我在街上停泊私家車輛，在取車時發現車窗被人打破，車內的智能手機被偷走，請問是否屬於一般的盜竊罪嗎？

根據《刑法典》第198條第1款b)項規定，如果被盜竊的他人動產是由交通工具運送的，行為人處最高5年徒刑。該項包含任何機動或非機動車輛所載的物品，即使車輛並非處於行駛狀態亦然。上述個案中，市民的智能手機放置在車輛內，而該車處於停駛狀態，故應適用該項規定，即行為人觸犯了《刑法典》第198條第1款b)項的加重盜竊罪，可處最高5年徒刑的刑罰。

I parked my private car on the street and found that the car window was broken, and the smartphone inside the car was stolen when I picked up my car. Is this an ordinary theft?

According to Section 1 Item b) of Article 198 of the Penal Code, if the stolen property belonging to others is delivered by means of transportation, the offender is liable to a maximum penalty of 5 years of imprisonment. As stipulated in the aforementioned Item, items on any motor or non-motor vehicle, even if the vehicle is not moving, are included. In the above case, the resident’s smartphone was placed in a vehicle which was not moving, thus making the stipulation applicable. The offender had committed aggravated theft in Section 1 Item b) of Article 198 in the Penal Code, and was punishable by a maximum penalty of 5 years of imprisonment.

Quando fui buscar o meu veículo estacionado na rua, descobri que a janela tinha sido arrombada, e que o telemóvel que estava dentro do carro tinha sido furtado. Este caso é de se considerar como crime de furto comum?

Em conformidade com o disposto na alínea b) do n.º 1 do art. 198.º do Código Penal, quem furtar coisa móvel alheia transportada em veículo, é punido com pena de prisão até 5 anos. A alínea engloba objecto transportado por qualquer veículo motorizado ou não-motorizado, ainda que não se encontre em estado de marcha. No caso em apreço, é aplicável a disposição, uma vez que o telemóvel foi colocado dentro do veículo e aquele veículo encontrava-se estacionado, isto é, o agente cometeu o crime de furto qualificado, previsto na alínea b) do n.º 1 do art. 198.º do Código Penal, punível com pena de prisão até 5 anos.
