澳門《刑法典》第257條第一款b)項規定，信用卡為等同貨幣之物，故可以適用該法典中關於偽造貨幣的相關條文。如果行為人事前明知其所持有的信用卡為假卡，卻仍使用該卡購物支付貨款，說明其故意將假卡充當正當信用卡使用，因此，其行為構成第255條第1款a)項的將假信用卡轉手罪，可被科處最高5年徒刑。

According to the stipulation of Article 257, Section 1, Item b) of the Macao Penal Code, credit card is equivalent to currency, and therefore applicable to the relevant articles on counterfeit currencies as stated in the Macao Penal Code. If the actor is well aware in advance that the credit card in hand is a counterfeit card yet still uses it for payment, it is clear that the actor has purposely used the counterfeit card as a legitimate credit card. Therefore, such act constitutes the offence of “passing on counterfeit credit card” in Article 255, Section 1, Item a), and is liable to a term of imprisonment of up to 5 years.

Nos termos previstos na alínea b) do n.º 1 do artigo 257.º do Código Penal de Macau, os cartões de crédito são equiparados a moeda, portanto podem ser aplicáveis os respectivos artigos do mesmo diploma em relação à falsificação de moeda. Se o agente tem conhecimento de que o cartão de crédito que possui é falso, e mesmo assim, continua a utilizá-lo para efectuar pagamentos, significa que ele utiliza, com dolo, o cartão falso como legítimo, por conseguinte, a sua prática constitui crime de uso de cartão de crédito falso, previsto na alínea a) do n.º 1 do artigo 255.º, e é punido com pena de prisão até 5 anos.
