我經營小生意，最近與鄰店的店東因貨物擺賣問題曾經發生口角，今天他又因相同的原因拿起剪刀並稱“信不信我刺死你？！”雖然他最後沒有用剪刀刺我，但他說話時十分激動，我害怕有一天他真的會襲擊我，我可否報警？

上述個案中，雖然行為人說出“信不信我刺死你”這句話，但沒有採取任何實際攻擊性行為，然而，根據《刑法典》第147條的規定，行為人的言行已涉嫌觸犯恐嚇罪。為此市民可向本局報案求助，若情況十分緊急，亦可向治安警察局尋求協助，立即控制現場情況。

    I run a small business. Recently, I have quarreled with the owner of a neighbourhood store over the issue of placement of goods. Today, due to the same issue, he held a pair of scissors to threaten me and said: “Don’t you believe I’ll stab you to death?” Although he did not use it to stab me at last, he was extremely agitated while speaking; I am afraid that he would really attack me one day, can I call the police?

    In the above case, despite the actor uttered the sentence “Don’t you believe I’ll stab you to death”, he did not carry out any actual offensive act. However, according to the stipulation of Article 147 of the Penal Code, the actor’s words and deeds involved the perpetration of the offence of threat. In view of this, the resident can call the Judiciary Police for help. In case of urgency, the Public Security Police Force may also be sought for assistance, so as to immediately rein in the situation on the spot.

    Tenho uma loja pequena e, nestes dias, tive altercações com o proprietário da loja vizinha por causa da colocação das mercadorias. Hoje, o proprietário, pela mesma razão, pegou uma tesoura e disse: “Queres uma facada?”. Nessa altura, estava muito agitado embora não me tenha esfaqueado, receio que ele me possa agredir, posso fazer a denúncia agora?

    No caso acima mencionado, o agente não teve efectivamente nenhum comportamento ofensivo mesmo que tenha proferido a frase “Queres uma facada?”. Contudo, nos termos do disposto no artigo 147.o do Código Penal, a expressão e a conduta do agente já podem constituir o crime de ameaça. Para tal, a outra parte pode apresentar queixa à PJ ou, em situações urgentes, pedir a intervenção da PSP, no sentido de controlar a situação in loco.
