我早前到司法警察局報案，當時已錄了一次口供，後來又收到檢察院邀請，需要再次就案件作出證言，為何會有這樣的要求呢？

根據《刑事訴訟法典》的規定，本局在接到市民舉報犯罪消息後，必須製作檢舉筆錄（俗稱落口供），在完成調查後將案卷移交檢察院，由其決定是否提出控訴。在確定是否提出控訴前，倘檢察院認為有需要對調查結果所載證據的真實性和充分性進行確定，可要求被害人、證人及嫌犯再次履行陳述義務。

Earlier on, I reported a case to the Judiciary Police while a statement was made at that time. Subsequently, I was also invited by the Public Prosecutions Office to testify again regarding the case.  Why would there be such a request?

According to the stipulation of the Criminal Procedure Code, upon receiving criminal information reported by a resident, the Judiciary Police must compose a record of complaint (commonly known as a statement).  Having completed the investigation, the dossier is transferred to the Public Prosecutions Office which will decide whether to launch prosecution.  Before confirming whether to launch prosecution, if the Public Prosecutions Office deems it necessary to verify the authenticity and adequacy of the evidence stated in the investigation results, the victim, witness and suspect may be requested to undertake the obligation to testify again.

Há alguns dias, fiz uma queixa na PJ. Naquela altura, prestei depoimentos, mas mais tarde, fui notificado pelo Ministério Público para voltar a prestar depoimento. Qual é a razão?

Nos termos do Código de Processo Penal, depois de recebida a denúncia, precisamos de elaborar um auto (vulgarmente conhecido por prestação de depoimentos). Após a conclusão da investigação, o processo é entregue ao MP para que decida se avançar com a acusação. Antes da acusação, se o MP considerar que é necessário verificar a veracidade e a suficiência das provas obtidas na investigação, pode pedir à vítima, testemunha e arguido para cumprir o dever de depoimento.
