內地警方移交涉簽發空頭支票之本澳女子予本局
2021年12月6日,本局接獲一名女子檢舉,稱收到一名本澳女子簽發的空頭支票,導致損失536萬港元。
本局調查後發現,涉案女子於2020年10月底向事主借取600萬港元,並簽發一張等額支票作為抵押;2021年2月25日,事主到銀行兌現時發現支票因存款不足而法兌現,遂報警求助,本局迅即拘捕涉案女子並移交檢察院處理。
事後,涉案女子向事主還款64萬港元,又簽發一張536萬港元的支票,以換取事主撤回告訴;2021年8月23日,事主到銀行兌現支票時又再無法兌現,經與涉案女子多番協商不果,事主最終再向本局報案求助。
本局調查發現涉案女子於事主報案當天潛逃內地,隨即請求廣東省公安廳及珠海市公安局協助緝捕,2022年4月27日,內地警方通報涉案女子在內地落網,並於同日將之移交本局,本局以簽發空頭支票(相當巨額)罪將之移送檢察院處理。
Mainland police transferred a local woman involved in issuing rubber cheques to the Judiciary Police
On 6th December 2021, a woman filed a complaint with the Judiciary Police, indicating that she had received a rubber cheque issued by a local woman, resulting in a loss of HKD5.36 million.
Investigation by the Judiciary Police revealed that the involved woman had borrowed HKD6 million from the victim at the end of October 2020, and issued a cheque for an equivalent amount as collateral. On 25th February 2021, the victim failed to cash the cheque at the bank due to insufficient account balance, therefore reported to the police for assistance. The Judiciary Police speedily apprehended the involved woman and transferred her to the Public Prosecutions Office for handling.
Afterwards, the involved woman repaid the victim HKD640,000, and issued another cheque for HKD5.36 million to the latter in exchange for withdrawal of the complaint. On 23rd August 2021, the victim tried to cash the cheque at the bank but it could not be honoured again. After repeatedly unsuccessful negotiations with the involved woman, the victim eventually reported to the Judiciary Police again for assistance.
Subsequent to investigation, the Judiciary Police found that the involved woman had fled to mainland on the day when the victim reported the case, thus immediately requested the Guangdong Provincial Public Security Department and the Zhuhai Municipal Public Security Bureau for assistance in the manhunt. On 27th April 2022, notification was given by the mainland police that the involved woman had been arrested in mainland, who was handed over to the Judiciary Police on the same day. The Judiciary Police transferred the involved woman to the Public Prosecutions Office for the offence of issuing rubber cheque (considerably huge amount).
A polícia da China continental transferiu para a PJ uma residente por passagem de cheque sem provisão
Em 6 de Dezembro de 2021, a PJ recebeu uma denúncia de uma mulher que disse ter recebido um cheque sem provisão, emitido por uma residente, num prejuízo de 5,36 milhões de HKD.
Conforme a investigação, apurou-se que nos finais de Outubro de 2020, a vítima tinha emprestado seis milhões de HKD à mulher em causa que lhe emitiu um cheque servindo como garantia. Em 25 de Fevereiro de 2021, a denunciante dirigiu-se ao banco para tentar sacar o cheque mas verificou que não havia cobertura suficiente, fez queixa de imediato. A mulher foi detida e foi presente ao MP.
Posteriormente, a suspeita devolveu à denunciante 640.000 HKD e emitiu um outro cheque com valor facial de 5,36 milhões de HKD pedindo para desistir da queixa. Em 23 de Agosto de 2021, a denunciante, novamente, tentou sacar o cheque mas, mais uma vez, não tinha cobertura. Após repetidas discussões que continuaram em vão, a vítima fez novamente denúncia à polícia.
No dia em que a denunciante fez queixa, a suspeita fugiu para a China continental, a PJ solicitou então a colaboração da Directoria Provincial de Segurança Pública de Guangdong e a Directoria Municipal de Segurança Pública de Zhuhai. Em 27 de Abril de 2022, chegou a informação que polícia da China continental tinha detido a suspeita e que iria transferi-la para a PJ no mesmo dia. A detida foi depois presente ao MP por emissão de cheque sem provisão (valor consideravelmente elevado).
