the position of head of the Division, and the appointment was on the basis of renewable fixed-term mandate.

Under the provisions of the Decree-Law No. 430/71, the then Division was upgraded to Sub-directorate on 12th October 1971. The position of assistant coordinator was then abolished and replaced by the post of deputy director, and one vacancy for coordinator of criminal investigation was added on to the career structure of the Sub-directorate. Magistrates of the Public Prosecution, under renewable fixed-term mandates, held the position of deputy director.

On 19th December 1975, the Sub-directorate of Macao Judiciary Police was upgraded to Directorate, under the provisions of Decree-law No. 705/75. It was subordinated to the Macao Governor in terms of administration, but the authority to oversee the execution of criminal proceedings rested with the Portuguese Attorney General.
In order to outline the functioning of the Directorate of Macao Judiciary Police, the Legislative Assembly of Macao enacted the Law No. 19/79/M on 4th August 1979, i.e. the Organization Law of the Judiciary Police. Such a law provided that the Directorate of Macao Judiciary Police was a law enforcement agency responsible for crime prevention and investigation, and tasked to render assistance to judicial authorities. It was hierarchically organised in rank and orders, subordinated to the Governor, and performed under the guidance of the Public Prosecutions Office on areas related to criminal investigation. Nonetheless, the Directorate had the authority to file investigative proceedings if charges had not been pressed.
The post of Director was filled by be a judge or a magistrate of the Court or the Public Prosecutions office. The post of Deputy Director, pursuant to the stipulations in the Decree Law No. 34/86/M enacted in 1986, had to be taken up by Judges of Courts or Magistrates of the Public Prosecutions office, or Assistant Inspector General I or holders of degree of Bachelor of Law with at least 5 years working experience in the legal field, appointed by the Macao Governor.

Following the establishment of the Macao Special Adminsitrative Region on 20th December 1999, the Judiciary Police has been subordinated to the Secretary for Security, while the supervisory role of the Public Prosecutions office over criminal investigation and enquiries remained unchanged, and so did the requirements for taking up the positions of Director and Deputy Director as stipulated by the Law No. 27/98/M enacted prior to return of Macao.

In pace with the adjustment of Macao's gaming policy and the implementation of the "Hong Kong and Macao Individual Visit Scheme for Mainland Residents", Macao's entire economy has been booming continuously. In line with the need of social development, the SAR government enacted and published Law no.5/2006 and Administrative Regulation no. 9/2006 in the year 2006, to restate the norm of the Judiciary Police (PJ) for the exclusive jurisdiction in the investigation of money laundering crimes, IT crimes and terrorism crimes, along with adjustments to its organization structure.

Since 2006, after the enactment of Administrative Regulation no. 9/2006 for the norm of PJ organization and function, the social economy and the modernization of technology in the Macao S.A.R. has maintained a rapid development. However, gaming and I.T. crimes had inevitably surged, especially crimes committed by using modi operandi of new science and technology. Likewise, cross-border organized crimes had also increased.
In order to cope with the shift of modi operandi, the PJ has implemented a series of adjustments, through Adminstrative Regulation no. 20/2010, regarding its Organization Law, so as to effectively perform the duties vested by law.
The amended Regulation mainly includes: the hierarchical elevation of the Intelligence Division to the Intelligence and Support Department; the establishment of 3 divisions under the Forensic Science Department; and individualization of the work of IT crime investigation which originally belonged to the responsibility of the Economic Crimes Division into that of the newly established I.T. Crimes Division. The above adjustments could enhance the capability to fight against crime, which would better serve the needs of the society and the general public.

