一本澳男子涉突發公共事件下的妨害公共安全、秩序及安寧罪就逮
根據行政長官批示,為防止新型冠狀病毒在澳門傳播,宣佈澳門特別行政區於2021年8月3日下午3時30分起進入即時預防狀態。
2021年8月4日,本局發現有人在某網絡社交平台發表五名防疫工作人員已確診新冠肺炎的留言,經審慎調查證實有關留言內容實屬虛假,誤導公眾以為澳門有新增確診個案,相關言論足以引起公眾受驚或不安,妨害公共安全和秩序,影響特區政府的防疫工作。
本局對此高度重視並立案跟進,經深入調查後於8月5日下午將涉案本澳男子尋獲,並在其電子設備中搜獲相關犯罪證據;其承認蓄意散播虛假言論,以引起社會大眾關注。本局以突發公共事件下的妨害公共安全、秩序及安寧罪將之移送檢察院偵辦。
Local man arrested for the offence of prejudicing public security, order, and peace in the event of public emergency
Pursuant to the instructions of the Chief Executive to prevent the spread of COVID-19 in Macao, the Macao SAR was declared to have entered a state of immediate prevention from 3.30pm on 3rd August 2021.
On 4th August 2021, the Judiciary Police found that someone had posted a comment on an online social platform that 5 anti-epidemic workers had been confirmed of COVID-19 infection. After thorough investigation, it was verified that the content of the relevant comment was fake, misleading the public to believe that Macao had new confirmed cases. The relevant comment was enough to arouse public panic or anxiety, prejudicing public security and order, thereby affecting the anti-epidemic efforts of the SAR government.
The Judiciary Police attached the utmost weight to this and immediately opened a case file for follow-up. After in-depth investigation, the involved local man was found on the afternoon of August 5th, and the relevant criminal evidence was seized from his electronic device. He admitted spreading the false comment intentionally to raise public concern in the society. The Judiciary Police transferred the involved man to the Public Prosecutions Office for the offence of prejudicing public security, order, and peace in the event of public emergency.
Detido um homem de Macau por crime contra a segurança, ordem e paz públicas em incidentes súbitos de natureza pública
Por despacho do Chefe do Executivo e de forma a evitar a transmissão da COVID-19, a RAEM encontra-se no estado de prevenção imediata desde as 15:30 horas do dia 3 de Agosto de 2021.
Em 4 de Agosto, a PJ encontrou numa plataforma de redes sociais um comentário que dizia que cinco funcionários de prevenção da epidemia tinham sido infectados pelos virus COVID-19. Após cautelosas averiguações, apurou-se que o conteúdo do comentário era falso e incutia a ideia na população de que havia novos casos confirmados em Macau. Afirmações destas são suficientes para causar alarme ou inquietação pública, prejudicando a segurança e a ordem públicas e afectando o trabalho de prevenção do Governo da RAEM.
Pela importância do assunto, a PJ instaurou logo um processo para averiguação. Após trabalho exaustivo, conseguiu-se localizar um homem de Macau na tarde de 5 de Agosto, tendo sido ainda encontradas provas relacionadas com o crime no seu equipamento electrónico. O suspeito confessou ter disseminado com intenção as afirmações falsas com o objectivo de atrair a atenção do público em geral e foi presente ao Ministério Público acusado de crime contra a segurança, ordem e paz públicas em incidentes súbitos de natureza pública.
