七名本澳男女涉虛構勞動關係被拘
本局調查2021年9月一宗電腦詐騙案時,揭發有人藉內地中介經本澳某飲料公司虛構勞動關係而取得外地僱員身份認別證,隨後被移交檢察院處理。
本局對涉案飲料公司展開調查,發現該公司的法人企業主還開設了另一間公司,並以兩間公司名義與五名本澳居民虛構勞動關係,藉此成功申請11個外僱聘用許可。本局於2022年2月15日到兩間公司進行調查,發現有七名外地僱員並非受僱於相關公司,隨即將上述企業主的本澳男股東及其中一間公司的本澳女負責人帶返調查。
涉案男子承認在本澳至少物色五名虛假本地僱員,並為他們繳納社保供款,以製造本地僱員人數增加的假象,從而申請更多外地僱員聘用許可;涉案女子則承認負責接洽上述涉案內地中介人,以每張10萬元人民幣的金額出售外地僱員身份認別證,事成後兩人對分利潤,至被捕時其個人已獲得不法利益35萬元人民幣,並已用於公司的營運開支。
本局其後傳召五名涉案虛假本地僱員協助調查,他們均承認借出身份資料予涉案男子作社保供款,事實上未受聘於涉案公司。本局對兩名涉案男女控以偽造文件、使用或佔有偽造文件罪,另對五名虛假本地僱員控以偽造文件罪,俱送交檢察院處理,並追查其餘涉案人。
Seven locals apprehended for fabricating labour relationship
During the investigation of a computer fraud case in September 2021, the Judiciary Police revealed that someone had obtained “Non-resident Worker’s Identification Card” through an intermediary in mainland by the fabrication of labour relationship at a beverage company in Macao. The case was later transferred to the Public Prosecutions Office for handling.
The Judiciary Police launched investigation against the involved beverage company, discovering that the legal entrepreneur of that company had also established another company. By using the names of both companies to fabricate labour relationships with five local residents, eleven non-resident worker employment permits were successfully applied. The Judiciary Police conducted investigation at the two companies on 15th February 2022, revealing that 7 non-resident workers were not employed by the related companies. As such, the local male shareholder of the abovementioned entrepreneur and the local female responsible person of one of the companies were immediately brought back to the Judiciary Police for investigation.
The involved man admitted that he had hunted for at least 5 fake local workers in Macao, paying for their Social Security Fund contributions so as to create an illusion of increasing the numbers of local employees, which in turn increasing the quotas to employ more non-resident workers. Whilst, the involved woman avowed that she was responsible for making arrangements with the abovementioned involved intermediary in mainland, selling “Non-resident Worker’s Identification Card” at a price of RMB100,000 each and the duo would share the profit equally afterwards. By the time she was arrested, an illicit proceed of RMB350,000 had already been acquired and used as operating expenses of the company.
Later, the 5 involved fake local workers were summoned by the Judiciary Police to assist in the investigation. All of them confessed to have lent out their personal particulars to the involved man for Social Security Fund contributions, yet they were not practically employed by the involved companies. The involved man and the involved woman were charged with the offences of forgery of documents, and using or possessing forged documents, while the 5 fake local workers were charged with forgery of documents. The Judiciary Police transferred the 7 individuals to the Public Prosecutions Office for handling, while pursuing the other involved persons.
Detidos sete residentes por falsas relações de trabalho
Na investigação de um caso de burla informática ocorrido em Setembro de 2021, descobriu-se que alguém, através de um intermediário da China continental e uma companhia de bebidas de Macau, falsificava as relações de trabalho e obteve os Títulos de Identificação de Trabalhador não Residente, os suspeitos foram presentes ao Ministério Público.
Iniciou-se a investigação da companhia de bebidas, apurou-se que o empresário, pessoa colectiva daquela companhia abriu ainda outra companhia e falsificou, em nome destas duas companhias, as relações de trabalho com cinco residentes, assim requereu com sucesso 11 autorizações de contratação de trabalhadores não residentes. Em 15 de Fevereiro de 2022, o pessoal da PJ deslocou-se às duas companhias para investigar, descobriu que havia sete trabalhadores não residentes que não eram contratados por estas companhias. De imediato, um sócio de Macau do referido empresário e uma responsável local de uma das companhias foram levados às instalações da PJ para investigação.
O suspeito admitiu que tinha angariado pelo menos cinco falsos trabalhadores locais e que pagavam as relativas contribuições para o fundo de Segurança Social, de modo a fazer parecer um aumento de trabalhadores locais podendo requerer assim mais autorizações de contratação de trabalhadores não residentes. Por sua vez, a suspeita admitiu que era responsável por contactar o referido intermediário da China continental para a venda de documentos de trabalhadores não residentes pelo preço de 100.000 RMB cada, dividindo o lucro igualmente entre os dois após concluído o negócio. Quando foi detida, a suspeita disse já ter obtido, pessoalmente, lucros ilícitos em 350.000 RMB, dinheiro que foi utilizado nas despesas de funcionamento da companhia.
A PJ convocou os cinco trabalhadores locais falsos envolvidos no caso para investigação, todos admitiram que tinham emprestado os dados de identidade ao suspeito para uso do pagamento das contribuições para o fundo de Segurança Social, mas de facto não tinham sido contratados pelas companhias envolvidas. O homem e a mulher envolvidos foram presentes ao Ministério Público acusados de crime de falsificação de documentos e de uso ou posse de documentos falsos, enquanto que os cinco falsos trabalhadores foram também presentes ao Ministério Público por falsificação de documentos. A PJ continua à procura de outros eventuais envolvidos.
