我在網上認購拍賣貨品，並按賣家要求交付貨款，惟對方收取貨款後沒有如期送貨，並失去聯絡，我亦無從追討已付的金錢。請問我應如何是好？

在上述個案，市民按賣家要求交付貨款後未能收到貨物，且無法與對方取得聯絡，賣家的這種為獲取利益，使用詭計誤導、欺騙，使他人財產有所損失的行為，已經構成《刑法典》第211條的詐騙罪，處最高3年徒刑或科罰金。市民如發現可疑情況，應停止交易。如果不幸被騙，應即時報警求助。

In the above case, the resident paid as per the request of the seller but failed to receive the goods, and was unable to contact the seller. The seller’s act to gain a profit by using schemes to mislead and deceive, causing property loss to others had constituted the offence of fraud in Article 211 of the Penal Code, and was punishable by 3 years of imprisonment or a fine. If a resident finds the situation suspicious, he or she should stop the transaction. In the unfortunate case of being deceived, he or she should report to the police for assistance immediately.

Fiz uma compra na internet e paguei conforme a solicitação daquele vendedor, mas a entrega das mercadorias não foi efectuada no prazo combinado após o pagamento, o vendedor não responde assim não consegui recuperar o dinheiro pago. Como é que devo fazer?

Neste caso, o comprador já fez o pagamento mas não conseguiu receber as mercadorias no prazo fixado, ainda que não seja contactável, o vendedor teve a intenção de obter para si enriquecimento ilegítimo, por meio de erro ou engano que causou a outra pessoa um prejuízo patrimonial, pode ser punido com pena de prisão até 3 anos ou com pena de multa por burla, nos termos do artigo 211.º do Código Penal. Se suspeitar que existem circunstâncias suspeitas, deve cessar a transacção de imediato. Se for enganado, deve informar a polícia imediatamente.
