我的家人在露台吸煙後，隨手便將未熄滅的煙蒂丟棄，不幸燒着樓下鄰居的衣服。他不是故意的，也願意賠償損失，為甚麼警方仍要拘捕他？

由於你家人的疏忽大意，最終導致失火，有可能觸犯《刑法典》第264條“造成火警、爆炸及其他特別危險行為”罪，可被處最高五年徒刑；假如相關火警令樓宇、建築物、交通工具、叢林或樹林被燒毀，因而對他人生命造成危險、對他人身體完整性造成嚴重危險，或對屬巨額之他人財產造成危險，可被處最高八年徒刑；若有關火警導致他人重傷甚至死亡，將按《刑法典》第273條的規定對行為人作加重處罰。同時，行為人亦須依法承擔相應民事責任。

亂丟煙蒂既缺公德，更對他人的生命財產安全構成嚴重威脅，市民應確保火種完全熄滅並妥善處理煙蒂，切勿貪一時之便而禍己禍人，付出沉重代價。

After smoking in the balcony, my family member casually discarded the unextinguished cigarette stub.  Unfortunately, it ignited my neighbour’s clothes downstairs.  He did not mean it, and is willing to compensate the loss.  Why did the police still arrest him?

Due to your family member’s negligence, it eventually caused fire.  This might constitute Article 264 of the Penal Code “causing fire, explosion and other exceptionally dangerous behaviour”, which is punishable with imprisonment of up to 5 years.  In the event that the related fire incinerates a building, construction, means of transport, forest or trees, creating danger to another person’s life, serious danger to another person’s physical integrity or risk to another person’s property of high value, this shall be punishable with imprisonment of up to 8 years.  If the related fire causes serious injury or even death to another person, the penalties of the perpetrator shall be aggravated as stipulated in Article 273 of the Penal Code.  Simultaneously, the perpetrator shall also undertake the civil responsibility accordingly.

Not only is littering cigarette stubs uncivil, it also causes serious threat to the safety of life and property of the others.  Residents should make sure that the tinder is completely put out and cigarette stubs are properly discarded.  Do not go for a moment of convenience which harms yourself and others, and a heavy price has to be paid.

A negligência do seu familiar, que acabou por causar o incêndio, pode constituir o crime de Incêndios, explosões e outras condutas especialmente perigosas, previsto no artigo 264.º do Código Penal e ser punido com pena de prisão até 5 anos. Quem provocar incêndio queimando edifícios, construções, meios de transporte, mata ou arvoredos, e criar deste modo perigo para a vida, perigo grave para a integridade física de outrem ou perigo para o património alheio de valor elevado, é punido com pena de prisão até 8 anos. Se do fogo resultar ofensa grave à integridade física ou morte de outra pessoa, o agente é punido conforme o artigo 273.º do Código Penal com a pena agravada, devendo também, nos termos da lei, assumir as correspondentes responsabilidades civis.

Deitar pontas de cigarro é uma conduta que não tem virtude moral e ameaça gravemento a vida e os bens dos outros. Por isso, as pessoas devem garantir que o cigarro esteja totalmente extinto e despejar as beatas de forma adequada, para evitar que isso as prejudique ou que faça mal aos outros e pague caro o comportamento.
