本澳男子涉詐騙、清洗黑錢及犯罪集團被拘
2023年12月20日,一名事主到本局檢舉,表示其電話號碼無故被加入以投資股票為名的聊天群組內,之後有一名聲稱是投資助理的人士主動聯絡事主向其推送投資網站,由於事主有意投資,故按對方指示提供個人資料登記一個投資帳戶,並分10次將約30萬港元存入對方指定的四個本澳銀行帳戶作為投資股票之用。起初均可透過投資網站獲利,並成功取現5,000多港元。之後,對方更要求事主投入更多款項以作為抽新股之費用,隨後由於一直都未能取回早前投資的本金及回報,因此懷疑被騙,故到本局報警求助,報稱損失約30萬港元。
本局資訊罪案調查處開展調查,經分析銀行交易記錄,發現其中一名收款帳戶為涉案男子持有,曾收取76萬港元,當中有50萬港元已透過提款機提取,其餘款項則透過網上銀行轉帳轉走。有關騙款涉及本案多名潛在事主,之後本局成功聯絡七名事主到本局協助調查,七名事主均表示收到投資股票的資訊後,應要求匯款投資,直至接獲本局通知才獲悉被騙,七人合共損失約140萬港元。
除此之外,該涉案帳戶亦涉及本局近月的六宗案件,當中事主同樣因收到投資股票的資訊後,應騙徒要求匯款到本澳、香港或內地銀行帳戶進行投資,事後一直未能取回本金及回報,故到本局報案,六宗案件合共損失約100萬港元。
本局鎖定多名收取贓款的涉嫌人士資料,於2024年1月4日成功在青茂口岸截獲其中一名收取贓款的涉案本澳男子。
該男子承認於2023年12月18日至20日,與另外多名在逃涉嫌人應上線要求提供本澳銀行帳戶作收款及操控,事後其獲利3,000澳門元,但否認知悉銀行帳戶收取贓款及否認參與詐騙犯罪行為。
經綜合調查,涉案本澳男子伙同多名在逃涉嫌人士至少涉及七宗案件、13名被害人,合共損失270萬港元,當中涉案本澳男子的銀行帳戶合共收取至少76萬港元的騙款。
本局根據調查所得,以詐騙(相當巨額)罪、清洗黑錢罪及犯罪集團罪將其移送檢察院偵辦,並繼續追查其他涉嫌人及騙款下落。
Local man apprehended for fraud, money laundering and criminal syndicate
A victim filed a complaint at the Judiciary Police on 20th December 2023, stating that his telephone number had been added to a chat group under the pretext of stock investment for no reason and that someone claiming as an investment assistant took the initiative to approach the victim subsequently to recommend him an investment website. Since the victim was interested in investment, he thus provided personal details for the registration of an investment account as instructed by the opposite party, with 10 deposits made to transfer approximately HKD300,000 into the four local bank accounts designated by the opposite party for stock investment. At first, profits could be generated via the investment website and the victim could successfully withdraw cash of more than HKD5,000. Later, the opposite party even requested the victim to invest more fund for Initial Public Offering (IPO) subscription. Since the victim failed to retrieve the capital previously invested and the returns, he suspected that he had been defrauded and thus reported to the Judiciary Police for help, stating that a loss of approximately HKD300,000 had been incurred.
The I.T. Crimes Division of the Judiciary Police initiated an investigation. Analysis on the bank transaction records revealed that one of the beneficiary accounts was held by the involved man and it had been used to receive HKD760,000, among which HKD500,000 had already been withdrawn via ATM, while the rest of the fund had been transferred via online banking. The relevant fraudulent proceeds involved multiple potential victims in this case. Later, the Judiciary Police successfully contacted 7 victims, who came to the Judiciary Police to assist in investigation, stating that they had remitted money for investment as requested upon the receipt of the stock investment information. It was not until they received notification from the Judiciary Police did they realize that they had been defrauded, with a total loss of approximately HKD1,400,000 incurred to the seven of them.
Apart from this, the involved account was also related to the 6 cases at the Judiciary Police in recent months in which the victims, upon the receipt of the stock investment information similarly, failed to retrieve the capital and returns after remitting money as instructed by fraudsters into bank accounts in Macao, Hong Kong and the mainland for investment. They thus reported to the Judiciary Police and the total loss incurred in the 6 cases was approximately HKD1,000,000.
The Judiciary Police identified the information of various suspects collecting the illicit proceeds, with an involved local man who had received the illicit proceeds intercepted at the Qingmao checkpoint successfully on 4th January 2024.
