兩漢涉貨物欺詐被拘
2024年9月12日,本局接獲市政署檢舉一宗涉及貨物欺詐罪的案件。
案情顯示,市政署於2023年4月19日就“製造及安裝澳門特別行政區之街道名牌工程”進行招標,至同年6月25日涉案一判公司中標,負責362個街道名牌安裝工程,合同中明確規定名牌瓷磚須以“釉下彩”工藝燒製,而該署亦要求工程公司提供相關檢測報告。涉案一判工程公司自同年9月起按合同要求提供瓷磚樣本及內地一檢測公司之測試合格報告,相關瓷磚樣本經市政署初步檢驗符合合同要求,故通過驗貨並隨即安排全數安裝。然而其後市政署職員在巡查街道名牌時發現當中44個名牌明顯脫落,其餘大部分則變色,質量明顯與工程指標不符,懷疑負責工程的外判公司以貼紙充當判給合同中明確規定的“釉下彩”燒製技術,誤導該署通過驗收。
本局經濟罪案調查處人員展開調查及取證,發現部分涉案街牌瓷磚確實呈明顯脫落及變色。
2024年9月16日,本局人員截獲上述街牌工程的一判及二判工程公司的負責人,以及兩間公司負責項目的本澳男職員及內地男職員。經查,兩間工程公司負責人並無參與過程;涉案本澳男職員表示在承接有關工程後即交由下判工程公司跟進,過程中已要求對方以“釉下彩”工藝製作街牌,惟雙方並無簽署任何協議文件,其僅將市政署部分報價合同交予下判公司執行,而有關街牌則由下判公司在內地採購;而涉案內地男職員則辯稱已按照合同向內地採購瓷磚,且並無接獲一判公司的涉案本澳男職員就瓷磚製作工藝提出任何要求。
本局根據調查所得,以貨物欺詐罪將兩名涉案嫌犯移送檢察院偵辦。由於不排除尚有其他人士涉案,本局將繼續就案件進行深入調查。
Two men arrested for merchandise fraud
On 12th September 2024, the Judiciary Police received a complaint from the Municipal Affairs Bureau about a case involving offence of merchandise fraud.
Case details revealed that the Municipal Affairs Bureau invited tenders for the “manufacturing and installation of street nameplates in the Macao Special Administrative Region” on 19th April 2023, and on June 25th of the same year, the involved main contractor company won the tender and was responsible for the installation of 362 street nameplates. It was clearly stipulated in the contract that the ceramic tiles of nameplates had to be manufactured using the “underglaze” technique, and the Municipal Affairs Bureau had also requested the engineering company to provide the relevant testing report. Since September of the same year, the involved main contractor engineering company provided ceramic tile samples and a testing qualification report from a mainland testing company in accordance with the contractual requirements. The relevant ceramic tile samples met the contractual requirements after preliminary examination by the Municipal Affairs Bureau, hence the acceptance test was passed and the installation of all the nameplates were arranged thereupon. However, when the Municipal Affairs Bureau personnel inspected the street nameplates later, 44 of which were found obviously flaked off, while most of the remaining were discoloured, the quality of the nameplates clearly was not in compliance with the project specifications. It was suspected that the outsourced company responsible for the works had misled the Municipal Affairs Bureau into passing the acceptance test by using stickers as the “underglaze” manufacturing technique expressly stipulated in the awarded contract.
The Economic Crimes Division personnel of the Judiciary Police initiated an investigation and gathered evidence, it was found that the ceramic tiles of some of the street nameplates in question were indeed obviously flaked off and discoloured.
On 16th September 2024, the Judiciary Police personnel intercepted the persons-in-charge of the main contractor and sub-contractor engineering companies of the above street nameplate works, as well as the local male employee and mainland male employee of the two companies responsible for the works. Investigation revealed that the persons-in-charge of the two engineering companies were not involved in the process. The involved local male employee stated that subsequent to undertaking the related works, he had immediately handed it over to the sub-contractor engineering company to follow up, and in the process, he had already requested the other party to employ the “underglaze” craftsmanship to manufacture the street nameplates, yet no agreement was signed between the two parties. He had only handed over part of the Municipal Affairs Bureau’s quotation contract to the sub-contractor company for execution, whereas the involved street nameplates were procured by the sub-contractor company in mainland. The involved mainland male employee argued that he had purchased the ceramic tiles from mainland in accordance with the contract, and did not receive any requirement from the involved local male employee of the main contractor company in respect of the ceramic tile-manufacturing process.
Base on the investigative results, the Judiciary Police transferred the two involved suspects to the Public Prosecutions Office for the offence of merchandise fraud. As it is not ruled out that there are other persons involved in the case, the Judiciary Police will continue to conduct in-depth investigation into the case.
Dois homens detidos por fraude sobre mercadorias
Em 12 de Setembro de 2024, o Instituto para os Assuntos Municipais (IAM) entregou à PJ um caso de fraude sobre mercadorias.
Conforme mostra a informação, o IAM, no dia 19 de Abril de 2023, abriu um concurso de empreitada “Manufactura e colocação das placas toponímicas na RAEM”. No dia 25 de Junho desse ano, a empresa que ganhou o concurso era responsável pela montagem de 362 placas toponímicas, as quais deviam ser fabricadas com a técnica “underglaze”, conforme estipula o contrato, enquanto o IAM exigiu da empresa o fornecimento do relatório de exame. Desde Setembro do mesmo ano, a empresa disponibilizou, de acordo com as cláusulas contratuais, amostras de azulejos e relatório de qualidade elaborado por uma empresa que fazia testes na China continental, e essas amostras, examinadas pelo IAM, satisfizeram as exigências do contrato, por isso, aprovaram-se os produtos em causa na inspecção e logo foi organizada a montagem de todas as placas. Posteriormente, quando os funcionários do IAM inspecionavam as placas de rua, descobriram que 44 delas estavam a perder a tinta e o restante a descolorir, o que mostra que a qualidade não corresponde claramente aos critérios pedidos, suspeitou-se assim que a empresa que ganhou usou papel adesivo para substituir a técnica “underglaze” prevista no contrato, de modo a enganar o IAM aquando da recepção da obra.
O pessoal da Divisão de Investigação de Crimes Económicos iniciou a investigação e recolheu provas, verificando que parte dos azulejos estava obviamente a descascar e perder a cor.
No dia 16 de Setembro de 2024, o nosso pessoal encontrou os responsáveis da empresa encarregada e do subemprenteiro, assim como um seu funcionário de Macau e outro da China continental, que estavam encarregados de realizar o projecto. Na investigação, apurou-se que os responsáveis das empresas não estavam envolvidos no projecto; o funcionário de Macau defendeu que, logo que ganhou a empreitada, encarregou outra empresa para que fizesse o trabalho, pediu-lhe para que as placas fossem fabricadas com a técnica “underglaze”, mas não houve acordo assinado pelas partes e apenas entregou parte da empreitada à outra empresa para esta a executar, também disse que essas placas tinham sido adquiridas por essa empresa no continente; o funcionário da China continental alegou ter comprado azulejos conforme exigido no contrato, e nunca ter sido informado, pelo funcionário de Macau da empresa que ganhou, de qualquer critério sobre a técnica de produção dos azulejos.
De acordo com o apurado na investigação, os dois funcionários foram presentes ao MP por fraude sobre mercadorias, sendo possível que haja outras pessoas envolvidas, o que deixa a investigação em aberto.
