粵澳警方破不法經營賭博集團 共拘42名集團成員
2021年3月,本局情報及支援廳主動蒐集情報,指一個涉及內地、澳門及台灣地區的跨境犯罪集團,透過不法經營網絡博彩平台獲取不法利益。經立案偵查,發現犯罪集團亦與內地存有關聯。為此,本局與廣東省警方進行情報交流,並展開聯合調查。
其後,本局查知一名在本澳的涉案主腦身份、該集團設於皇朝區住宅單位的窩點及其運作模式,並且相信至少14名集團成員居澳,包括股東和代理人。
該集團先由主腦開設多個帳戶,股東則負責物色及組織代理人,再由代理人招攬賭客進行網絡賭博。集團提供多個網絡賭博遊戲,並涉及經營網絡外圍波,在內地及境外均設有據點,後台伺服器及集團大部份運作均在境外地區,且透過受操控的内地銀行帳戶、或以加密貨幣等方式接收及交付網上賭資,集團同時具有極強的反偵查意識。
調查亦發現,涉案主腦曾將網絡賭博的不法得益轉至其妻子的銀行帳戶,藉此轉移犯罪所得,而其他集團成員亦會以“螞蟻搬家”方式將內地銀行帳戶內的不法得益轉移到本澳。
2023年1月11日,本局聯同廣東省警方採取代號為“雙箭2023”的聯合拘捕行動,本局人員分別在16個地點緝獲15名犯罪集團成員,扣押折合約1,070萬港元現金,同時搜獲電腦等犯罪工具;內地警方在全國多個省市成功緝獲27名集團成員,包括兩名主腦,並扣押相關證物。
根據調查所得,該網絡賭博平台自2017年已開始運作,涉及不法投注額不少於185億元人民幣,集團的犯罪所得不少於2,500萬元人民幣。本局以有組織犯罪、不法經營賭博及清洗黑錢罪將15名在澳被捕的涉案人移送檢察院偵辦。
Illegal gambling syndicate busted by Guangdong and Macao Police, with 42 syndicate members apprehended
In March 2021, the Intelligence and Support Department of the Judiciary Police actively collected intelligence which indicated that a cross border criminal syndicate involving mainland, Macao and Taiwan (China), operated an illegal online gambling platform to earn illegal profits. Having initiated an investigation, it was found that the criminal syndicate was also linked to the mainland. Hence, the Judiciary Police exchanged intelligence with the Guangdong police, and launched a joint investigation.
Afterwards, the Judiciary Police had mastered the identity of the Macao involved mastermind, the den of the syndicate located in a residential apartment of NAPE area and the mode of operation. It was believed that at least 14 syndicate members lived in Macao, including its shareholders and agents.
The mastermind of the syndicate initially opened a number of accounts, the shareholders were responsible for seeking and organizing agents, and the agents would recruit punters to gamble online. The syndicate provided various online gambling games, and involved in operating underground football betting, they also had bases in the mainland and abroad, the backend server and most of the operations of the syndicate were located abroad, they received and paid online gambling funds via controlled bank accounts in the mainland or crypto currencies etc. Meanwhile, the syndicate was highly alert to evade investigation.
Investigation revealed that the involved mastermind had transferred the illegal proceeds from online gambling to the bank account of his wife, thus transferring the criminal proceeds. Other syndicate members would transfer illegal proceeds from the mainland bank accounts to Macao bit by bit.
On 11th January 2023, the Judiciary Police launched a joint arrest operation named “Double-Arrow 2023” together with the Guangdong Police, the Judiciary Police personnel arrested 15 members of the criminal syndicate at 16 spots, detaining approximately HKD10.7 million cash and seizing criminal equipments including computers. The mainland police successfully arrested 27 members of the syndicate nationally in various provinces and cities, including 2 masterminds, and seized relevant evidences.
According to the finding of the investigation, the online gaming platform had started operation since 2017, which involved total illegal bets no less than RMB18.5 billion, the criminal proceeds of the syndicate was at least RMB25 million. The Judiciary Police transferred the 15 involved individuals arrested in Macao to the Public Prosecutions Office on the charges of organized crime, illicit operation of gambling and money laundering.
Desmantelada com a polícia de Guangdong uma rede que explorava jogo ilícito e detidos 42 indivíduos
Em Março de 2021, o Departamento de Informações e Apoio recolheu informações sobre uma rede criminosa transfronteiriça que actuava entre China continental e as regiões de Macau e Taiwan, obtinha lucros através da exploração de uma plataforma de jogo ilícito online. Após a instauração do inquérito, verificou-se que a rede criminosa também tenha ligações com a China continental, assim, a PJ trocou informações com a Polícia de Guangdong e juntos efectuaram uma investigação.
Posteriormente, a PJ descobriu a identidade do cabecilha em Macau e o modo de funcionamento da rede criminosa, descobriu também o abrigo, situado num apartamento do NAPE onde residiam em Macau, pelo menos, 14 membros, incluindo gestores e agentes.
A rede criminosa tinha feito a abertura de várias contas através dos cabecilhas, e os gestores era responsáveis pela organização dos agentes que angariavam clientes para jogar. Esta rede criminosa fornecia vários jogos online também explorava apostas ilegais de jogos de futebol online e tinha vários abrigos dentro e fora da China continental. A rede criminosa possuia servidores próprios e a maioria das operações estavam localizadas fora da fronteira, recebia e pagava o dinheiro das apostas online por meio de contas bancárias controladas na China continental ou através de criptomoedas. Esta rede criminosa também tinha grandes capacidades de contra-investigação.
Durante a investigação apurou-se que o cabecilha transferia o dinheiro recebido nestas apostas ilegais para a conta bancária da sua mulher, no sentido de branquear o dinheiro obtido pelo crime e lucrando com isso. Também os outros membros da rede faziam transferências dos lucros das contas do Continente para Macau.
Em 11 de Janeiro de 2023, a PJ, juntamente com a polícia de Guangdong, realizaram uma operação conjunta denominada “Operação de duas lanças 2023”, o nosso pessoal conseguiu deter 15 membros desta rede criminosa em 16 esconderijos e foram apreendidos um total de 10.7 milhões de HKD. Além disso, foram apreendidos alguns objectos relacionados com o crime, como computadores. Por outro lado, as autoridades policiais do Continente detiveram 27 membros daquela rede criminosa em diversas cidades do Continente, incluindo os dois cabecilhas e apreenderam provas relativas ao crime.
Segundo a investigação, esta plataforma de apostas online entrou em funcionamento em 2017, com cerca de 18.5 bilhões RMB de dinheiro suspeito de apostas ilegais, com lucros de cerca de 25 milhões. Assim os 15 detidos em Macau foram presentes ao MP, por associação criminosa, exploração de jogo ilícito e branqueamento de capitais.
