本局偵破一宗假聘用詐騙政府外勞配額案 六名本澳居民被捕
2022年10月10日本局接獲檢舉,指一名經營車行的本澳女東主涉不實申報僱員資料及虛構勞務關係,以騙取外地僱員配額。
本局有組織罪案調查處人員調查後發現,涉案女東主自2008年起先後虛報聘請五名本地僱員,並每年向社會保障基金及財政局申報,最終騙得七名外地僱員配額。
涉案的五名本澳居民承認於2008年開始先後獲涉案女東主虛假聘用,但從未在車行工作。於2020年至2022年新冠疫情期間,涉案女東主及五名涉案本澳居民再以虛假的勞務關係,向本澳政府部門遞交《僱員、自由職業者及商號經營者援助款項計劃》申請,並獲批准,涉案女東主因此騙取到186,400澳門元政府資助,而五名涉案本澳居民每人亦騙得40,000澳門元政府資助。
本局人員成功逮獲案中六名男女,起回當中的12萬澳門元贓款,並於2023年1月17日以偽造文件、詐騙(相當巨額)、詐騙 (巨額)、為取得許可而虛偽作出並主張某些法律行為等罪將被捕女東主及五名涉案本澳居民送交檢察院偵辦。
Six local residents arrested in the crackdown of a case of fabricated employment to defraud government of non-resident workers quota
The Judiciary Police received complaint on 10th October 2022 that a local female owner of a car dealership was involved in false declaration of employee information and fabrication of labour relations to defraud of non-resident workers quota.
Upon investigation, the Organized Crime Division officers of the Judiciary Police found that the involved female owner had made successive false declarations of the employment of five local employees to the Social Security Fund and the Financial Services Bureau annually since 2008, eventually defrauding of the quota for seven non-resident workers.
The five involved local residents admitted to their successive fake employment by the involved female owner since 2008, despite their non-existent work at the car dealership. During the COVID-19 pandemic between 2020 and 2022, the involved female owner and the five involved local residents, again using their fabricated labour relations, applied for the “Subsidy scheme for employees, freelancers and business operators” at local government departments. Upon approval of the applications, the involved female owner defrauded of a subsidy of MOP 186,400, while the five involved local residents defrauded of a subsidy of MOP 40,000 each.
Arresting the six involved persons, the Judiciary Police retrieved MOP 120,000 of the stolen proceeds, while transferring the arrested female owner and the five involved local residents to the Public Prosecutions Office for the charges of document falsification, fraud (considerably huge amount), fraud (massive amount), deceptive implementation and invocation of certain legal acts to obtain authorization, etc. on 17th January 2023.

Em 10 de Outubro de 2022, a PJ recebeu uma denúncia que indicava que uma mulher residente, proprietária de uma oficina de automóveis, teria declarado falsamente dados de empregados e de relações de trabalho para requerer quotas de trabalhador não residente.
Na investigação, o pessoal da Divisão de Combate ao Banditismo verificou que a suspeita tinha declarado falsamente, desde 2008, a contratação de cinco trabalhadores residentes, e entregava, anualmente, as declarações ao Fundo de Segurança Social e à Direcção dos Serviços de Finanças, acabando por conseguir 7 quotas de trabalhador não residente.
Os cinco residentes envolvidos confessaram que tinham sido contratados falsamente pela suspeita desde 2008 e nunca chegaram a trabalhar na oficina. Entre 2020 e 2022, durante a pandemia, a mulher e os cinco residentes suspeitos voltaram a declarar falsamente a relação de trabalho, para requerer o “apoio pecuniário para aliviar o impacto negativo da epidemia nos trabalhadores, profissionais liberais e operadores de estabelecimentos comerciais”, que foi aprovado. A patroa e os cinco residentes suspeitos conseguiram burlar, respectivamente, 186.400 patacas e 40.000 patacas de apoio ao governo.
Os agentes da PJ detiveram os seis suspeitos e recuperaram 120.000 patacas do montante burlado. Em 17 de Janeiro de 2023, os mesmos foram presentes ao Ministério Público acusados de crimes de falsificação de documentos, burla de valor elevado, burla de valor consideravelmente elevado, e simulação e invocação de certos actos jurídicos para obtenção de autorizações.
