損失少於澳門幣3萬元的詐騙罪不屬於公罪，因此，需要被害人報案及要求追究作案者的刑事責任，警方才能開始刑事訴訟程序。如果案件中的被害人沒有報案及提出追究，警方即使搜集到充分證據，基於該罪的性質，不能對無人報案的騙案作出刑事追究。

If the victim of the case does not make a report and pursue the criminal responsibility, even if the police have collected sufficient evidence, based on the nature of the case, criminal responsibility cannot be pursued for a fraud case that no one has made a report.
