四名內地男女涉融資貸款詐騙被拘
2022年3月18日,本局接獲一名內地男子舉報,指被人以融資貸款為名詐騙53萬港元。
案情顯示,2019年8月,第一涉案男子在內地認識事主,自稱為香港某銀行經理,可協助事主的內地公司獲得香港銀行兩億港元的融資貸款,但因疫情關係,須改為來澳辦理融資貸款手續,要求事主在澳開立240萬港元存款帳戶作為貸款條件,又訛稱可協助事主借款籌足開戶資金,但須先付60萬港元作為報酬。
事主於2022年3月16日來澳,在涉嫌人引介下認識了放貸人(即第二涉案男子)和自稱為本澳某銀行經理的第三涉案男子,並按指示自行在南灣區某銀行開立帳戶。3月18日,三名涉案人陪同事主前往中區某銀行辦理貸款手續,第一涉案人將第一筆貸款73萬港元以支票方式存入事主戶口,並隨即要求事主支付60萬港元報酬,當時事主只交付了53萬港元。同日,事主應約再到銀行辦理餘下的貸款手續時,三名涉案人均沒有依約出現且失聯。同時,銀行職員告知相關支票為異地支票,須於下一工作日才能到帳,事主懷疑受騙,遂報警求助,報稱事件中損失53萬港元。
本局經調查證實涉案人開立的73萬港元支票為已結清賬戶的香港銀行支票,根本無法兌現,並發現案中還有第四涉案女子在幕後參與犯案,遂於2022年8月7日四名涉案人經關閘口岸入境本澳後,在四人入住的酒店房間將之截獲,並搜獲名片、借貸合同、空白支票簿及多部手機等作案工具。本局其後再查悉四名涉案人是次來澳是為再次犯案,旋於2022年8月8日成功聯絡到有關事主到本局協助調查,該名內地事主報稱應第一涉案人之約來澳申辦四千多萬港元的融資貸款,並準備支付60萬港元手續費,由於本局介入調查而及時止付,但亦損失了早前所付的疏通費7,800元人民幣。
經綜合調查所得,本局以詐騙(相當巨額)、偽造具特別價值之文件及犯罪集團等三罪將四名涉案人送交檢察院偵辦。
Four mainland Chinese arrested for fraud of financing loan
A mainland Chinese man reported to the Judiciary Police on 18th March 2022 that he had been defrauded of HKD 530,000 on the pretext of fraud of financing loan.
In the case, the first involved man, allegedly the manager of a bank in Hong Kong, got acquainted with the victim in mainland China in August 2019. He claimed that he could obtain a financing loan of HKD 200 million for the victim’s company in mainland China, the formalities of which had to be performed in Macao instead due to the pandemic, demanding the victim to open a savings account of HKD 2.4 million in Macao as a prerequisite of the loan. He also falsely claimed to be able to raise funds for the victim to open the account for an advance reward of HKD 600,000.
When the victim came to Macao on 16th March 2022, the suspect introduced him to the lender (i.e. the second involved man) and the third involved man, allegedly the manager of a bank in Macao. He then opened an account on his own at a bank in Praia Grande as instructed. Accompanied by the three involved persons, the victim performed formalities for the loan at a bank in central district on March 18th. After depositing the first loan of HKD 730,000 into the victim’s account with a cheque, the first involved person immediately demanded the victim to pay him a reward of HKD 600,000, of which the victim paid only HKD 530,000 at that time. On the same day, the victim went through the remaining procedures for the loan at the bank as promised, only to find the three involved persons no-show and unaccounted for. Meanwhile, he was informed by the bank staff that the cheque, being a foreign cheque, could not be credited until the next working day. Suspected of fraud and having suffered a loss of HKD 530,000 in the incident, the victim reported to the police.
