某天，我陪同即將入讀幼稚園的兒子在房間午睡，趁他入睡後將之獨留在家短暫外出購物。兒子隨後睡醒大哭，一時害怕而攀上陽台邊緣呼喊，鄰居驚覺立即報警，並破門解救。若兒子在我離家期間遭受任何損傷，我是否需要承擔法律責任？

父母對子女負有法定的保護及看管義務，不論父母外出時間長短（即使短暫離家），或因外出工作等理由，均不應將年幼子女獨留家中；一旦實施該行為，即須依法承擔刑責。若子女因獨留家中而受傷、甚至死亡，父母須承擔更重的刑責。

根據澳門《刑法典》第135條第一款b）項規定，作出遺棄因年齡、身體缺陷或疾病致不能自救之人，而行為人係對其負有保護、看管或扶助義務，使他人有生命危險者，可處最高五年徒刑。該條文第二款、第三款、第四款規定，如該行為由被害人之直系血親尊親屬作出，則行為人處最高五年徒刑；如因該事實引致身體完整性受嚴重傷害或致人死亡，可處最高15年徒刑。

本局鄭重呼籲各位家長，切勿把年幼子女獨留在家，哪怕只是短時間外出，也應請親友幫忙照料，或是將孩子帶在身邊，以免孩子出於恐懼而作出危險行為，切實為孩子築牢生命安全的“防護欄”。

One day, I accompanied my son, who was about to start kindergarten, to take a nap in the bedroom. After he fell asleep, I left him home alone and went outside shopping for a short time. My son later woke up and cried. Frightened, he climbed up the edge of the balcony and shouted, prompting a neighbour to call the police and break in to rescue him. If my son suffered any injuries while I was away from home, would I be held legally responsible?

Parents have the statutory obligation to protect and supervise their children. Regardless of the length of time a parent is away (even leaving home briefly), or for reasons like going out for work, young children should not be left home alone. If such act is committed, the parents shall be held criminally liable in accordance with the law. If the children sustain injury or even death as a result of being left home alone, the parents shall bear even greater criminal responsibility.

According to Paragraph 1b) of Article 135 of Macao Penal Code, abandoning a person who is unable to save oneself due to age, physical disability or illness, and to whom the actor has the obligation to protect, supervise or assist, thus endangering the life of the person, is punishable by up to five years of imprisonment. Paragraph 2, 3 and 4 of the article stipulate that if the act is committed by a direct blood relative of the victim, the actor is subject to a maximum sentence of five years’ imprisonment. If the fact results in serious harm to bodily integrity or death, the actor is subject to a maximum sentence of 15 years’ imprisonment.

The Judiciary Police solemnly urges all parents not to leave their young children alone at home. Even if they are just going out for a short time, they should ask relatives or friends to help care for their children, or bring their children with them, to prevent the children from engaging in dangerous behaviour out of fear, practically building a strong “safeguard” for the children’s safety.

Um dia, acompanhei o meu filho, que estava prestes a ingressar para o jardim de infância, para dormir uma sesta no seu quarto. Depois dele adormecer, deixei-o sozinho em casa e saí, por um curto período de tempo, para fazer compras. Posteriormente, o meu filho acordou e começou a chorar e com medo trepou para a beira da varanda, gritando por ajuda. O vizinho ouviu os gritos, fez logo a denúncia à polícia, que depois arrombou a porta da casa para o resgatar. Caso o meu filho tivesse sofrido algum ferimento no período da minha ausência, teria eu de assumir responsabilidade legal?

Os pais têm o dever legal de cuidar e vigiar os seus filhos. Independentemente do tempo em que estejam ausentes de casa (mesmo que por breves instantes) seja por motivos de trabalho ou outros, os filhos menores não devem ser deixados sozinhos em casa. A prática dessa conduta está sujeita a responsabilidade criminal, conforme previsto na lei. Caso a criança venha a sofrer ferimentos ou perder a vida, a responsabilidade criminal dos pais será agravada.

Conforme o disposto na alínea b) do n.º 1 do artigo 135.º do Código Penal de Macau, quem colocar em perigo a vida de outra pessoa, abandonando-a sem defesa, em razão da idade, deficiência física ou doença, sempre que ao agente coubesse o dever de a guardar, vigiar ou assistir, é punido com pena de prisão de limite máximo de 5 anos. Nos n.os 2, 3 e 4 do mesmo artigo estabelece-se ainda que, se o facto for praticado por ascendente da vítima, o agente é punido com pena de prisão máxima de 5 anos; se do facto resultar uma ofensa grave à integridade física ou até resultar a morte, o agente é punido com pena de prisão até 15 anos.

A PJ apela solenemente a todos os pais para que não deixem os seus filhos menores sozinhos em casa. Mesmo que saiam por um curto período de tempo, devem solicitar o apoio de familiares ou amigos para tomar conta deles, ou levá-los consigo para evitar que, por medo, se envolvam em comportamentos perigosos. Assim, contribuirão para a construção de uma sólida “barreira de protecção” que salvaguarde a vida dos seus filhos.