To improve the legal system and implementation mechanism relevant to the safeguarding of national security, and to fulfill the needs of law enforcement in the investigation of crimes related to national security, cybersecurity, terrorism and advanced technology, while enhancing the efficiency of law enforcement, the SAR Government devised and published Law no. 14/2020 and Administrative Regulation no. 35/2020 in 2020, thereby adjusting the functions and organizational structure of the Judiciary Police, in order to enrich and stabilise its professional team. Macao’s law enforcement force to uphold national security will therefore be further fortified, while elevating capabilities in early warning, prevention and defence against various security risks to safeguard national sovereignty, security and development interests more effectively.
Law no. 14/2020 clearly defines the investigation of crimes against national security as the exclusive competence of the Judiciary Police; Administrative Regulation no. 35/2020 states the creation of department for national security and four subordinate Divisions in the Judiciary Police: National Security Intelligence Division, National Security Crimes Investigation Division, National Security Operations Support Division, and National Security Affairs Consolidation Division; meanwhile, the Terrorism Crimes Early Warning and Investigation Division as well as Cyber Security Division were established, while Operations Support Division was removed. After the adjustments of the organizational structure, the Judiciary Police has 8 departments and 25 Divsions in total, a Deputy Director post has been added in parallel to the expansion of functions; in the future, the Judiciary Police would launch its effort, in accordance with the adjusted new organizational structure and the law, to maintain holistic national security, and implement its function more effectively to combat and prevent crimes.
Moreover, to facilitate the professional development in criminal investigation and reinforce law enforcement capabilities, the SAR Government is optimizing the original rank scale of criminal investigators by creating two new ranks:“Senior Assistant Inspector General” and “Chief Criminal Investigator” respectively, while raising qualification requirements for inspectors and subinspectors to boost law enforcement effectiveness. Meanwhile, two special rank scales of Senior Forensic Technical Officers and Technical Forensic Officers, specializing in material evidence and electronic evidence, were also created, assembling a team of forensic professionals to fully support criminal investigation and carry out tasks to safeguard cybersecurity.

O Decreto-Lei n.º 43125, promulgado em 19 de Agosto de 1960 pelo então Governo de Macau, criou a Inspecção da Polícia Judiciária, visando centralizar os serviços ultramarinos (à época extensivos a Macau) de investigação e instrução preparatória, de modo a que os serviços competentes, organizar da melhor forma, e com base nos princípios consagrados na Constituição da República Portuguesa e na lei processual penal, executassem a defesa da sociedade contra a criminalidade.
Essa Inspecção era dirigida por um inspector-adjunto, que deveria exercer cumulativamente as funções que cabiam aos subdirectores e inspectores da Polícia Judiciária de Portugal, devendo o lugar de inspector-adjunto ser preenchido por licenciados em Direito com experiência profissional, ou por magistrados do Ministério Público em comissão de serviço.

Em 12 de Outubro de 1971, a Inspecção foi elevada, pelo Decreto-Lei n.º 430/71, em departamento policial. Para além da promoção da Inspecção a Subdirectoria, foi extinguido o lugar de inspector-adjunto, substituindo-o por um subdirector e criando ainda um lugar de inspector. O lugar de subdirector era ocupado em comissão de serviço por magistrados do Ministério Público.

Em 19 de Dezembro de 1975, a Subdirectoria da Polícia Judiciária de Macau foi elevada pelo Decreto-Lei n.º 705/75 a Directoria, constituída na dependência administrativa do Governador e orientada pelo procurador da República Portuguesa no funcionamento dos processos criminais. Para se tornar explícito o funcionamento da Directoria da Polícia Judiciária de Macau, a Assembleia Legislativa de Macau promulgou a Lei n.º 19/79, de 4 de Agosto, que definia a lei orgânica da Polícia Judiciária de Macau. Segundo essa lei, a Directoria da Polícia Judiciária era um serviço policial, incumbido de prevenção, investigação criminal e coadjuvação das autoridades judiciárias, organizado hierarquicamente na dependência do Governador, orientado pelo Ministério Público na investigação criminal, competindo-lhe arquivar todos os processos sem acusação deduzida. O lugar de director da Polícia Judiciária devia ser provido de entre os magistrados judiciais ou os do Ministério Público. Os lugares de subdirector eram escolhidos de entre os magistrados judiciais ou do Ministério Público pelo Governador de Macau, ou de entre inspectores de 1.ª classe, ou de entre licenciados em direito, com pelo menos 5 anos de experiência do trabalho na área jurídica, nos termos do Decreto-Lei n.º34/86/M aprovado em 1986.

Após o estabelecimento da Região Administrativa Especial de Macau no dia 20 de Dezembro de 1999, a Directoria da Polícia Judiciária passou a ser a Polícia Judiciária e passou sob a tutela do Secretário para a Segurança. Quanto às diligências de investigação criminal, estas são da competência do Ministério Público. As condições e os requisitos de desempenho dos cargos de director e de subdirector mantiveram-se inalteradas, as mesmas previstas no Decreto-Lei n.º 27/98/M que entrou em vigor antes do regresso de Macau à Pátria.

O ajustamento da política do jogo, posto em prática pela RAEM, e a política do Governo Central Chinês posta em prática nos anos anteriores, relativa aos vistos turísticos individuais para visitar Hong Kong e Macau, concedidos aos residentes da China, impulsionaram consideravelmente o desenvolvimento económico de Macau. Para coordenar melhor as necessidades desse desenvolvimento, a RAEM elaborou e publicou no ano de 2006 a Lei n.º 5/2006 e o Regulamento Administrativo n.º 9/2006, reiterando a exclusividade da competência na investigação dos crimes de branqueamento de capitais, informáticos e de terrorismo, foram então efectuadas algumas alterações na estrutura orgânica da PJ.