The man admitted that he, together with various suspects at large, had provided local bank accounts for beneficiary and manipulation purpose as required by the upper level members between 18th and 20th December 2023. He received remuneration of MOP3,000 afterwards. However, not only did he deny knowing about the receipt of illicit proceeds in his bank account, but he also denied having participated in the crime of fraud.
Integrated analysis revealed that the involved local man and several suspects at large were related to at least 7 cases, involving 13 victims and a total loss of HKD2,700,000, in which the bank account of the involved local man had received fraudulent proceeds of at least HKD760,000 in total.
Based on investigative results, the Judiciary Police transferred the involved man to the Public Prosecutions Office for the offences of fraud (considerably huge amount), money laundering and criminal syndicate, while continuing to pursue the whereabouts of other suspects and the fraudulent proceeds.
Detido um residente por burla, branqueamento de capitais e associação criminosa
No dia 20 de Dezembro de 2023, uma pessoa fez queixa à PJ, dizendo que o seu número de telefone, sem motivo, foi integrado num grupo de conversa relativo a investimento em acções, mais tarde um indivíduo que se dizia ser assistente de investimento, promoveu, por iniciativa própria, um site de investimento, como o denunciante estava interessado em investimentos, disponibilizou, de acordo com as orientações da outra parte, os seus dados para registá-los numa conta de investimento e depositou, em dez ocasiões, cerca de 300.000 HK$ para quatro contas bancárias indicadas para esse fim. No início, lucrou e conseguiu levantar mais de 5.000 HK$ daquele site. Depois, a outra parte pediu à vítima que depositasse mais dinheiro para a subscrição de uma Oferta Pública Inicial, a partir daquele momento, nunca mais conseguiu recuperar o capital anteriormente investido nem os rendimentos. Apercebeu-se que tinha sido burlado e fez queixa à PJ, declarou que sofreu um prejuízo de cerca de 300.000 HK$.
A Divisão de Investigação de Crimes Informáticos iniciou a investigação, analisou os registos dos movimentos bancários e constatou que uma das contas de recebimento de fundos pertencia ao suspeito e tinha sido utilizada para receber 760.000 HK$, de entre estes, 500.000 HK$ tinham sido levantados numa máquina ATM e o restante dinheiro tinha sido transferido através de um banco online. O montante pertencia a várias potenciais vítimas do caso em investigação, posteriormente, a PJ conseguiu contactar sete pessoas que foram vítimas, para se irem à PJ para colaborar na investigação, todas disseram que depois de receber as informações acerca do investimento em acções, fizeram, conforme solicitado, remessas. Só se aperceberam que tinham sido burladas depois de receber a nossa notificação, as sete vítimas sofreram um prejuízo total de cerca de 1.400.000 HK$.
A par disso, aquela conta bancária também estava relacionada com seis casos ocorridos nos últimos meses. As vítimas, da mesma forma, por terem recebido informações de investimento em acções, fizeram, a pedido dos burlões, remessas de dinheiro para contas bancárias de Macau, Hong Kong ou China continental, mas acabaram por não conseguir recuperar o capital investido e os rendimentos, assim fizeram queixa, o prejuízo total dos seis casos ronda o milhão de HK$.
A PJ identificou vários indivíduos que supostamente estão relacionados com o recebimento do dinheiro proveniente das burlas, um desses, residente, foi detido no Posto Fronteiriço Qingmao no dia 4 de Janeiro de 2024.
O homem admitiu que entre 18 e 20 de Dezembro de 2023, em conluio com vários indivíduos em fuga, disponibilizou, a pedido dos membros a montante, a conta bancária local para receber o dinheiro e efectuar movimentações, declarou ter lucrado 3.000 patacas. Contudo negou que tivesse conhecimento de que a conta bancária servia para receber dinheiro do crime como também negou ter participado na burla.
Efectuada uma investigação integrada, o detido, em conluio com outros indivíduos em fuga, estava relacionado com pelo menos sete casos, o que envolveu 13 vítimas que ficaram com um prejuízo total de 2.700.000 HK$, do qual, a conta do detido recebeu, pelo menos 760.000 HK$, dinheiro proveniente das burlas.
Conforme apurado, o detido foi presente ao MP pelos crimes de burla (valor consideravelmente elevado), branqueamento de capitais e associação criminosa. A PJ continua à procura de outros cúmplices e do destino do dinheiro das burlas.
