本澳女子涉簽發空頭支票被捕
2022年6月6日,本局接獲一名香港女子檢舉其本澳女友人向其簽發空頭支票,導致損失600萬港元。
案情顯示,兩人的丈夫於2015年5月合資1,600萬港元投資生意,但涉案女子丈夫缺乏資金,故向女事主借取1,000萬港元作投資及周轉,並承諾於2016年3月全數歸還;涉案女子丈夫分多次攤還款項,但仍拖欠600萬港元。直至2021年8月,涉案女子向女事主簽發一張600萬港元支票作擔保,女事主於2022年5月31日支票到期日仍未收到還款,故於翌日帶同支票前往銀行兌現,發現因支票戶口存款不足而無法兌現,其後向本局檢舉。
本局於2022年9月13日傳召涉案本澳女子接受調查,其承認因無力還款而犯案。本局以簽發空頭支票(相當巨額)罪將涉案女子移送檢察院處理。
Local woman arrested for issuing rubber cheque
On 6th June 2022, the Judiciary Police received a report from a Hong Kong woman claiming that a female friend from Macao had issued a rubber cheque to her, which then caused her a loss of HKD6 million.
Case details revealed that in May 2015, the husbands of the duo engaged in a joint investment of HKD16 million for a business venture, yet the involved woman’s husband was short of funds. Hence, a sum of HKD10 million was borrowed from the female victim for investment and cash flow purposes, with the promise to repay in full in March 2016. The involved woman’s husband had been repaying by installments but still owed HKD6 million. It was until August 2021 that the involved woman issued a cheque for HKD6 million to the female victim as guarantee. On 31st May 2022, the due day of the cheque, the female victim had yet to receive any repayment. As such, she brought the cheque to the bank the following day for cashing out but to no avail due to insufficient deposit in the cheque account. Later, the victim reported to the Judiciary Police.
On 13th September 2022, the Judiciary Police summoned the involved local woman for investigation, who confessed that she had perpetrated the crime because she was unable to repay the debt. The Judiciary Police transferred the involved woman to the Public Prosecutions Office with the charge of issuing rubber cheque (considerably huge amount).
Detida uma residente por ter passado um cheque sem provisão
No dia 6 de Junho de 2022, a PJ recebeu uma denúncia duma residente de HK, dizendo que uma residente local, amiga da denunciante, emitiu-lhe um cheque sem provisão, que lhe causou um prejuízo de 6 milhões de HKD.
Segundo a investigação e declarações, os maridos das duas mulheres juntaram dinheiro, em Maio de 2015, no valor de 16 milhões de HKD, para investimento dum negócio. Entretanto, o marido da mulher envolvida deste caso como teve falta de dinheiro e pediu à denunciante dinheiro emprestado, no valor de 10 milhões de HKD para investimento e encargos financeiros, prometendo-lhe devolver o dinheiro todo em Março de 2016. Apesar de o marido da mulher envolvida ter devolvido o dinheiro devido por prestações, ainda lhe estava a dever 6 milhões de HKD. Em Agosto de 2021, a mulher envolvida passou um cheque no valor de 6 milhões de HKD como sinal mas, no dia 31 de Maio de 2022, prazo do cheque, a denunciante não conseguiu receber o dinheiro devido e assim, no dia seguinte, levou o cheque até ao banco para levantar o dinheiro onde, nessa altura se deu nota que não havia dinheiro suficiente na conta daquele cheque. Por consequência, foi fazer denúncia na PJ.
No dia 13 de Setembro de 2022, a PJ pediu à mulher envolvida para colaborar na investigação, tendo esta admitido o crime, explicando que não tinha capacidade de devolver o dinheiro prometido. A mulher foi presente ao MP, acusada de crime de cheque sem provisão (de elevado valor).
