司警要求我提供公司某僱員的資料，但卻拒絕透露案件情況，我可否不向司警提供資料？

基於履行刑事調查的職責，本局有權要求任何自然人（個人）或法人（如公司）向本局提供協助，亦有權向有助發現犯罪行為人及有助重組犯罪過程的人收集資料。但由於在偵查過程中，任何得悉該訴訟程序資料的人士都受到司法保密原則的約束，因此，除非已獲司法當局（法官、預審法官及檢察院）的同意，本局要求市民提供資料時，一般不會透露案件資料，以免影響調查工作。

The Judiciary Police requested me to provide information of an employee of the company, but refused to reveal the case details.  Can I not provide information to the Judiciary Police?

In order to undertake the responsibility of criminal investigation, the Judiciary Police has the power to request any natural person (individual) or legal person (e.g. company) to provide assistance to the Judiciary Police, and the power to collect information from an individual assistive in discovering the criminal perpetrator(s) and an individual assistive in re-constructing the course of crime.  However, in the course of criminal investigation, any individual knowing the information of the proceedings is subject to the principle of judicial confidentiality.  Therefore, unless approved by the judicial authority (judges, pre-trial judges and Public Prosecutions Office), when the Judiciary Police requests a resident to provide information, information of the case will generally not be revealed, so as to avoid affecting the investigation work.

A PJ pediu-me para fornecer informações sobre um funcionário da companhia, mas foi-me recusada a revelação de pormenores sobre o caso, posso não dar as informações que a PJ pede?

Para o cumprimento das atribuições da investigação criminal, a PJ tem direito a pedir a qualquer pessoa singular (indivíduo) ou pessoa colectiva (ex.: companhia) para colaborar, como também tem direito a recolher informações junto das pessoas que podem ajudar na descoberta de actos criminosos e a reconstituição do crime. Contudo, durante a investigação, todas as pessoas que têm conhecimento das informações do processo são sujeitas ao princípio de segredo de justiça, portanto, salvo haja consentimento prévio das autoridades judiciárias (juízes, juízes de instrução e Ministério Público), a PJ não revela pormenores sobre o caso quando pede aos cidadãos para fornecer informações, isto para não afectar o trabalho de investigação.
