內地婦涉協助收取“公檢法”電話詐騙贓款被捕
2023年9月5日,本局接獲一名本澳男事主報案,稱於2023年8月24日其接到一名自稱為上海市公安局公安的人士來電,指其登記的內地電話號碼在內地發佈大量非法賭博訊息,要求事主到上海市公安局協查。起初事主拒絕,然而對方表示可協助事主轉線到上海市公安局刑警支隊報案。其後,兩名分別自稱為公安及檢察官的人士指事主涉及一宗特大賭博詐騙案,向事主傳送印有其身份資料的“通緝令”及“取保候審”等文件,同時自稱公安的人士與事主進行視頻通話時穿著警服並身在類似公安局辦公室的地方,因此事主相信對方為內地公安且自己涉及內地刑事案件。
其後事主按對方指示,透過社交軟件開啟流動電話“分享屏幕功能”後登入一條連結,並輸入自己的網上銀行資料,包括登入密碼及交易密碼,以配合“資金審查”。事主隨後有所懷疑並向銀行查詢,獲銀行職員告知其帳戶曾轉出685萬港元到三個香港銀行帳戶,方知被騙。
本局資訊罪案調查處展開深入調查,發現當中165萬港元被匯到涉案內地女子名下的一個香港銀行帳戶,事後有關款項已被提現。
2024年4月15日,涉案內地女子經關閘口岸入境時被截獲。經查,其承認應一名不知名男子要求到香港開立銀行帳戶及收取款項,並將開戶資料及提款卡交給對方,對方承諾事後給予帳戶收款額兩成作報酬,惟至今仍未收到任何報酬。本局人員查悉有人指示涉案內地女子開立多個香港銀行帳戶,其後涉案內地女子將銀行帳號、網上銀行帳戶及提款卡提供予對方。
本局根據調查所得,以詐騙(相當巨額)罪、清洗黑錢罪及犯罪集團罪將涉案內地女子移送檢察院偵辦。
Mainland woman assisted in collecting illicit proceeds of “impersonating government officials” telephone fraud under arrest
On 5th September 2023, the Judiciary Police received a report from a local male victim, indicating that he had received a phone call from someone who claimed to be a public security officer of Shanghai Municipal Public Security Bureau on 24th August 2023, and stated that his registered mainland phone number had disseminated scores of illegal gambling messages in mainland, hence requested him to proceed to the Shanghai Municipal Public Security Bureau for assistance in the investigation. At first the victim refused to do so, yet the caller offered to assist the victim in transferring the call to the Criminal Police Detachment of Shanghai Municipal Public Security Bureau to report the case. Afterwards, two individuals who respectively claimed to be a public security officer and a prosecutor indicated that the victim had been involved in a mega gambling fraud case, and sent him documents including a “wanted warrant” and an “application for bail pending trial” with his identity information printed thereon. Meanwhile, the self-claimed public security officer was wearing a police uniform and was in a place similar to the Public Security Bureau office when making the video call with the victim, therefore the victim believed that the caller was a mainland public security officer and that he had been involved in a criminal case in mainland.
Thereafter, the victim followed the caller’s instructions to activate the “screen sharing function” of his mobile phone through a social networking app, logged onto a link and input his online banking information, including the login and transaction passwords, in order to facilitate the “capital vetting”. The victim subsequently smelled a rat and made enquires to the bank, after which he was informed by the bank personnel that HKD6.85 million in his bank account had been transferred to three Hong Kong bank accounts, and it was till then did he realise that he had been defrauded.
The I.T. Crimes Division personnel of the Judiciary Police initiated an in-depth investigation and found that HKD1.65 million of the fraudulent proceeds had been remitted to a Hong Kong bank account under the name of the involved mainland woman. The related funds had been subsequently withdrawn.
On 15th April 2024, the involved mainland woman was intercepted upon her entry into Macao via the Border Gate checkpoint. After investigation, she admitted that, as per the request of an unknown man, she had opened a bank account in Hong Kong to receive the funds, as well as handing the bank account information and ATM card to the man, who promised to pay her 20% of the received amount in the bank account as remuneration upon completion of the task, yet no remuneration has been received so far. The Judiciary Police personnel found that someone had instructed the involved mainland woman to open a number of Hong Kong bank accounts, to whom she provided the bank account numbers, online banking accounts and ATM cards thereupon.
Based on the investigative results, the Judiciary Police transferred the involved mainland woman to the Public Prosecutions Office for the offences of fraud (considerably huge amount), money laundering and criminal syndicate.
Detida uma mulher do continente por colaborar na recolha de dinheiro vindo duma burla “ Polícia, Procuradoria e Tribunal”
Em 5 de Setembro de 2023, a PJ recebeu a queixa dum residente, a dizer que em 24 de Agosto de 2023 recebeu um telefonema dum indivíduo que alegava ser funcionário da Directoria Municipal de Segurança Pública da Cidade de Shanghai, apontou que o seu número telefónico registado no continente tinha divulgado, em grande quantidade, informações relativas ao jogo ilegal na China continental e pediu-lhe para se deslocar à directoria supracitada para colaborar na investigação. Inicialmente a vítima recusou o pedido, mas a outra parte disse que iria transferir a chamada para apresentar queixa junto do Grupo de Polícia Criminal da mesma directoria. Posteriormente, outros dois indivíduos, alegando ser agente e magistrado, disseram que a vítima estava envolvida numa burla de jogo muito grande e enviaram-lhe documentos, “mandato de captura” e “libertação sob fiança na pendência de julgamento”, que constavam nos seus dados de identificação. Ao fazer uma videochamada, o alegado agente usou uniforme da polícia e se encontrava num local semelhante ao gabinete de segurança pública, assim, a vítima acreditou que se tratava de um polícia do continente e que ele próprio estava envolvido num caso criminal na China.
Posteriormente, a vítima activou, através duma aplicação, a função “partilha da tela” do telemóvel conforme as indicações, acedeu a um link e introduziu os seus dados bancários online, incluindo as senhas de acesso e de transacção, com o fim de colaborar para proceder à “verificação de capitais”. Mais tarde, a vítima, desconfiando, consultou o banco e foi informada de que tinham sido transferidos 6.850.000 HKD para três contas bancárias de Hong Kong e apercebeu-se de que tinha sido enganada.
O pessoal da Divisão de Investigação de Crimes Informáticos iniciou a investigação, verificou que 1.650.000 HKD tinham sido remetidos a uma conta bancária de Hong Kong registada em nome duma mulher do continente que estaria envolvida no caso, e o dinheiro tinha sido posteriormente levantado.
A mulher em causa foi detida em 15 de Abril de 2024 quando entrou em Macau pelas Portas do Cerco. No interrogatório admitiu ter aberto contas bancárias em Hong Kong e ter recebido dinheiro a pedido dum desconhecido, entregou também os dados de abertura da conta e os cartões ATM. O outro comprometeu-se a pagar, posteriormente, 20% da quantia recebida nas contas, mas até ao momento não tinha recebido nada. Na investigação, soube-se que a detida foi instruída a abrir várias contas bancárias em Hong Kong e entregou os números de conta bancária, contas bancárias online e cartões ATM ao outro.
Conforme os resultados obtidos na investigação, a suspeita foi presente ao Ministério Público por burla (de valor consideravelmente elevado), branqueamento de capitais e associação criminosa.
