兩男女涉假結婚被拘
2020年2月,本局接獲舉報指一名內地女子和一名本澳男子假結婚,經調查分析兩人於2006年至2012年婚姻存續期間的生活軌跡,發現兩人沒有共同出入境記錄。基於對兩人婚姻關係存疑,本局分別在涉案男子位於北區的工作地點及涉案女子位於北區的住所將二人帶返本局調查,涉案女子雖否認二人假結婚,但僅能指出涉案男子住所的大概位置;而涉案男子則承認收取1.5萬澳門元與女方假結婚,其後藉申請女方及其兩名兒子來澳團聚,協助他們取得在澳居留許可。
本局於2022年2月16日將兩名涉案男女拘捕,以第16/2021號法律《澳門特別行政區出入境管控、逗留及居留許可的法律制度》第78條“為取得許可而虛偽作出並主張某些法律行為”罪將之移送檢察院偵辦。
Two individuals arrested for sham marriage
In February 2020, the Judiciary Police received a report stating that a mainland woman had a sham marriage with a local man. After investigating and analysing the living trails of the two individuals during the course of their marriage from 2006 to 2012, it was discovered that the two had no common exit-entry records. Since their marriage relationship appeared suspicious, the two of them were brought back to the Judiciary Police for investigation from the workplace of the involved man in the Northern District and the residence of the involved woman in the Northern District respectively. Although the involved woman denied they had a sham marriage, she could only roughly indicate the location of the residence of the involved man. However, the involved man admitted receiving MOP15,000 to contract a sham marriage with the woman, in order to subsequently apply for her and her two sons to come to Macao on the ground of family reunion, assisting them to obtain Macao residence permits.
On 16th February 2022, the Judiciary Police detained the two involved individuals and transferred them to the Public Prosecutions Office for the charge of “falsely performing and claiming certain legal acts to obtain permits”, pursuant to Article 78 of Law no. 16/2021 “Legal Regime of Immigration Control, Stay and Residence Authorization of the Macao Special Administrative Region”.

Em Fevereiro de 2020, a PJ recebeu uma denúncia sobre um caso de casamento falso que envolvia uma mulher da China continental e um residente. Nas averiguações verificou-se que durante o período em que os dois estavam casados, ou seja, entre 2006 e 2012, não havia registos de entrada nem de saída juntos do território. Duvidando desta relação matrimonial, os nossos agentes deslocaram-se ao local de trabalho do suspeito e à residência da suspeita, na zona da Areia Preta, os dois foram levados às instalações da PJ para investigação. A suspeita negou o casamento falso, contudo não conseguiu indicar a residência concreta do suspeito; enquanto que o suspeito confessou que tinha recebido 15.000 patacas para contrair um casamento de conveniência com a mulher, que depois fez o pedido de reunião familiar para auxiliar a mulher e os dois filhos dela a obterem a autorização de residência em Macau.
O casal acabou por ser detido no dia 16 de Fevereiro de 2022 e foi presente ao MP pelo crime de “simulação e invocação de certos actos jurídicos para obtenção de autorizações” previsto no artigo 78.° da Lei n.°16/2021 - Regime jurídico do controlo de migração e das autorizações de permanência e residência na Região Administrativa Especial de Macau.
