九名本澳男女涉犯罪集團及清洗黑錢被拘
2022年3月中旬,本局接獲一金行負責人報案,稱有內地顧客使用借記卡在店舖進行大額刷卡消費,但其後收到銀行通知,有關交易因顧客借記卡內的款項來自詐騙犯罪所得而暫停支付,金行蒙受損失而報警求助。
本局經調查發現案件涉及一跨境清洗黑錢犯罪集團,主要透過內地銀行帳戶接收騙款,再派遣帳戶持卡人來澳,由在澳集團成員陪同刷卡購買黃金,之後將借記卡及黃金一併交給集團成員,隨後再通過多名集團成員以層層迂迴交接的方式,將黃金帶到皇朝區一間售賣酒品的店舖。案發當日共有四名內地持卡人,在兩間金行作案五次,涉及五張借記卡,涉款合共592萬澳門元;根據內地相關部門提供資料,上述款項中有297萬元為內地電信刷單詐騙款項,55名內地事主向所在地警方報案追究。
2022年10月19日本局見時機成熟,在多個地點拘捕九名涉案本澳男女,在各人的住所及接收黃金的店舖搜獲一顆金粒及現金(澳門元、港元、人民幣)折合逾一百萬澳門元,同時扣押四輛汽車。
部份涉案人承認受犯罪集團指使,協助以刷卡購金方式將犯罪所得轉移及進行清洗,每次成功交易可得3,000元人民幣報酬。本局以犯罪集團罪及清洗黑錢罪將九名涉案男女移送檢察院偵辦,並追緝其他涉案人。
Nine local men and women apprehended for criminal syndicate and money laundering
In mid-March 2022, the Judiciary Police received a report from the person-in-charge of a goldsmith shop that there were mainland customers conducting large-amount transactions with debit cards in his shop. However, notification from the bank was received afterwards, stating that payment for the relevant transactions was suspended since the money in the customer’s debit cards originated from proceeds of fraudulent crimes. The goldsmith shop thus reported to the police for the loss incurred.
Investigation revealed that the case involved a cross-border money laundering criminal syndicate which mainly received fraud proceeds via mainland bank accounts, and then deployed card holders to Macao to purchase gold with their cards in the company of the syndicate members in Macao. After that, both the debit cards and gold would be passed to the syndicate members, who would subsequently take the gold to a liquor shop in the NAPE district but not before going through a hierarchical and circuitous way by multiple syndicate members. On the day of the incident, there were 4 mainland card holders perpetrating in 2 goldsmith shops for 5 times, involving 5 debit cards and a total of MOP5,920,000. According to the information provided by the relevant mainland department, an amount of MOP2,970,000 of the abovementioned funds came from the proceeds of telecom “brushing” scams in the mainland, with 55 mainland victims reported to the local police for the pursuit of responsibility.
Seeing the opportune moment, the Judiciary Police apprehended 9 involved local men and women at multiple locations on 19th October 2022, with 1 gold grain and cash (Pataca, Hong Kong dollar, Reminbi) equivalent to more than MOP1,000,000 seized from their residences and the shop receiving the gold. At the same time, 4 cars were also detained.
Some of the involved individuals admitted to have been instructed by the criminal syndicate to assist in transferring and laundering the illicit proceeds by the method of purchasing gold with cards, and a remuneration of RMB3,000 would be obtained for every successful transaction. The Judiciary Police transferred the 9 involved men and women to the Public Prosecutions Office for the offences of criminal syndicate and money laundering, while pursuing other involved individuals.
Detidos nove indivíduos locais por associação criminosa e branqueamento de capitais
Em meados de Março de 2022, recebemos a queixa de um responsável de uma ourivesaria, dizendo que clientes da China continental, tinham usado cartões de débito em compra de produtos caros, porém, mais tarde, a loja foi informada pelo banco, de que os pagamentos das transacções em causa tinham sido suspendidas devido ao facto que dinheiro daqueles cartões provinha de burlas, o que causou um prejuízo para a loja.
Na investigação ficou apurado que no caso estava envolvida uma rede transfronteiriça de branqueamento de capitais. A rede recebia dinheiro das burlas através de contas bancárias da China continental e enviava titulares dos cartões bancários para Macau para comprar ouro, os membros da rede os acompanhavam, depois o cartão de crédito e o ouro eram entregues aos elementos da rede, que através de outros elementos da rede e meios tortuosos, eram levados a uma loja de vinhos no NAPE. No dia da ocorrência, houve quatro titulares dos cartões, todos da RPC, que actuaram em duas ourivesarias, em cinco ocasiões, usando cinco cartões de débito, num valor de 5,92 milhões de patacas. De acordo com as informações dos serviços competentes do continente, de entre o valor acima referido, 2,97 milhões de patacas provinham das burlas de “aumentar o registo das encomendas” em telecomunicações, onde 55 vítimas da RPC tinham feito queixa junto das polícias locais.
No dia 19 de Outubro de 2022, os nossos agentes detiveram 9 indivíduos (homens e mulheres) locais, nas suas residências e na loja onde recebia o produto foram encontrados uma peça de ouro e algum dinheiro em numerário, nomeadamente patacas, dólares de Hong Kong e renminbi, num valor de mais de um milhão de patacas, foram também apreendidos 4 veículos.
Alguns dos detidos confessaram que foi-lhes indicado pela rede para auxiliar na transferência do produto do crime através da compra de ouro com o cartão de débito e branqueamento e por cada transacção feita recebiam uma recompensa de 3.000 yuans. Os nove suspeitos foram presentes ao MP acusados de associação criminosa e branqueamento de capitais. A PJ continua à procura dos outros eventuais envolvidos.
