四名男女涉相當巨額詐騙及犯罪集團被捕
本局資訊罪案調查處人員跟進調查2023年4月24日偵破的電話詐騙集團案,於4月26日再拘捕包括一名集團骨幹成員在內合共兩名本澳男子,並搜獲一件外賣員制服及扣押一輛電單車。據查,涉案集團骨幹成員操控本次及早前行動中被捕的三名涉案男子共同作案,他們於過去三個月內多次喬裝外賣員前往犯罪窩點維護作案設備,以逃避偵查。
調查過程中,本局人員揭發其中兩名於本次及早前被捕的涉案男子伙同兩名女子詐騙水貨店及水客,隨即將兩名涉案女子帶返調查。
調查發現,四人在內地購入一批廉價花膠,將之偽裝成上等花膠,然後招攬水客將之帶到內地指定地點交收,但要求水客先出資購買,待運至指定地點交收後便會返還本金及獲得報酬,但涉案人等隨後向本澳及內地海關舉報,故意令相關貨物被充公,藉此拒絕向水客返還款項,以牟取不法利益;四人又表示欲將上述“上等花膠”運到內地,以每包300元人民幣報酬誘騙一名男事主協助運送,但對方須支付每包1,000元人民幣訂金,男事主於2023年4月兩度運送合共598包花膠到內地,但收貨人藉詞花膠重量不足而拒絕付款及拒收當中398包花膠,男事主損失27.5萬元人民幣訂金及運費。
同時,本局人員在上述於早前被捕的涉案男子的公司內發現一個模擬內地海關充公貨物的場景,經訊問得悉涉案人等替水貨店運送花膠往內地,但卻將花膠帶到上述地點拍攝貨物被內地海關沒收的虛假視頻,藉以侵吞貨物,至被捕時作案一宗,涉款約1,000澳門元;本局人員亦於現場檢獲一批假燕窩及化妝品的包裝盒,不排除涉案人等涉及其他詐騙犯罪。
本局以詐騙(相當巨額)罪及犯罪集團罪將四名涉案男女送交檢察院偵辦,並跟進調查案中的水貨活動。
Four men and women apprehended for fraud of considerably huge amount and criminal syndicate
During the follow-up investigation on a case of telephone scam syndicate cracked on 24th April 2023, the personnel of the IT Crimes Division of the Judiciary Police further apprehended a total of 2 local men, including a core member of the syndicate on April 26th, with a uniform of deliveryman seized and a motorcycle detained. Upon investigation, it was found that the involved core member of the syndicate had manipulated the 3 involved men apprehended this time and in the previous operation for joint perpetration. In the past 3 months, they disguised as deliverymen to maintain the equipment for perpetration at the crime hub on multiple occasions to avoid investigation.
During the course of investigation, the personnel of the Judiciary Police unveiled that 2 of the involved men apprehended this time and earlier had defrauded parallel import shop and parallel traders together with 2 women, who were swiftly brought back for investigation.
Investigation revealed that the four had purchased a batch of inexpensive fish maw in the mainland and camouflaged it as top-notch fish maw. Parallel traders were solicited to take it to a designated spot in the mainland for trading. However, the parallel traders would have to pay for the goods first and they could get back the capital and the remuneration after they had taken the goods to the designated spot for trading. Nonetheless, the involved individuals subsequently reported to the Customs Service in Macao and the mainland, leading to the confiscation of relevant goods on purpose and thus refusing to return the money to the parallel traders in order to gain illicit profits. The four also expressed that they had intended to convey the abovementioned “top-notch fish maw” back to the mainland and lured a male victim to assist in the transportation at a remuneration of RMB300 per pack. However, the opposite party had to pay a deposit of RMB1,000 per pack first. The male victim conveyed a total of 598 packs of fish maw to the mainland on two occasions in April 2023. However, the recipient, using insufficient weight of the fish maw as an excuse, refused to pay and rejected 398 packs of fish maw. The male victim thus lost RMB275,000 of deposit and transportation fees.
