請問報案人是否有權知道案件的調查內容及調查過程？

在偵查階段中的刑事案件，所有知悉案件資料的人士都必須遵守司法保密的原則。因此，本局人員不能將案件的調查內容告知報案人。但在不違反司法保密原則的前提下，本局人員可向報案者披露關於案件調查進度的資訊。自2008年中開始，本局實施主動向報案人發出案件立案偵查通知及案件完成偵查通知的措施，增加刑偵工作的透明度，使報案人知悉負責跟進的部門和人員，以及卷宗移送至檢察院的時間。

Does the informant have the right to know the investigation content and investigation process of a case?

In the investigation phase of a criminal case, all individuals, who know the information of the case, must observe the principle of judicial confidentiality.  Therefore, Judiciary Police officers cannot notify the informant of the investigation content.  However, as a prerequisite without violating the judicial confidentiality, the Judiciary Police officers can reveal to the informant the information regarding the progress of investigation of the case.  From mid-2008 onwards, the Judiciary Police has carried out the measure of sending notifications of initiation and completion of investigation of the case to the informant pro-actively, in order to increase the transparency of criminal investigation work, so that the informant knows the department and officer responsible for the follow-up as well as the time when the dossier is transferred to the Public Prosecutions Office.

O denunciante tem direito a saber o conteúdo e o desenvolvimento da investigação do caso?

Relativamente aos crimes em investigação, todas as pessoas que têm conhecimento das informações relativas ao caso são obrigadas a cumprir o princípio de segredo de justiça, portanto, não podemos revelar o conteúdo da investigação ao denunciante, mas podemos dar informações em relação ao progresso da investigação, sem prejuízo do segredo de justiça. Desde meados de 2008, temos emitido, de forma pro-activa, ao denunciante uma notificação sobre a instauração do processo e a conclusão da investigação, com vista a melhorar o grau de transparência do trabalho de investigação, dando ao denunciante a conhecer as informações sobre as subunidades e investigadores responsáveis pelo seguimento do caso e o tempo de entrega do processo ao MP.
