兩男女涉相當巨額詐騙及偽造具特別價值文書被拘
2023年7月18日內地男事主向本局舉報,指其姑媽伙同他人向本澳公證署作虛假聲明,從而獲得事主已故伯父在澳唯一遺產繼承人的身份並成功繼承三個共值300萬澳門元的物業,導致事主損失至少150萬澳門元。
本局經濟罪案調查處人員展開調查,發現事主伯父於2016年11月身故,其遺產包括三個本澳物業,其後事主姑媽與一名本澳男子合謀,由該名男子找來三人於2018年10月3日在確認繼承資格的程序中向本澳公證署作虛假聲明,隱瞞事主的代位繼承資格並聲明事主姑媽為遺產唯一繼承人,從而令事主姑媽成功獲得公證處簽發“確認繼承資格公證書”並繼承事主伯父名下的三個本澳物業。案中兩名在公證程序中作虛假聲明的本澳男子已於早前被本局以偽造具特別價值的文件罪移送檢察院偵辦。
2024年1月22日及23日,涉案內地女子(即事主姑媽)與涉案本澳男子被截獲。經查,涉案內地女子承認串謀涉案本澳男子安排不認識的三名人士,向公證署作虛假聲明以繼承事主伯父的三個本澳物業;而涉案本澳男子則拒絕配合調查。
本局根據調查所得,以詐騙(相當巨額)罪及偽造具特別價值之文件罪將兩人移送檢察院偵辦。
Man and woman arrested for fraud of considerably huge amount and forgery of documents of special value
On 18th July 2023, the Judiciary Police received a complaint from a male mainland victim, alleging that his aunt conspired with others to make a false declaration to the Public Notary Office of Macao, so as to obtain the status of sole heir of the deceased uncle of the victim in Macao and successfully inherited three properties with a total worth of three million patacas, causing the victim to lose at least 1.5 million patacas.
The personnel of the Economic Crimes Division of the Judiciary Police launched an investigation, and found that the victim’s uncle passed away in November 2016, and his inheritance included three properties in Macao. The victim’s aunt conspired with a local man subsequently, who found three persons to make false declarations to the Public Notary Office of Macao during the procedure of confirming inheritance qualification on 3rd October 2018, concealing the victim’s qualification for subrogation while declaring the victim’s aunt was the sole heir of the inheritance. As a result, the victim’s aunt successfully obtained the “Confirmation of Inheritance Qualification” issued by the Public Notary Office and inherited the three properties in Macao of the victim’s uncle. Two local men in this case, who had made false declarations during the notary procedure, had been transferred to the Public Prosecutions Office earlier by the Judiciary Police with the offence of forgery of documents of special value.
On 22nd and 23rd January 2024, the involved mainland woman (ie the victim’s aunt) and the involved local man were intercepted. After investigation, the involved mainland woman admitted to have conspired with the local man to arrange three unknown individuals to make false declarations to the Public Notary Office in order to inherit the three properties of the victim’s uncle in Macao, while the involved local man refused to cooperate with the investigation.
Based on investigative findings, the Judiciary Police transferred the duo to the Public Prosecutions Office with the offences of fraud (considerably huge amount) and forgery of documents of special value.
Detido um casal por burla de valor consideravelmente elevado e de falsificação de documento de especial valor
No dia 18 de Janeiro, um homem da RPC fez queixa à PJ, dizendo que a sua tia, em conluio com terceiros, terá prestado falsas declarações junto do Cartório Notarial de Macau para ser reconhecida como única herdeira do tio do queixoso. Tendo assim conseguido herdar três imóveis em Macau, no valor total de 3.000.000 de patacas, o que lhe causou um prejuízo, de pelo menos 1.500.000 de patacas.
O pessoal da Divisão de Investigação de Crimes Económicos iniciou uma investigação, na qual descobriu que o tio tinha falecido em Novembro de 2016 e que a sua herança incluía 3 imóveis em Macau. Posteriormente a tia, em parceria com um homem local, e este arranjou três pessoas para prestarem falsas declarações junto do Cartório Notarial no dia 3 de Outubro de 2018 e no acto da confirmação do processo de habilitação notarial de herdeiros essas pessoas ocultaram a qualidade de representação sucessória da vítima e declararam que a tia da vítima era a única herdeira, a fim de que esta pudesse obter a “escritura pública de habilitação notarial de herdeiros” emitida por aquela instituição e herdar os três imóveis em Macau. Os dois homens locais que tinham prestado falsas declarações naquele processo foram detidos pela PJ por falsificação de documento de especial valor e presentes ao MP.
A mulher da RPC em causa (tia da vítima) e o homem local foram detidos em 22 e 23 de Janeiro de 2024. A mulher admitiu que, com o suspeito, tinha contactado três homens locais desconhecidos para prestarem falsas declarações, para dessa forma, herdar os três imóveis, tendo o suspeito recusado cooperar na investigação.
O casal foi presente ao MP acusado de burla (valor consideravelmente elevado) e de falsificação de documento de especial valor.
