為遏止本澳居民北上吸毒，司法警察局與廣東省警方於2005年1月簽訂了《粵澳警方禁毒部門關於對廣東省內查獲的澳門籍吸毒人員移交出境合作協議》。

根據上述協議的規定，在廣東省內因吸食或注射毒品而被捕的澳門居民會被當地警方根據內地法律處理，包括拘留最長15日，並沒收毒品和吸食、注射器具，同時會被吊銷《港澳居民來往內地通行證》，3年內不得進入內地。拘留期滿後，廣東省警方會將吸毒人士移交澳方處理，本局將認別其身份資料，以查證是否有涉及本澳其他毒品罪案。

在本澳，吸毒屬於刑事罪行，一經定罪可處最高一年徒刑，或科最高240日罰金。如涉及販賣毒品（包括送贈、分發、讓與、購買或以任何方式收受、運載、不法持有等行為），最高可被判處15年徒刑。

In order to deter residents of Macao from abusing drugs in the Mainland, the Macao Judiciary Police and the Guangdong Provincial Police signed the “Co-operative Agreement of the Narcotics Authorities of the Guangdong and Macao Police for the Handing over of Drug-Taking Macao Residents Seized within the Guangdong Province” in January 2005.

According to the provisions of the above agreement, Macao residents arrested for consuming or injecting drugs in the Guangdong Province will be dealt with by the local police under the laws of the Mainland, including detention for up to 15 days, and confiscation of drugs and consumption and injection paraphernalia.  At the same time, the “Permit for Travelling to and from the Mainland for Hong Kong and Macao Residents” will be revoked and they will not be allowed to enter the Mainland for three years.  Upon the expiry of the period of detention, the Guangdong Provincial Police will hand over the drug abusers to Macao for processing. The Macao Judiciary Police will verify the identity of the drug abusers to ascertain if they are involved in other drug crimes in Macao.

Drug abuse is a criminal offence in Macao and is punishable on conviction by imprisonment of up to 1 year or a fine of up to 240 days.  In the case of drug trafficking (including giving, distributing, transferring, buying or in any way receiving, transporting, illegal possessing, etc.), the maximum penalty of 15 years of imprisonment may be sentenced.

Para evitar o consumo de droga de residentes de Macau na China continental, a Polícia Judiciária e as autoridades da província de Guangdong assinaram em Janeiro de 2015, o “Acordo de Cooperação, entre as Subunidades de Combate à Droga das Polícias da Província de Guangdong e de Macau, para a Entrega em Macau de indivíduos aqui Residentes, Consumidores de Substâncias Estupefacientes e Detidos na Província de Guangdong”.

Em conformidade com o disposto no referido acordo, os residentes de Macau quando forem detidos na Província de Guangdong por ingerir ou injectar drogas, serão tratados pela polícia local de acordo com a lei da China continental, incluindo a detenção por um período de 15 dias, a apreensão de drogas e utensílios para o consumo e a injecção, a revogação do salvo-conduto de entrada na China continental para os 3 anos sucessivos. Depois da detenção, a polícia de Guangdong transfere os detidos para Macau, e a PJ procede à identificação para verificar se há envolvimento noutros casos de droga de Macau.

Em Macau, considera-se o consumo de droga como crime, que é punido com pena de prisão até 1 ano ou até 240 dias de multa. No caso do tráfico de droga (que inclui oferecer, distribuir, ceder, comprar ou de qualquer outra forma receber, transportar ou ilicitamente deter), a pena máxima é de 15 anos de prisão.
