毒品犯罪對社會、尤其是對青少年造成的禍害深遠，澳門特區政府根據不同時期的相關犯罪形勢，適時在司法及執法層面作出相適應的措施和部署，達到有效預防和打擊的目的。

根據現行第17/2009號法律《禁止不法生產、販賣和吸食麻醉藥品及精神藥物》（下稱《禁毒法》）第8條規定，“不法販賣麻醉藥品及精神藥物”是指未經許可而送贈、準備出售、出售、分發、讓與、購買或以任何方式收受、運載、進口、出口、促成轉運或不法持有該法律表一至表三所列之植物、物質或製劑的行為，違法者可被科處5年至15年徒刑。如將毒品交予未成年人，根據該法第10條（九）項規定，刑罰的最低及最高限度均加重三分之一，即行為人最高可被處20年徒刑。

Facing drug crimes that profoundly scourge the society, especially young people, the Macao SAR Government timely adopts corresponding measures and deployments on judicial and law enforcement levels in response to criminal landscapes at different times, achieving the goals of effective prevention and combat.

According to the provisions of the current Law no. 17/2009 “Prohibition of the illegal production, trafficking and use of narcotic drugs and psychotropic substances” (hereinafter referred to as “Anti-drug Law”) Article 8, the “illegal trafficking of narcotic drugs and psychotropic substances” refers to the act of unauthorised giving, preparation for sale, sale, distribution, transfer, purchase or in any way receiving, transporting, importing, exporting, facilitating transit or illegal possession of plants, substances or preparations listed in Tables I to III of the Law. The offender is liable to a term of imprisonment of 5 to 15 years. If the drug is handed over to a minor, the minimum and maximum penalties are increased by one third, i.e. the actor is liable to a maximum penalty of 20 years of imprisonment, according to the provisions of Article 10 (9) of that Law.

Os crimes relacionados com droga causam problemas profundos e duradouros na comunidade, nomeadamente para os jovens. Com o objectivo de prevenir com eficácia e combater estes crimes, o Governo da RAEM toma as medidas e os preparativos mais oportunos, a nível jurídico e de execução da lei, de acordo com a realidade criminal dos diferentes períodos.

Conforme o disposto no artigo 8.º da Lei n.º 17/2009 (Proibição da produção, do tráfico e do consumo ilícitos de estupefacientes e de substâncias psicotrópicas, ou simplesmente Lei de Combate à Droga) em vigor, o “tráfico ilícito de estupefacientes e de substâncias psicotrópicas” refere-se a quem, sem se encontrar autorizado, oferecer, puser à venda, vender, distribuir, ceder, comprar ou por qualquer título receber, transportar, importar, exportar, fizer transitar ou ilicitamente detiver plantas, substâncias ou preparados compreendidos nas tabelas I a III da referida lei, é punido com pena de prisão de 5 a 15 anos. E, nos termos da alínea 9) do artigo 10.º da mesma lei, se a droga for entregue a menores, as penas são agravadas de um terço nos seus limites mínimo e máximo, e o agente é punido com pena de prisão até 20 anos.
