冒稱警察的乙、丙二人截停路人甲，以查證和搜身為名要甲將手機和錢包交出，二人乘機取去現金後離開。請問甲可以怎樣做？

乙、丙自稱警察並要求甲出示身份證的行為，使甲相信他們是正在執行警察職務的警務人員，故應其二人要求交出身上財物進行查核，這說明乙、丙在明知及有意識的情況下，以其言行向他人暗示自己具有警務人員身份，並將他人財物據為己有，其行為構成了《刑法典》第322條a)項規定的職務之僭越罪，將面臨處最高2年徒刑，或科最高240日罰金的處罰。同時，他們通過上述使甲產生錯覺的詭計，導致甲作出了造成其本人財產損失的行為，令他們詐騙得逞，該行為構成了《刑法典》第211條的詐騙罪。

 因此，被害人應儘快向警方報案，讓警方將不法之徒繩之以法。

Arrogating as policemen, B and C intercepted a passer-by A, demanding him to hand over his mobile phone and wallet on the pretext of checking his ID and frisking him. The duo took the opportunity to snatch the cash and left. What could A do?

The act of B and C claiming to be policemen and demanding A to show his ID made A believe that they were police officers exercising their police duty, and thus handed over his property for verification as per their demand.  This indicated that B and C knowingly and consciously implied to others their identity as policemen with their words and behaviours, and took forcible possession of others’ property.  Such act has already constituted the offence of usurpation of duty as stipulated in Item a) of Article 322 of the Macao Penal Code, which will lead to penalty of imprisonment of up to 2 years or a fine of up to 240 days.  At the same time, by using the abovementioned trick that deluded A, they led him to behave in a way that caused damage to his personal property, making their fraud successful.  Such act has constituted the offence of fraud in Article 211 of the Macao Penal Code.

Therefore, the victim should report it to the police as soon as possible so as to bring the criminals to justice.

B e C fizeram-se passar por polícias e interceptaram o indivíduo A para a verificação de documentos e revista, exigindo-lhe a entrega do telemóvel e da carteira, os dois aproveitaram e furtaram o dinheiro, depois fugiram. Neste caso o que é que A deve fazer?

Exigiram a A que entregasse o bilhete de identidade, este acto de B e C, alegando ser polícias, fez com que A confiasse neles, pensando que de facto eram polícias e estavam a exercer as suas funções, por essa razão fizeram o pedido, isto demonstra que B e C sabiam e tinham noção de que a sua atitude de se arrogar essa qualidade, e apropriar-se dos bens de outrem, constitui o crime estipulado na alínea a) do artigo 322.º, usurpação de funções, do Código Penal, os dois podem ser punidos com pena de prisão até 2 anos ou com pena de multa até 240 dias. Ao mesmo tempo, utilizaram uma forma astuciosa, e por meio de erro ou engano, causaram a A, um prejuízo patrimonial, assim cometeram também uma burla, de acordo com o artigo 211.º do Código Penal.

É por isso que a vítima deve denunciar, o mais rápido possível, o facto à polícia, para que esta leve o criminoso à justiça.
