我有一位朋友是澳門居民，近日在內地被另一名澳門居民毆打，我的朋友雖然已在內地報案，但內地警方將案件歸檔，未予控訴。現當事人雙方均已回澳，請問我的朋友可否向澳門警方報案？

根據澳門《刑法典》第5條規定在澳門以外作出的事實，澳門刑法亦具有管轄權的情況，當中第1款d)項規定由澳門居民對澳門居民在澳門以外作出的事實，只要行為人被發現身在澳門，澳門刑法亦適用。但需要強調的是，倘外地也奉行屬地原則、對同一案件也具有刑事管轄權時，澳門刑法是否適用，還須依據澳門《刑法典》第6條的規定來判斷：該條規定澳門刑法適用於澳門以外作出的事實，是以行為人在其作出事實之地未受審判，或行為人逃避履行當地全部或部分所判之刑為限。
在上述個案中，由於內地公安機關經調查後已將有關案件歸檔，沒有經過審判程序，故符合同一法典第6條的規定，本澳警方擁有管轄權，因此，本局根據上指法律條款及《刑事訴訟法典》第245條的規定接受檢舉，並進行立案偵查。

    I have a friend who is a Macao resident. He was beaten by another Macao resident in mainland China recently. Although my friend had already filed a complaint in the mainland, the mainland police simply filed the case and did not initiate a prosecution. Both parties have currently returned to Macao. Can my friend report the case to the Macao Police?

    According to the stipulation of Article 5 of the Macao Penal Code, for facts committed outside of Macao, the Macao criminal law still maintain its jurisdiction over this condition. In Section 1 Item d), it is stipulated that for facts committed outside of Macao by a Macao resident to another Macao resident, as long as the actor has been discovered in Macao, the Macao criminal law is still applicable. However, it should be emphasized that if the other locality also practises the principle of territoriality, with criminal jurisdiction over the same case, whether or not the Macao criminal law is applicable would be determined by the stipulation of Article 6 of the Macao Penal Code: it is stipulated that the application of Macao's criminal law to facts committed outside of Macao, is limited to the situation whereby the actor has not been tried at the place where the fact was committed, or the actor has evaded to serve all or part of the sentence given.

    In the above case, since the mainland security agency had filed the case after investigation, it had not gone through any trial procedure, thus it fits the stipulation of Article 6 of the Code and the Macao police have jurisdiction over the case. Hence, the Judiciary Police accept the report of the case in accordance with the stipulation of the above mentioned law and Article 245 of the Criminal Procedure Code, and launch a case file to investigate.

    Nos dias anteriores, um meu amigo, residente de Macau, foi agredido na China continental por outro residente de Macau, fez queixa na polícia do continente, a qual, porém, arquivou o processo e não deduziu nenhuma acusação. Agora, ambas as partes já voltaram para Macau e queria saber se o meu amigo possa apresentar a queixa na polícia de Macau?

    Nos termos do disposto no artigo 5.o do Código Penal, a factos praticados fora de Macau é também aplicável a lei penal de Macau, e nomeadamente, de acordo com o disposto na alínea d) do n.o 1 do mesmo artigo, a lei penal de Macau é ainda aplicável a factos praticados fora de Macau, por residente, contra residente de Macau sempre que o agente for encontrado em Macau. Contudo, importa salientar que, se o país estrangeiro tiver aderido ao princípio da territorialidade e tiver jurisdição penal sobre o mesmo caso, a questão de que é aplicável ou não a lei penal de Macau deve ser resolvida conforme o disposto do artigo 6.o do Código Penal, que estipula o seguinte: “A aplicação da lei penal de Macau a factos praticados fora de Macau só tem lugar quando o agente não tiver sido julgado no local da prática do facto ou se houver subtraído ao cumprimento total ou parcial da condenação”.

    Na situação acima referida, a autoridade de segurança pública da China, depois da sua investigação, arquivou o inquério sem julgamento, sendo esta a razão pela qual a polícia de Macau tem a juridição, o que está em conformidade com o artigo 6.o do mesmo Código. Por isso, a PJ, nos termos dos dispostos supracitados e do artigo 245.o do Código de Processo Penal, recebe a denúncia e instaura o precesso de inquérito.
