內地男子涉信任之濫用及勒索被捕
2018年4月25日，21名內地勞工聯同一名內地勞務中介公司負責人前來本局舉報，聲稱於2016年經公司負責人介紹來澳擔任地盤工作，由公司負責人協助辦理外勞證件及負責支付薪金，但遭二判工程公司拖欠約900萬澳門元薪金，懷疑該二判工程公司故意侵犯其法益。
本局深入調查及接觸該工程公司負責人，發現該公司於2016年以1.2億澳門元將路氹城區某建築地盤工程外判上述勞務中介公司負責人，並陸續支付逾1.19億澳門元工程費及勞工薪金，但其將款項據為己有，更向勞工訛稱被拖欠薪金。另外，涉案男子曾假稱工程費用不足，勒索工程公司3,000萬澳門元，工程公司不從，涉案男子遂帶同勞工在工地外示威，又分別向本局和勞工事務局報案及作出投訴。
本局查明涉案男子的犯罪事實，以信任之濫用（相當巨額）罪和勒索罪將其移送檢察院處理。
Mainland man arrested for abuse of trust and extortion
On 25th April 2018, 21 mainland labourers accompanied by the person-in-charge of a mainland labour agency proceeded to the Judiciary Police to report a case, stating that they were introduced to work in a construction site in Macao in 2016 via the person-in-charge of the agency, who assisted in applying for non-resident worker IDs and was responsible for paying their salary. However, the subcontractor company had about MOP 9 million of salary payment in arrears, and was thus suspected of deliberately infringing upon their legitimate rights.
After investigating thoroughly and contacting the person-in-charge of the construction company, the Judiciary Police found that the company had outsourced the project of a construction site in the Cotai district to the aforesaid person-in-charge of the agency for MOP 120 million, and had paid over MOP 119 million successively as project fee and labour salary. However, the said person embezzled the amount and lied to the labourers that their salary had been stalled. Furthermore, the involved man had extorted MOP 30 million from the construction company on the pretext of insufficient project fee, then led the labourers to protest outside the construction site, and reported to the Judiciary Police and complained to the Labour Affairs Bureau respectively as the construction company refused to pay the amount.
The involved man’s perpetration had been clarified by the Judiciary Police and he was thus transferred to the Public Prosecutions Office for the offences of abuse of trust (considerably massive amount) and extortion.
Detido um homem da China continental por abuso de confiança e extorsão
Em 25 de Abril de 2018, 21 trabalhadores do continente, acompanhados por um responsável de uma agência laboral chinesa, apresentaram denúncia na PJ. Estes alegaram que foram recrutados em 2016 para trabalhar numa obra de construção de Macau, através da colaboração do responsável da agência, que cooperou na obtenção do título de identificação de trabalhador não-residente e estava encarregado pelo pagamento. No entanto, por causa de que a empresa subcontratada não ter pago cerca de 9 milhões de patacas de salário, suspeitou-se que esta empresa estivesse a violar os seus deveres jurídicos.
Na investigação profunda e no contacto com o responsável da obra de construção, apurou-se que o projecto desta obra no Cotai foi subcontratado pelo responsável daquela agência laboral chinesa, por 120 milhões de patacas, e a empresa de construção pagou, sucessivamente, 119 milhões de patacas para o custo de construção e salário dos trabalhadores. Porém, as verbas foram desviadas pelo responsável da agência que mentiu aos trabalhadores dizendo que seus salários estavam em atrasos. Para além disso, o responsável também extorquiu à empresa de construção, 30 milhões de patacas com o pretexto da insuficiência do custos de construção, a empresa de construção rejeitou o pagamento, e assim, este homem levou os trabalhadores a protestarem do lado de fora da obra de construção, e apresentarem denúncias junto à Direcção dos Serviços para os Assuntos Laborais e à Polícia Judiciária, respectivamente.
Após a verificação do facto criminoso, o homem foi presente ao MP por abuso de confiança e extorsão.