Desde 2006, data da publicação do Regulamento Administrativo n.º 9/2006, diploma que regulava a organização e funcionamento da PJ, a RAEM registou um desenvolvimento sócioeconómico sem paralelo no mundo actual. Para além disso, também a área da modernização tecnológica aqui se fez sentir. Como consequência inevitável de todo este desenvolvimento registou-se um aumento dos crimes ligados ao jogo e do crime informático, de que são exemplo a prática de crimes precisamente com recurso a meios tecnológicos muito sofisticados, e a área da criminalidade organizada entre fronteiras.
Foi para fazer face a toda a evolução registada no espectro criminal da RAEM que a PJ viu ser aprovado o Regulamento Administrativo n.º 20/2010, o qual veio proceder a um conjunto de reajustamentos na sua Lei Orgânica, considerados indispensáveis à continuação do exercício eficaz das atribuições conferidas por lei.
Das alterações introduzidas importa destacar a promoção da Divisão de Informações ao nível de Departamento, passando a designar-se Departamento de Informações e Apoio, e da subdivisão do Departamento de Ciências Forenses em três Divisões. Procedeu-se igualmente à autonomização da investigação dos crimes informáticos, deixando estes de se encontrar na competência da Divisão de Investigação de Crimes Económicos, foi assim criada para o efeito a Divisão de Investigação de Crimes Informáticos.
As alterações introduzidas visavam corresponder ainda melhor às necessidades da sociedade e da população em geral, melhorando a capacidade da PJ no combate à criminalidade.

Em 2020, com o intuito de aperfeiçoar o regime jurídico e os mecanismos de defesa da segurança do Estado, satisfazer as necessidades da investigação dos crimes relacionados com a segurança nacional, a cibersegurança, o terrorismo e a tecnologia de ponta, bem como melhorar a eficácia do trabalho, o Governo da RAEM formulou e publicou a Lei n.º 14/2020 e o Regulamento Administrativo n.º 35/2020, os quais procedem ao ajustamento das funções e estrutura orgânica da PJ, procurando consolidar e estabilizar a equipa profissional, para aumentar, deste modo, o nível de defesa da segurança do Estado em Macau e optimizar a capacidade de previsão, prevenção e protecção contra os diversos riscos, salvaguardando efectivamente a soberania nacional, a segurança e os interesses do desenvolvimento.
A Lei n.º 14/2020 confere a competência exclusiva à PJ relativamente à investigação dos crimes contra a segurança do Estado, para além disso, conforme o disposto no Regulamento Administrativo n.º 35/2020, foram criados na PJ o Departamento de Segurança e as suas quatro subunidades orgânicas, que são a Divisão de Informações de Segurança do Estado, a Divisão de Investigação de Crimes Relativos à Segurança do Estado, a Divisão de Apoio Operacional de Segurança do Estado e a Divisão Geral de Assuntos Relativos à Segurança do Estado, bem como foram criadas a Divisão de Alerta e Investigação de Crimes de Terrorismo e a Divisão de Cibersegurança. A par disso, a Divisão de Apoio Operacional foi extinta. A PJ passou a ser composta por 8 departamentos e 25 divisões após o reajustamento da estrutura e foi acrescentado um lugar de subdirector para responder à ampliação das competências. A PJ irá desenvolver, conforme a estrutura recentemente reorganizada, o trabalho de salvaguarda da segurança geral do Estado de acordo com a lei, para cumprir com maior eficácia as atribuições de combate e prevenção do crime.
Para além disso, para incentivar o desenvolvimento profissional da investigação criminal e melhorar a execução da lei, o Governo da RAEM aperfeiçou a carreira do pessoal de investigação criminal da PJ, criando as duas novas categorias de inspector chefe e de investigador criminal chefe e aumentando os requisitos académicos para acesso às categorias de inspector e de subinspector, no sentido de melhorar a eficácia do trabalho. Para além disso, criaram-se duas carreiras especiais de técnico superior de ciências forenses e de técnico de ciências forenses na área de provas materiais e na área de provas electrónicas, com o objectivo de criar uma equipa com competências profissionais em ciências forenses que se empenha no trabalho de apoio à investigação criminal e na defesa da cibersegurança.
