我是一間超市的東主，日前有兩名年輕人在我的超市偷竊，被超市經理當場逮獲及報警處理，但事後才得悉其中一名嫌犯是我多年的鄰居，嫌犯父母請求我不要告他的兒子，最終我接納了其請求，但是，我仍想追究案中另一名嫌犯的刑事責任，請問可以部份撤回我的告訴權嗎？

不可部份撤回，只可全部撤回。根據澳門《刑法典》第108條第3款規定，對任一共同犯罪人撤回告訴時，其餘同屬非經告訴不得被追訴的共同犯罪人亦因此而得益，但此等共同犯罪人反對告訴的撤回者，不在此限。按這一規定，如超市東主撤回對任一盜竊嫌犯的告訴，則同時亦會撤回案中其他嫌犯的告訴，除非受惠的嫌犯表示反對，即他們堅持需要法院審理以證明其清白，否則，撤回對任一嫌犯的告訴便等同於撤回對全部嫌犯的告訴，不會再審理其他一同犯罪者的刑事責任。即使在報案時，亦不容許只追究其中一名共犯的刑事責任，根據《刑法典》第106條規定，追究其中一人的刑事責任，即代表同時追究其餘共同犯罪人的刑事責任。

    I am the owner of a supermarket. Some days ago, 2 teenagers committed theft in my supermarket. They were caught by the supermarket manager on the spot and police were called to handle the case. However, I realized afterwards that one of the suspects was a neighbour of mine for many years, whose parents implored me not to report their son and I accepted their request in the end. But I still would like to pursue the criminal responsibility of the other suspect in this case, can I partially withdraw my right of complaint?

    It cannot be partially withdrawn as only complete withdrawal is allowed. According to the stipulation of Section 3 of Article 108 of the Penal Code of Macao, the withdrawal of the complaint against any one of the accomplices of the crime will also benefit the remaining accomplice who cannot be prosecuted without complaint. However, this shall not apply if the accomplice opposes the withdrawal of the complaint. According to this stipulation, if the supermarket owner withdraws the complaint against one of the theft suspects, simultaneously the complaint against the other suspect in the case will be withdrawn, unless there is opposition from the benefited suspect, that is, he insisted the court to try his case to prove his innocence. Otherwise, the withdrawal of the complaint against any one of the suspects equates to the withdrawal of the complaint against all the suspects. The criminal responsibility of the other accomplice would no longer be tried. At the time when the complaint is being filed, it is also not allowed to pursue the criminal responsibility of only one of the accomplices. According to the stipulation of Article 106 of the Penal Code, pursuing the criminal responsibility of one of them means pursing the criminal responsibility of all other accomplices at the same time.

    Sou o proprietário de um supermercado, onde dois jovens furtaram há dias, o gerente conseguiu apanhá-los e pediu a intervenção da polícia, só depois fiquei a saber que um dos suspeitos é o meu vizinho que conheço há muitos anos, os seus pais rogam-me que não me queixe contra o filho. Afinal, aceito o pedido deles e ainda desejo, porém, o proedimento penal contra o outro suspeito. Gostaria de saber se poderei desistir da queixa parcialmente?

    Pode apenas desistir de toda a queixa mas não parcialmente, porque, nos termos do disposto no número 3.o de artigo 108.o do Código Penal, “A desistência da queixa relativamente a um dos comparticipantes no crime aproveita aos restantes, salvo oposição destes, nos casos em que também estes não possam ser perseguidos sem queixa”. Isto é, se o proprietário do supermercado desistir da queixa relativa a qualquer um dos suspeitos no crime de furto, a queixa contra o outro suspeito também vai ser retirada, salvo se o suspeito aproveitador se opuser à desistência, ou seja, insistir em justificar a sua inocência através do julgamento do tribunal, senão, a desistência da queixa relativamente a qualquer um dos suspeitos se tornará extensiva ao restante suspeito. Para além disso, não se permite, na apresentação da queixa, exigir a responsabilidade penal de um só dos comparticipantes no crime, porque, conforme o disposto no artigo 106.o do Código Penal, “A apresentação da queixa contra um dos comparticipantes no crime torna o procedimento penal extensivo aos restantes”.