Meanwhile, the personnel of the Judiciary Police found a scenario simulating the confiscation of goods by the mainland Customs Service in the company of the abovementioned involved man who had been apprehended earlier. Interrogation revealed that the involved individuals were to convey fish maw to the mainland for the parallel import shop. However, they took the fish maw to the abovementioned location to produce fake videos depicting the confiscation of goods by the mainland Customs Service so as to misappropriate the goods. They had perpetrated the crime once before they were arrested, involving an amount of approximately MOP1,000. The personnel of the Judiciary Police also seized a batch of counterfeit bird nest and the packaging of cosmetics at the scene. The possibility that the involved individuals were also involved in other fraudulent crimes would not be ruled out.
The Judiciary Police transferred the four involved men and women to the Public Prosecutions Office for the offence of fraud (considerably huge amount) and criminal syndicate, and would follow up with the investigation of the parallel goods activities in the case.
Detidos quatro indivíduos por burla de valor consideravelmente elevado e associação criminosa
O pessoal da Divisão de Investigação de Crimes Informáticos acompanhou a investigação de uma rede de burla telefónica, desmantelada em 24 de Abril, dois dias depois, foram detidos outros dois homens locais, um deles, um elemento principal, e ainda foram encontrados alguns uniformes do pessoal de entrega de take-away e foi apreendida uma mota. Conforme a investigação, aquele elemento principal controlava três dos envolvidos, os quais foram detidos anteriormente e no caso em investigação para a prática conjunta, estes, ao longo de três meses, disfarçavam-se, em várias ocasiões, de pessoal de entrega de take-away para irem ao abrigo para a manutenção de equipamentos, com vista a escapar às investigações.
Na investigação, o nosso pessoal descobriu que dois dos agora detidos burlaram lojas ligadas ao “comércio paralelo” e operadores de “comércio paralelo”, em conjunto com duas mulheres, as quais foram levadas às nossas instalações para investigação.
Apurou-se que os aqueles quatro indivíduos compraram “ictiocolas” a um preço acessível e embalaram-nas para fingirem que fossem de primeira qualidade e angariaram operadores de “comércio paralelo” para as levar para um local indicado no continente, contudo exigiam àqueles operadores que comprassem esse produtos primeiro e prometiam devolver-lhes o capital e as remunerações após a entrega feita. Por outro lado, os envolvidos comunicavam o facto aos Serviços de Alfândega de Macau e do continente, com o propósito de fazer com que as mercadorias fossem confiscadas, para usar isso como razão para não lhes devolver o dinheiro, obtendo, desta forma, lucros. Os quatro detidos disseram que pretendiam levar as “ictiocolas de primeira qualidade” para o continente, desta forma iriam burlar a vítima, um homem, ao qual levavam o produto e que recebia 300 yuans por cada embalagem, mas como contrapartida, a vítima tinha de dar 1.000 yuans como depósito por cada embalagem. E assim, a vítima transportou, em Abril de 2023, em duas ocasiões, 598 embalagens desse tipo de produto para o continente, mas o receptor do outro lado disse que o peso das “ictiocolas” era insuficiente, portanto recusou-se de lhe pagar e de receber as restantes 398 embalagens, isto causou à vítima um prejuízo de 275.000 yuans em depósito e transporte.
Ao meso tempo, os nossos agentes descobriram, na empresa do suspeito anteriormente detido, um cenário simulado de confisco de mercadorias pela alfândega da China continental. No interrogatório, apurou-se que aquele detido e outros ajudavam as lojas a transportar as “ictiocolas” para o continente, e faziam um vídeo fictício para mostrar que tinham sido confiscadas pelos serviços de alfândega, para se apropriarem do produto. Até o momento da detenção, este último tipo de esquema tinha sido usado uma vez e envolveu cerca de 1.000 patacas. Por outro lado, foram apreendidas algumas caixas de embalagem de ninhos de andorinha falsos e artigos cosméticos, não se exclui que os indivíduos envolvidos estivessem relacionados com outros crimes de burla.
Os quatro detidos foram presentes ao MP acusados de burla (valor consideravelmente elevado) e de associação criminosa. A PJ continua a investigar as actividades de “comércio paralelo” deste caso.
