五本澳男女涉相當巨額詐騙就逮
2024年4月19日及20日,本局接獲多名本澳居民報案,稱早前分別在本澳北區三間貿易行以高價購入花膠、瑤柱和鮑魚等大量海味,其後按貿易行職員指示,將貨物帶到珠海指定店舖以取回貨款並賺取帶工費,惟珠海店舖以無錢為由拒絕收貨,眾人將貨物帶返本澳要求貿易行退款亦遭拒絕,故懷疑被騙。
4月20日,治安警察局將同案13名本澳事主連同兩男兩女涉案本澳居民移交本局跟進調查。
本局經濟罪案調查處對案件進行串併分析,發現三間貿易行的登記人為一名內地人士,店舖日常營運由三男兩女涉案本澳居民負責,涉案大部分貨款由其中一名涉案本澳男子收取。此外,本局經徵詢專業人士對案中貨物的鑑定意見,得悉有關海味市價遠低於涉案貿易行的售價。綜合調查所得,有強烈跡象顯示五名涉案本澳男女合謀以先墊支購貨、再帶貨到內地退回貨款及賺取帶工費的走私方式,誘騙“水客”以高於貨物真實價值二至八倍的價格購入貨物,其後拒絕收貨及退款,從而詐騙金錢。案中27名事主報稱合共損失約357萬澳門元,各人損失由一萬多至數十萬澳門元不等。
2024年4月20日晚,本局人員於北區截獲一名涉案本澳男子並將之帶返本局,經調查發現其負責每日到涉案貿易行收取貨款。
本局根據調查所得,以詐騙(相當巨額)罪將五名涉案本澳男女移送檢察院偵辦,並就懷疑有人觸犯現行第7/2003號法律《對外貿易法》的情況向澳門海關通報。
Five locals arrested for fraud of considerably huge amount
On 19th and 20th April 2024, the Judiciary Police received reports from a number of local residents, alleging that they had earlier purchased a large amount of dried seafood, including fish maws, dried scallops and abalones at high prices from three trading firms respectively in the North District in Macao, and subsequently brought the goods to the designated store in Zhuhai as per the instructions of the staff members of the trading firms, in exchange for refund of the goods payment and earning parallel trading fees. However, the store in Zhuhai refused to accept the goods due to lack of money. They therefore took the goods back to Macao and requested the trading firms for refund but were also refused, hence suspecting that they had been scammed.
On April 20th, the Public Security Police Force transferred 13 local victims along with two men and two women involved in this case to the Judiciary Police for follow-up investigation.
Subsequent to serial-parallel analysis on the case by the Economic Crimes Division of the Judiciary Police, it was found that the registrant of the three trading firms was a mainland individual. The daily operation of the firms was run by the involved three men and two women, who were local residents, while most of the involved goods payment was collected by one of the involved men. In addition, having sought professional advice on the identification of the involved goods, it was realised that the market price of the related dried seafood was much lower than the selling price charged by the involved trading firms. After consolidation of the investigative results, there were strong indications that the five involved local men and women had conspired to defraud the victims of money by employing the smuggling method of advancing payment for the purchase of goods, subsequently bringing the goods to mainland for refund of the goods payment and earning parallel trading fees, thereby enticing the “parallel traders” to purchase the goods at a price two to eight times higher than the true value of the goods, with subsequent refusal to accept the goods and offer refunds. The 27 victims of the case reported a total loss of approximately MOP3.57 million, with each individual’s loss ranging from over MOP10,000 to hundreds of thousands of MOP.
On the night of 20th April 2024, the Judiciary Police personnel intercepted an involved local man in the North District and took him in. Investigation revealed that he was responsible for collecting the goods payment in the involved trading firms every day.
Based on the investigative results, the Judiciary Police transferred the five involved local men and women to the Public Prosecutions Office for the offence of fraud (considerably huge amount), while notifying the Macao Customs Service of suspected breaches of the existing Law No. 7/2003 “Foreign Trade Law”.
Cinco pessoas de Macau detidas por burla de valor consideravelmente elevado
Em 19 e 20 de Abril de 2024, a PJ recebeu as denúncias de vários residentes de Macau, dizendo que tinham comprado grandes quantidades de marisco seco, como ictiocolas, vieira e abalone, a preços altos em três agências comerciais na zona norte de Macau, e que mais tarde, seguindo as instruções dos funcionários das agências comerciais, trouxeram estes mercadorias para uma loja indicada em Zhuhai para recuperar o dinheiro das mercadorias e ganhar uma comissão para levá-las para Zhuhai, no entanto, a loja em Zhuhai recusou-se a aceitar as mercadorias dizendo que tinham falta de dinheiro, assim, eles trouxeram as mercadorias de volta a Macau e pediram às agências comerciais em Macau o reembolso, que també lhes foi recusado, assim suspeitaram ter sido burladas.
No dia 20 de Abril, o CPSP transferiu para a PJ 13 vítimas de Macau, relacionadas com o mesmo caso, bem como dois homens e duas mulheres suspeitos, também residentes locais, para dar seguimento à investigação.
A Divisão de Investigação de Crimes Económicos fez uma análise combinada dos casos, descobriu que as três agências comerciais eram registadas em nome da mesma pessoa, um indivíduo da China continental, a operação diária das agências era da responsabilidade dos três homens e duas mulheres de Macau, envolvidos no caso, e a maior parte do dinheiro das mercadorias era recebida por um dos envolvidos de Macau. Além disso, após ter consultado os profissionais para dar um parecer pericial em relação às mercadorias em questão, ficou determinado que o preço de mercado desses mariscos secos era muito inferior ao que foi pago às agências. A investigação integrada levou a fortes indícios de que os cinco indivíduos de Macau, induziam, em conluio, os “comerciantes paralelos”, com o esquema de contrabando no qual o pagamento das mercadorias era feito antecipadamente, e depois as levava para a RPC para o reembolso das compras e recebia uma comissão pelo trabalho efectuado, levando assim os “comerciantes paralelos” a comprar mercadorias entre duas e oito vezes mais caras do que o seu valor verdadeiro, recusando-se depois a recebê-las e a reembolsar a despesa, burlando desta maneira as vítimas. As 27 vítimas do caso disseram que tinham sofrido um prejuízo total de cerca de 3,57 milhões de patacas, tendo cada um delas perdido quantias entre mais de 10.000 e centenas de milhares de patacas.
Na noite de 20 de Abril de 2024, o nosso pessoal interceptou um homem de Macau envolvido no caso na zona norte e levou-o para as instalações da PJ. Na investigação, apurou-se que este era responsável por ir receber o dinheiro das mercadorias diariamente nas agências comerciais em causa.
Conforme o que foi apurado na investigação, os cinco detidos foram presentes ao Ministério Público por burla (valor consideravelmente elevado), ao mesmo tempo foi comunicado aos Serviços de Alfândega de Macau a existência de uma violação da Lei n.º 7/2003 “Lei do Comércio Externo”.
