四男女涉假結婚被拘
2022年1月20日,本局接獲檢察院要求調查一宗假結婚及虛假聲明案件。
案情顯示,一對內地夫婦於1994年在內地註冊結婚,並於2001年誕下一子,但兩人卻找來另一名本澳男子冒充該子生父,2004年兩人離婚,上述涉案丈夫與一名本澳女子結婚及取得澳門居民身份證,直至2017年離婚並與內地前妻復婚,再以夫妻團聚為由申請內地妻子來澳定居。
本局於3月24日採取行動,分別在三個單位及關閘口岸截獲四名涉案男女,根據行動中搜獲之家庭生活照片、各人的出入境記錄及相關供詞,發現涉案內地男子及本澳女子在婚姻存續期間並沒有共同生活軌跡,涉案本澳男子則承認曾作出虛假聲明,故本局以偽造文件、使用或佔有偽造文件、為取得許可而虛偽作出並主張某些法律行為等三罪將四人移送檢察院偵辦。
Four persons arrested for sham marriage
The Judiciary Police was demanded by the Public Prosecutions Office to conduct investigation into a case of sham marriage and false declaration on 20th January 2022.
Case details revealed that a mainland Chinese couple had registered marriage in mainland China in 1994 and gave birth to a son in 2001. However, the couple found a local man to impersonate the child’s biological father and divorced in 2004. The aforesaid involved husband married a local woman and obtained his Macao Resident I.D. Card before divorcing in 2017 and re-marrying his mainland Chinese ex-wife, applying for residence in Macao for the latter on the grounds of family reunification.
The Judiciary Police took action on March 24th, intercepting the four involved persons respectively in three apartments and Portas do Cerco. Based on the family photographs seized in the operation, the arrestees’ immigration records and testimonials, it was found that the involved mainland Chinese man and the local woman did not share a life trajectory during their marriage, while the involved local man admitted to have made a false declaration. The Judiciary Police transferred the four persons to the Public Prosecutions Office for the three charges of falsification of document, using or possessing falsified document and simulation and invocation of certain legal acts to obtain authorization.

Em 20 de Janeiro de 2022, A PJ recebeu uma queixa sobre casamento falso e falsas declarações.
Conforme averiguações, um casal da China continental, cujo casamento foi registado em 1994, teve um filho que nasceu em 2001 mas, um outro homem, residente de Macau, fez-se passar pelo pai biológico da criança. Em 2004, o casal divorciou-se e o homem casou com uma residente local e obteve a autorização de residência em Macau para ele próprio. Até 2017, os dois divorciaram-se e o homem voltou a casar com a ex-mulher, assim a mulher e o filho da RPC conseguiram com sucesso a autorização de residência com fundamento na junção familiar.
Em 24 de Março a PJ iniciou as operações e conseguiu interceptar as quatro pessoas em três apartamentos e no Posto Fronteiriço das Portas do Cerco, respectivamente. Nas averiguações, conforme as fotos familiares encontradas, registos de entrada e saída do território e as declarações prestadas, não se verificou nenhuma prova de vida conjugal durante o período em que o homem da RPC e a residente local estavam casados. O homem suspeito, residente de Macau, confessou a prática das falsas declarações. Os quatro indivíduos foram presentes ao MP pelo crime de falsificação de documento, crime de uso ou posse de documentos falsos, crime de simulação e invocação de actos jurídicos para obtenção de autorizações.
