本澳男地產中介涉詐騙及信任之濫用被捕
本局於今年8月下旬先後接獲三名於本澳就讀大學的內地學生報案,指透過社交群組認識的本澳男地產中介的協助租住本澳住宅單位,但被對方騙取租金,三人損失合共約87,300港元。
本局經濟罪案調查處人員查悉,該名男地產中介訛稱續約並一次過繳交一年租金可享九折優惠,騙取首名報案的內地學生及其兩名室友合共160,900港元;以及收取次名及第三名報案的內地學生及其兩名室友合共54,400港元後未轉交予業主。
本局人員於8月31日尋獲該名男中介,其承認未經業主同意私自向租客收取租金,騙取約40個單位合共約210萬港元租金用於個人投資股票,雖其後陸續替各租客繳交約150萬港元租金,但因投資虧蝕,尚有15個單位合共60萬港元租金未交還予業主。
本局以詐騙(相當巨額)罪及信任之濫用(巨額)罪將涉案男子移送檢察院偵辦。由於涉及事件的眾多內地學生於暑假離開後尚未回澳,本局將會密切跟進案件。
Local male real estate agent involved in fraud and abuse of trust under arrest
In late August this year, the Judiciary Police successively received reports from three mainland students studying in the universities in Macao, indicating that they had rented residential units in Macao with the assistance of a local male real estate agent whom they got acquainted through a social networking group, yet were defrauded of the rents by the male real estate agent. The three individuals suffered a total loss of approximately HKD87,300.
The Economic Crimes Division personnel of the Judiciary Police found out upon investigation that the male real estate agent, by falsely claiming that a 10% discount could be offered for renewing the tenancy agreement and making a one-off payment of one year’s rent, had swindled the first reporting mainland student and his two roommates out of HKD160,900 in total, and failed to hand over the total amount of HKD54,400 to the landlords which he had received from the second and the third reporting mainland students and his two roommates.
The Judiciary Police personnel located the male agent on August 31st, who admitted that he had collected rents from the tenants without the consent of the landlords and obtained a total of approximately HKD2.1 million of rents from around 40 units by deception, which were subsequently used for personal investment in stocks. Although he subsequently paid approximately HKD1.5 million of rents on behalf of the tenants, due to the losses incurred in the investment, the rents of 15 units totaling MOP600,000 had not yet been returned to the landlords.
The Judiciary Police transferred the involved man to the Public Prosecutions Office for the offences of fraud (considerably huge amount) and abuse of trust (massive amount). As many of the mainland students involved in the incident have not yet returned to Macao after leaving for summer break, the Judiciary Police will closely follow up the case.
Detido um agente imobiliário de Macau por burla e abuso de confiança
Em finais de Agosto deste ano, a PJ recebeu as denúncias de três estudantes da China continental que frequentavam a Universidades de Macau, dizendo que alugaram apartamentos através de um agente imobiliário de Macau que tinham conhecido em grupos na rede, mas acabaram por ser burlados nas rendas num total de 87.300 HKD.
Na investigação a Divisão de Investigação de Crimes Económicos, apurou que esse agente tinha dito aos inquilinos que poderiam usufruir de 10% de desconto nas rendas caso renovassem os seus contratos e pagassem previamente, de uma só vez, as rendas do ano todo, assim conseguiu, com este esquema, burlar 160.900 HKD pagos pelo primeiro denunciante e seus dois coinquilinos, e 54.400 HKD do segundo e terceiro denunciantes e de outros dois coinquilinos, obviamente o dinheiro nunca chegou aos senhorios.
No dia 31 de Agosto, o nosso pessoal conseguiu encontrar o agente imobiliário, o qual admitiu que, sem ter o consentimento dos senhorios, tinha cobrado rendas aos inquilinos, tendo-se apropriado de cerca de 2.1 milhões de HKD de rendas em relação a 40 apartamentos, com o propósito de fazer um investimento pessoal em acções. Posteriormente, o agente entregou, em nome dos inquilinos, aproximadamente, 1.5 milhões de HKD aos proprietários, porém, em consequência das perdas no investimento, faltavam 600.000 HKD de rendas de 15 apartamentos para ser pagos aos outros proprietários.
O homem foi presente ao MP por burla (de valor consideravelmente elevado) e abuso de confiança (de valor elevado). A PJ continua a acompanhar o caso, uma vez que muitos estudantes do continente envolvidos ainda não regressaram a Macau por causa das férias de Verão.
