四名本澳男女涉開設空殼公司詐騙援助就逮
本局接獲情報,指有不法分子開設大量空殼公司並向當局虛報稅務資料,以詐騙特區政府經濟援助,隨即開立卷宗調查。
調查發現,三名涉案本澳男女在另一名涉案本澳男子協助下共開設610間公司,當中113間註冊為同一地址的公司並未經營任何業務,但向當局申報公司月租4.3萬港元,從而營造公司處於營運及虧損狀態的假象,並使之在“2021年度僱員、自由職業者及商號經營者援助款項計劃”中符合發放條件,獲批出援助款項合共291.5萬澳門元,各人其後兌現當中60張支票,涉款154.8萬澳門元。
2022年12月6日,本局在司法當局許可下採取行動,在四名涉案男女的住所及工作地點將之截獲,搜獲手機、平板電腦、單據及文件等證物,又在其中一人的工作地點帶走兩名身份有可疑的職員調查。
四名涉案男女聲稱開設大量空殼公司是為了申請澳門私家車往來港澳常規配額並轉售圖利,又稱因不熟悉稅務申報手續而虛報資料。綜合調查所得,四人涉嫌合謀向當局提供虛假資料,並在清楚知悉該等公司不符合發放商號經營者援助條件下,仍製造公司處於營運的假象來詐騙特區政府援助款項。本局以犯罪集團罪及詐騙(相當巨額)罪將四名涉案男女送交檢察院偵辦,並根據《聘用外地僱員法》的規定,將案中查獲涉及過界工作的兩名職員通報勞工事務局跟進。
Four locals arrested for subsidy fraud by setting up shell companies
Upon receiving intelligence that criminals had established large numbers of shell companies and falsely declared tax information to the authorities to defraud the SAR government of financial subsidies, the Judiciary Police immediately initiated a dossier for investigation.
Investigation revealed that, three involved locals were assisted by another local man in setting up a total of 610 companies, 113 of which had registered the same office address and had not run any business. However, they declared to the authorities a monthly rental of HKD43,000 for the office, thus creating false impression that the companies were in operation with deficits. Therefore, their companies were made eligible in the “2021 Financial Support Scheme for employees, freelancers and operators of commercial establishments”, with total subsidies of MOP2.915 million granted. Subsequently, each person cashed 60 of the cheques, involving an amount of MOP1.548 million.
On 6th December 2022, the Judiciary Police took action under the permission of the judicial authorities. The involved four persons were intercepted at their residence(s) and workplace(s), while evidence such as mobile phones, tablet computers, receipts and documents were found. In addition, at the workplace of one of the individuals, two employees with suspicious identities were taken in for investigation.
The four involved persons stated that large numbers of shell companies had been set up to apply for the regular quota for Macao private cars to travel between Hong Kong and Macao, and to resell for profits. They also claimed that they had made false declaration of information due to unfamiliarity with the procedures in filing tax returns. Based on integrated investigative findings, the four were suspected of conspiracy to provide the authorities with false information, and while being clearly aware that their companies were ineligible in the subsidy scheme for operators of commercial establishments, they had yet created the false impression of operating companies to defraud the SAR government of financial subsidies. The Judiciary Police transferred the four to the Public Prosecutions Office for the offences of criminal syndicate and fraud (considerably huge amount) and, based on stipulations of the Law on Employment of Non-Resident Workers, the Labour Affairs Bureau was notified to follow up with the two employees intercepted in this case for involvement in unauthorised work.

A PJ recebeu informações indicando que alguém tinha criado uma grande quantidade de empresas fictícias e tinha declarado falsas informações fiscais junto das autoridades, com vista a lucrar com os apoios pecuniários do Governo, assim, instaurou imediatamente um processo e iniciou a investigação.
Apurou-se que três indivíduos (homens e mulheres) de Macau, com a ajuda de um outro homem de Macau, criaram 610 empresas, das quais 113 com o mesmo endereço de registo, que não exploravam qualquer actividade, mas declararam às autoridades as rendas mensais de 43.000 HKD, para fingir que estavam a funcionar em perda, de forma a conseguirem o acesso ao “Plano de apoio pecuniário aos trabalhadores, aos profissionais liberais e aos operadores de estabelecimentos comerciais de 2021”. Os apoios obtidos foram de 2,915 milhões de patacas. Os suspeitos trocaram 60 dos cheques, num montante de 1,548 milhões de patacas.
Em 6 de Dezembro de 2022, a PJ, com a autorização das autoridades judiciárias, entrou em acção, foram detidos os 4 suspeitos nos seus apartamentos e nos locais de trabalho e foram apreendidos vários telemóveis, um tablet, alguns recibos e documentos, bem como no local de trabalho de um deles foram levados para as instalações da PJ dois funcionários com identidade suspeita.
Os 4 alegaram que a criação de uma grande quantidade de empresas fictícias serviu para o requerimento de quotas regulares para a circulação de veículos particulares entre Macau e Hong Kong e vendê-las depois para lucrar, disseram também ter dado falsas informações fiscais por não estarem bem familiarizados com as formalidades de declaração fiscal. De acordo com as provas obtidas, os 4 suspeitos estavam em conluio para fornecer falsas informações às autoridades e sabiam claramente que aquelas empresas não satisfiziam as condições de emissão de apoios pecuniários, mas ainda fingiram que as empresas estivessem em funcionamento, para conseguir os apoios pecuniários do Governo da RAEM. Os 4 detidos foram presentes ao MP por associação criminosa e burla (valor consideravelmente elevado), e nos termos da Lei da contratação de trabalhadores não residentes, foi notificada a Direcção dos Serviços para os Assuntos Laborais para acompanhar os dois funcionários detidos neste caso que trabalhavam num local diferente aquele que tinha sido autorizado.
