本澳男子涉誹謗、公開及詆毀、侵犯行使公共當局權力之法人等三罪被捕
2021年10月10日,本局分別接獲衛生局和教育及青年發展局來函檢舉,指有人於網上發佈不實帖文,內容指衛生局局長、教青局局長或相關親屬居於曾出現確診個案的大廈,令人覺得衛生當局對該大廈採取較寬鬆的防控措施。上述部門稱,有關帖文內容嚴重失實,損害兩個部門及相關人士的聲譽,且對特區政府防疫工作造成極為負面的影響,甚至令市民產生恐慌。
本局深入調查後確定涉案本澳男子的身份,於同日到其工作地點將之截獲,並在其身上搜獲懷疑作案手機。涉案男子承認居於上述大廈,聲稱於大廈業主聊天群組得悉“衛生局局局長的親戚住28樓,而教青局局長住7樓”,因而主觀認為衛生部門基於上述情況而對該大廈採取較寬鬆的防控措施,並在未有求證的情況下向多個網絡聊天群組發佈相關訊息。
本局根據調查所得,有強烈跡象顯示涉案男子故意捏造及發佈虛假消息,據此以誹謗、公開及詆毀、侵犯行使公共當局權力之法人等三罪將之移送檢察院偵辦。
Local man arrested on three charges of defamation, disclosure and slander, and infringement of a legal person exercising the power of a public authority
On 10th October 2021, the Judiciary Police received letters of complaint from the Health Bureau and the Education and Youth Development Bureau respectively, alleging that someone had published a false post on the Internet, the content of which indicated that the Director of Health Bureau, Director of Education and Youth Development Bureau or their related family members were living in the building where confirmed cases had been reported. It gave the impression that the health authority had been taking more lenient prevention and control measures against the building. The abovementioned bureaus stated that the content of the related post was seriously untrue, prejudicing the reputation of the two bureaus and related persons, as well as having extremely negative impacts on the SAR Government’s epidemic prevention efforts, and even causing panic among the public.
Subsequent to in-depth investigation, the Judiciary Police confirmed the identity of the involved local man, who was intercepted at his workplace on the same day and was found in possession of the suspected mobile phone for perpetration. The involved man admitted to living in the aforesaid building and claimed to have learned from the chat group of the building owners that “the relatives of the Director of Health Bureau were living on the 28th floor and the Director of Education and Youth Development Bureau was living on the 7th floor”. Therefore, he subjectively believed that the health authority had been taking more relaxed prevention and control measures against the building based on the abovementioned situation, and released the relevant message to multiple online chat groups without verification.
Based on the investigation outcomes, there were compelling indications that the involved man deliberately fabricated and published false information. The Judiciary Police therefore transferred him to the Public Prosecutions Office for three offences including defamation, disclosure and slander, and infringement of a legal person exercising the power of a public authority.
Homem detido por difamação, publicidade e calúnia, ofensa a pessoa colectiva que exerce autoridade pública
Em 10 de Outubro de 2021, a PJ recebeu as denúncias enviadas pelos Serviços de Saúde e pela Direcção dos Serviços de Educação e de Desenvolvimento da Juventude, respectivamente, acerca de um post com conteúdo falso que circulava na rede indicando que o Director dos Serviços de Saúde, o Director dos Serviços de Educação e de Desenvolvimento da Juventude ou os seus parentes moram num edifício onde havia casos confirmados, deu-se a impressão de que esse factor poderia ter influenciado a tomada de medidas de prevenção e controle da pandemia mais flexíveis perante o referido edifício. Os dois serviços acima referidos declararam que o conteúdo não corresponde à verdade, isto prejudicou a reputação desses dois serviços e os indivíduos visados, e tem causado ainda uma influência extremamente negativa sobre o trabalho feito pelo Governo no combate à epidemia, chegou até a causar pânico entre as pessoas.
A PJ identificou o homem e deteve-o no mesmo dia no seu local de trabalho, na posse dele foi apreendido o telemóvel utilizado. O homem admitiu ser morador daquele edifício, disse ter sabido, através de um grupo do Wechat dos proprietários. que “os parentes do Director dos Serviços de Saúde morariam no 28.o andar, e o Director da Direcção dos Serviços de Educação e de Desenvolvimento da Juventude (DSEDJ) no 7.o andar”. Isto o levou a pensar que este factor poderia ter influenciado a tomada de medidas de prevenção e controle da pandemia mais flexíveis por parte dos Serviços de Saúde. O mesmo alegou que não tinha feito qualquer verificação e tinha divulgado a mesma notícia noutros grupos de Wechat.
Analisadas as informações acima referidas, há fortes indícios que o suspeito redigiu e divulgou propositadamente informações falsas, por isso foi presente ao MP acusado de três crimes, difamação, publicidade e calúnia, ofensa a pessoa colectiva que exerça autoridade pública.