Upon investigation, it was confirmed that the cheque signed by the involved person and issued from a cleared account of a bank in Hong Kong was not cashable. A fourth involved person, a woman, was found to have perpetrated behind the scene. When the four persons entered Macao via Portas do Cerco on 7th August 2022, the Judiciary Police intercepted them in their hotel room, seizing crime tools including business cards, loan contracts, blank cheque books, several mobile phones, etc. Learning that the four persons had come to Macau this time for another perpetration, the Judiciary Police promptly contacted the victim to assist in investigation in person on 8th August 2022. The mainland Chinese victim claimed that he had prepared a processing fee of HKD 600,000 for applying a financing loan of over HKD 40 million in Macao as arranged by the first involved person. As a result of the intervention and investigation of the Judiciary Police, the payment had been stopped in time, but the facilitation payment of RMB 7,800 that he had paid earlier was irrecoverable.
Based on the overall investigative results, the Judiciary Police transferred the four involved persons to the Public Prosecutions Office for the three charges of fraud (considerably huge amount), falsifying documents of significant value and criminal syndicate.
Detidos 4 indivíduos da China continental por burla relativa a empréstimos de financiamento
Em 18 de Março de 2022, a PJ recebeu a denúncia de um homem da China continental, indicando que tinha sido burlado em 530.000 HKD através de um empréstimo de financiamento.
Em Agosto de 2019, um homem, 1.º suspeito deste caso, conheceu o denunciante na China continental, disse-lhe que era gerente de um banco de Hong Kong e podia ajudar a sua companhia na China continental a obter um empréstimo de financiamento daquele banco no valor de 200 milhões de HKD, mas devido à epidemia, pediu-lhe para lidar com as formalidades do empréstimo em Macau e abrir uma conta em Macau para depositar 2,4 milhões de HKD como condição de empréstimo, e disse-lhe que o podia ajudar a pedir outro empréstimo para angariar os capitais da abertura da conta, mas o denunciante precisava de pagar primeiro 600.000 HKD como remuneração.
Em 16 de Março de 2022, o denunciante chegou a Macau, com a recomendação do suspeito, conheceu um emprestador (2.º suspeito deste caso) e um alegado gerente de um banco de Macau (3.º suspeito), e de acordo com as indicações, deslocou-se pessoalmente a um banco na zona da Praia Grande para abrir uma conta. Em 18 de Março, os três suspeitos acompanharam o denunciante para um banco na zona central para lidar com as formalidades de empréstimos. O primeiro suspeito depositou um cheque com o primeiro empréstimo no valor de 730.000 HKD na conta do denunciante, e depois pediu-lhe para pagar 600.000 HKD como remuneração de imediato. Naquele momento, o denunciante só pagou 530.000 HKD. No mesmo dia, quando este foi ao banco outra vez para lidar com as formalidades dos restantes empréstimos, os três suspeitos não apareceram e a vítima não conseguiu contactá-los. Ao mesmo tempo, um funcionário bancário disse-lhe que aquele cheque não era cheque local e o dinheiro iria chegar no dia útil seguinte. A vítima suspeitou ter sido burlado, assim, fez queixa na PJ dizendo que tinha sofrido um prejuízo no valor de 530.000 HKD.
Na investigação, verificou-se que o cheque no valor de 730.000 do suspeito era de uma conta cancelada de um banco de Hong Kong e não tinha cobertura, bem como apurou-se que neste caso estaria envolvida mais uma mulher (4.º suspeita deste caso). Em 7 de Agosto de 2022, os 4 suspeitos entraram em Macau pelas Portas do Cerco, e foram detidos num quarto de hotel que alugavam, onde foram apreendidos vários objectos, tais como cartões de visita, contratos de empréstimo, talões de cheques em branco, e vários telemóveis. Verificou-se que os 4 suspeitos vieram para Macau para actuar novamente. Em 8 de Agosto de 2022, os nossos agentes conseguiram contactar a vítima em causa pedindo-lhe para colaborar na investigação. A vítima, da China continental, disse ter combinado com o 1.º suspeito para lidar com as formalidades de um empréstimo de financiamento no valor de mais de 40 milhões de HK em Macau, e pretenderia pagar 600.000 HKD como despesa de formalidades. Por causa da intervenção da PJ, o pagamento foi cessado a tempo, mas a vítima perdeu ainda 7.800 RMB, que foram, anteriormente, pagos como custos de facilitação.
De acordo com as provas obtidas na investigação, os 4 detidos foram presentes ao MP por burla (valor consideravelmente elevado), falsificação de documento de especial valor e associação criminosa.
