根據澳門《刑法典》第191條“不法之錄製品及照片”罪的規定，未經同意，將他人所述而非以公眾為對象的言詞進行錄音，即使該等言詞係對錄音的人所述者，又或使用或容許他人使用該錄製品，即使錄製品係合乎規範製作者，可處最高2年徒刑或科最高240日罰金。所謂的“非以公眾為對象的言詞”是指在客觀上具有隱密性，不是向外公開的言論。如行為人為使自己或他人獲得酬勞或得利，或為造成他人或澳門地區有所損失而作出上述行為，又或透過社會傳播媒介作出該行為，則該罪的最低及最高刑罰將提高三分之一，即最高可處2年8個月徒刑或科最高320日罰金。

此外，在違反他人意願的情況下，我們不可強行或私下對別人進行拍攝，例如我們絕不能在公眾場所或私人地方強行拍攝他人，又或使用針孔攝錄機偷拍他人更衣、洗澡、如廁等，否則，將觸犯“不法之錄製品及照片罪”。

According to the stipulation of Article 191 of the Macao Penal Code, for the offence of “illegal recordings and photographs”, a person who records words spoken by others which are not intended for the public without the speaker’s consent, even if those words are intended for that person; or uses or allows others to use such recording, even if the produced recording conformed to standard, shall be liable to imprisonment of up to 2 years or a fine of up to 240 days.  “Words which are not intended for the public” refers to words that are objectively private in nature, which are not open to public.  If the abovementioned acts are made by the actor to obtain reward or benefits for himself or others, or incur loss to others or the Macao region, or such acts are made via the social communication media, the minimum and maximum punishment of that offence shall be increased by one-third, i.e. an imprisonment of up to 2 years and 8 months or a fine of up to 320 days.

Moreover, under the circumstances whereby the wishes of others have been violated, we cannot take a picture of/ film video others forcibly or privately; e.g. forcibly taking a picture of or filming others in public venues or private areas or video-recording others secretly with pinhole camera while they are changing clothes, taking shower, using toilet, etc. are absolutely not allowed, or else the offence of “illegal recordings and photographs” will be committed.

Conforme o disposto no artigo 191.o do Código Penal de Macau sobre o crime de gravações e fotografias ilícitas, quem, sem consentimento, gravar palavras proferidas por outra pessoa e não destinadas ao público, mesmo que lhe sejam dirigidas, ou utilizar ou permitir que se utilizem as gravações referidas, mesmo que licitamente produzidas, é punível com pena de prisão até 2 anos ou com pena de multa até 240 dias. As chamadas “palavras proferidas não destinadas ao público” são palavras que têm, objectivamente, carácter privado e não são proferidas publicamente. No caso de o autor praticar o acto referido para obter recompensa ou enriquecimento, para si ou para outra pessoa, ou para causar prejuízo a outra pessoa ou ao Território de Macau; ou através de meio de comunicação social, as penas são elevadas de um terço nos seus limites mínimo e máximo, ou seja, é punível com pena de prisão até 2 anos e 8 meses ou com pena de multa até 320 dias.

Para além disso, não se pode filmar, pela força ou em privado, outra pessoa contra a sua vontade. Por exemplo, não podemos, absolutamente, filmar outra pessoa pela força em locais públicos ou privados, ou usar uma câmara de vídeo pinhole para filmar outra pessoa a mudar de roupa, tomar banho, ir à casa de banho, etc., nestes casos incorre-se no crime de gravações e fotografias ilícitas.
