兩名本澳男子涉相當巨額信任之濫用被拘
2022年1月,本局接獲某貿易公司負責人舉報,稱該公司被一名本澳男子詐騙約值286萬元人民幣的洋酒。
案情顯示,男事主透過親友認識從事“走水貨”的涉案男子,於2020年9月委託其將一批約值100萬元人民幣的名酒運往內地,事成後會給予對方每瓶酒70至100元人民幣不等的報酬,但涉案男子運送期間損毀或遺失當中757瓶酒,承諾賠償酒價約57萬元人民幣;2020年12月初,男事主再次委託涉案男子將3,600瓶約值432萬元人民幣的洋酒運到內地,但涉案男子只交付當中1,689瓶,又承諾會償付其餘貨款,及後卻以不同藉口拖延,最終失去聯絡。
本局調查後於2022年3月10日傳召涉案男子接受調查,其聲稱首批酒因被內地執法部門扣查而無法交付,而第二批酒中則有部份交予另一名本澳男子協助運送,因對方失聯及自己負責運送的洋酒被扣查,以致無法如期交付,但其無法提供貨物被扣查的記錄。本局根據線索傳召上述協助攜帶洋酒的本澳男子受查,其承認將1,554瓶洋酒據為己有,並以約100萬元人民幣將之轉售,贓款已用作償還賭債。
本局以信任之濫用(相當巨額)罪將兩名涉案男子移送檢察院偵辦,另通報澳門海關跟進本案中的走私水貨活動。
Two Macao man nabbed for involvement in abuse of trust (considerably huge amount)
In January 2022, the Judiciary Police received a report from the person in charge of a trading company, claiming that a Macao man had defrauded the company of wine worth approximately RMB2.86 million.
Case details indicated that, through a relative, the male victim became acquainted with the involved man who engaged in “parallel trading”. In September 2020, he entrusted the involved man to transport a batch of famous wine valued at around RMB1 million to the mainland. Upon completion of the task, the involved man would be given a remuneration ranging from RMB70 to RMB100 per bottle of wine. Yet, during the conveyance, the involved man had damaged or lost 757 bottles of wine of the batch, and promised to pay the victim a sum of around RMB570,000 as compensation for the loss of the wine. In early December 2020, the male victim entrusted the involved man to transport 3,600 bottles of wine worth about RMB4.32 million to the mainland again. However, the involved man only delivered 1,689 bottles, but promised to reimburse for the remaining goods. Subsequently, the involved man used various excuses to procrastinate and was eventually out of reach.
Upon investigation, the Judiciary Police summoned the involved man for investigation on 10th March 2022. He contended that, the first batch of wine had been withheld for investigation by the law enforcement in the mainland and therefore the delivery failed. As for the second batch of wine, some bottles had been handed to another Macao man assisting in the conveyance. Owing that the other man was out of reach, and the bottles of wine which the involved man was responsible for transportation were detained for investigation, on-time delivery was unable to take place. Nevertheless, he failed to provide a record that the goods had been detained for investigation. Acting on the lead, the Judiciary Police summoned the aforesaid Macao man who had assisted in carrying the wine. He admitted that he had appropriated 1,554 bottles of wine to himself and resold them for around RMB1 million. The ill-gotten gains had been used to repay his gambling debt.
The Judiciary Police transferred the two involved men to the Public Prosecutions Office for the offence of abuse of trust (considerably huge amount). In addition, the Macao Customs Service was informed to follow up with the parallel trading activity of this case.
Dois homens de Macau detidos por abuso de confiança em valor consideravelmente elevado
Em Janeiro de 2022, a PJ recebeu a denúncia do responsável duma companhia de comércio, dizendo que um número de garrafas de vinho estrangeiro, avaliadas em cerca de 2,86 milhões de RMB, tinha sido roubado por um indivíduo de Macau.
Segundo a informação, o patrão conheceu por meio dos familiares o homem em causa que fazia o contrabando e, em Setembro de 2020, confiou-lhe o transporte, para a China continental, dum lote de vinho de luxo que vale aproximadamente um milhão de RMB, iria por isso pagar-lhe 70 a 100 RMB por cada garrafa levada. Durante o transporte, esse homem estragou e extraviou 757 garrafas de vinho, prometendo assim pagar uma indemnização que rondava os 570.000 RMB, equivalente ao custo total dessas garrafas. No início de Dezembro de 2020, o responsável da empresa incumbiu novamente o mesmo homem de levar para o continente 3.600 garradas de vinho estrangeiro num valor de cerca de 4,32 milhões de RMB. Desta vez, o homem só entregou 1.689 dessas garrafas e prometeu novamente uma recompensa no valor das mercadorias. Porém, esse homem adiou o pagamento com pretextos diferentes e acabou por não conseguir ser contactado.
Após as averiguações, o homem foi chamado para o interrogatório no dia 10 de Março de 2022, disse que uma parte das garrafas do primeiro lote não tinha sido entregue por causa da apreensão da autoridade da China continental. Quanto ao segundo lote, deu uma porção do vinho a outro homem de Macau para que ajudasse no transporte, mas perdeu o contacto com ele e o vinho levado por si próprio foi apreendido, o que fez com que não conseguisse entregar as mercadorias no prazo devido. No entanto, não conseguiu exibir respectivos registos de apreensão. A PJ, de acordo com as informações, convocou o segundo homem que ajudou o transporte de vinho para a investigação, o qual admitiu ter-se apropriado de 1.554 garrafas de vinho e tê-las vendido por cerca de um milhão de RMB, também disse que o dinheiro obtido tinha sido usado para liquidar dívidas de jogo.
Os dois homens foram presentes ao MP por abuso de confiança (em valor consideravelmente elevado), a PJ comunicou também aos Serviços de Alfândega as actividades de contrabando envolvidas no caso.
