兩男女假結婚被拘
於2022年3月10日,本局接獲舉報,指一名內地女子透過與一本澳男子進行假結婚藉領取澳門居民身份證。
經調查分析兩人之出入境記錄,查悉涉案女子在分娩、帶同女兒離開本澳及領取澳門居民身份證期間,涉案男子均沒有陪同,二人婚姻存續期間並沒有共同生活軌跡;男涉案人承認與女涉案人進行假結婚,使其澳門居民身份證,便會獲得3萬元人民幣報酬,續表示在虛偽婚姻存續期間,女涉案人於澳門仁伯爵綜合醫院誔下女嬰,並著男涉案人冒充其女兒生父。
本局以為取得許可而虛偽作出並主張某些法律行為,將上述兩名涉案男女移送檢察院偵辦。
Man and woman nabbed for involvement in sham marriage
On 10th March 2020, the Judiciary Police received a report indicating that, a mainland woman had applied for Macao SAR Resident Identity Card by means of a sham marriage with a Macao man.
Having investigated and analysed the daily life tracks of the duo during their existing marriage, the Judiciary Police found that, neither did the duo share mutual immigration records, nor did the involved man accompany the involved woman during the times when she was in labour, exiting Macao with her daughter, or obtaining the Macao SAR Resident Identity Card. There were signs indicating that the duo was involved in a sham marriage. On 10th March 2022, the Judiciary Police summoned the involved man and woman for investigation. The involved man admitted that he had received RMB30,000 as a reward for a sham marriage with the involved woman, thereby assisting her to obtain the Macao SAR Resident Identity Card as well as impersonating the biological father of the baby girl.
In accordance with Article 78 “Falsely Performing and Claiming Certain Legal Acts to Obtain Permits” of Law No. 16/2021 “Legal Regime of Immigration Control, Stay and Residence Authorization of the Macao Special Administrative Region”, the Judiciary Police transferred the involved man and woman to the Public Prosecutions Office.

No dia 10 de Março, a PJ recebeu uma denúncia acerca de uma mulher do continente e um residente que teriam casado por conveniência para ela obter o bilhete de identidade de residente em Macau.
Nas averiguações verificou-se que, durante o período em que os dois estiveram casados, não havia registos de entrada nem de saída juntos do território. A par disso, o suspeito nunca acompanhou a mulher durante o parto, nem nos momentos em que a suspeita saiu do território com a filha e levantou o bilhete de identidade de residente, havia assim indícios de que se tratava de um casamento falso. No dia 10 de Março de 2022, a PJ convocou os dois suspeitos para a investigação, o suspeito confessou que tinha recebido 30.000 RMB para contrair um casamento de conveniência com a mulher para ela obter o bilhete de identidade de residente de Macau, além disso, ainda se fez passar pelo pai biológico da criança.
O casal acabou por ser presente ao MP pelo crime de “simulação e invocação de certos actos jurídicos para obtenção de autorizações” previsto no artigo 78.° da Lei n.°16/2021 - Regime jurídico do controlo de migração e das autorizações de permanência e residência na Região Administrativa Especial de Macau.
