本澳男子涉巨額信任之濫用法辦
2024年6月23日，本局接獲內地男事主舉報，稱遭一名本澳男子侵吞其交付用作購買名錶的款項。案情顯示，事主與涉案本澳男子已相識數年，於今年4月，事主一名內地朋友欲以10萬元人民幣購買一枚名錶，事主遂主動聯絡涉案本澳男子要求其在澳門代為選購，並於4月29日將用作購錶的10萬元人民幣轉帳至對方的內地銀行帳戶內，雙方同意若未能成功選購則全數退款。直至5月份，由於一直未能成功購買名錶，事主遂要求涉案本澳男子退款，惟對方聲稱其內地銀行卡出現問題，故只能以電子支付方式每日轉帳2,000元人民幣作退款。涉案本澳男子合共退還3.6萬元人民幣後即沒有再退款並失聯，導致事主損失6.4萬元人民幣。
本局經濟罪案調查處跟進調查，於7月16日截獲涉案本澳男子。經查，涉案本澳男子將事主交付的款項挪用作賭博並輸光，其後在事主追討下返還3.6萬元人民幣。
本局綜合調查所得，以信任之濫用（巨額）罪將涉案本澳男子移送檢察院偵辦。
Macao man arrested for involvement in abuse of trust (huge amount)
On 23rd June 2024, the Judiciary Police received a report from a mainland male victim, who claimed that, a Macao man had misappropriated the money he had given him for the purchase of a luxury watch. Case details revealed that, the victim and the involved Macao man had known each other for several years. In April this year, a mainland friend of the victim would like to purchase a luxury watch for RMB100,000. Thus, the victim took the initiative to contact the involved Macao man to purchase it for him in Macao. On April 29th, he transferred a sum of RMB100,000, which was to be used for the watch purchase, to a mainland bank account of the other party. Both parties agreed to a full refund if the purchase was unsuccessful. Until May, given the unsuccessful purchase of the luxury watch for long, the victim asked the involved Macao man for a refund. Yet, the other party claimed that, as there was an issue with his mainland bank card, the refund could only be made by a transfer of RMB2,000 per day via the electronic payment method. After returning the victim RMB36,000 in total, the involved Macao man did not make further refunds and was out of reach, resulting in a loss of RMB64,000 for the victim.
The Economic Crimes Division of the Judiciary Police followed up with the investigation, and intercepted the involved Macao man on July 16th. Upon investigation, it was found that, the involved Macao man had misappropriated the money given by the victim on gambling and lost it all. Subsequently, under the pursuit of the victim, he had returned RMB36,000.
Integrating the investigative results, the Judiciary Police transferred the involved Macao man to the Public Prosecutions Office for the offence of abuse of trust (huge amount).
Detido um residente por abuso de confiança de valor elevado
No dia 23 de Junho de 2024, recebemos a denúncia dum homem do Continente, alegando que um residente de Macau tinha-se apropriado do dinheiro que ele lhe entregou para comprar um relógio de luxo. Conforme o apurado, a vítima e o suspeito já se conheciam há anos e, em Abril deste ano, um amigo do Continente da vítima queria comprar um relógio de luxo com 100.000 RMB. A vítima contactou o suspeito e pediu-lhe para que comprasse o relógio em Macau. Para isso, no dia 29 de Abril, a vítima transferiu 100.000 RMB para a conta bancária da China continental do suspeito. Ambos concordaram que o dinheiro seria devolvido integralmente caso não conseguisse a compra. Como, até em Maio, ainda não tinha concretizado a compra, a vítima pediu ao suspeito para efectuar a devolução total do dinheiro, contudo, o mesmo disse-lhe que tinha problemas com o cartão bancário da China continental, por isso, só poderia fazer a devolução através de pagamento electrónico, transferindo-lhe 2.000 RMB por dia. O suspeito chegou a devolver até 36.000 RMB, a partir daí, parou e deixou de ser contactável, o que causou à vítima um prejuízo de 64.000 RMB.
A Divisão de Investigação de Crimes Económicos acompanhou o caso e o suspeito foi detido no dia 16 de Julho. Na investigação verificou-se que o detido, residente de Macau, perdeu o dinheiro que lhe tinha sido entregue no jogo e apenas tinha conseguido devolver 36.000 RMB à vítima.
Com base nos resultados obtidos na investigação, o suspeito foi presente ao MP acusado de abuso de confiança em valor elevado.
