反罪惡巡查行動——查獲八名從事不法兌換外幣活動的澳門居民
為持續打擊非法兌換活動(俗稱換錢黨),司警局透過與金融管理局建立的合作機制,於2024年3月27日下午3時,共出動15名刑事偵查人員及七名金融管理局人員,於路氹城區一娛樂場周邊及酒店範圍展開打擊非法匯兌的聯合行動。
行動中,共查獲八名(六男二女)從事不法兌換外幣活動的澳門居民。
經對上述八名人士作調查及身份識別後,沒有發現上述八名人士涉及刑事犯罪;但有跡象顯示該八名人士從事不法兌換外幣活動,故由金融管理局根據相關法律進行處理。
根據第13/2023號法律《金融體系法律制度》,任何人士或實體未獲許可從事匯兌業務屬嚴重行政違法行為,可被科處50萬至500萬澳門元的罰款,倘活動嚴重影響澳門金融體系的穩定或擾亂金融市場的正常運作,則最高可被科處至1,000萬澳門元的罰款。金融管理局表示將按照《金融體系法律制度》的相關規定,對違法人士提起法律程序。
針對在娛樂場及周邊地方出現的非法匯兌活動,司警局將持續加強巡查打擊,並不定時聯同相關部門進行聯合行動,務求最大程度地壓止該等不法活動。
Anti-crime patrol operation – Seizure of eight Macao residents engaged in illegal foreign currency exchange activities
In a bid to continue to combat illegal currency exchange activities (commonly known as the money exchange gangs), the Judiciary Police, through the cooperation mechanism established with the Monetary Authority of Macao, mobilised a total of 15 criminal investigators and 7 personnel of the Monetary Authority to launch a joint operation against illegal currency exchange in the vicinity of a casino and in a hotel premises in the Cotai district at 3:00 p.m. on 27th March 2024.
During the operation, a total of eight (six men and two women) Macao residents who had engaged in illegal foreign currency exchange activities were seized.
Upon investigation and identity verification of the aforesaid eight individuals, none of whom were found involving in criminal offences, yet there were indications that these eight individuals had engaged in illegal foreign currency exchange activities, hence they were dealt with according to the relevant laws by the Monetary Authority of Macao.
In accordance with the Law No. 13/2023 “Legal Regime of the Financial System”, any person or entity engaging in unauthorised foreign exchange business is a serious administrative offence, which is punishable by a fine of MOP500,000 to MOP5 million, and up to a maximum fine of MOP10 million if the activities seriously affect the stability of the financial system in Macao or disrupt the normal operation of the financial market. The Monetary Authority of Macao indicated that legal proceedings would be initiated against the offenders in accordance with the relevant provisions of the “Legal Regime of the Financial System”.
The Judiciary Police will continue to step up patrols and crackdowns on illegal currency exchange activities in casinos and their peripheries, and will conduct joint operations with relevant departments from time to time, in order to maximise the curbing efforts of such illegal activities.
Operação anticrime – Identificados 8 residentes por exercício de actividades de troca ilegal de dinheiro
A fim de continuar a reprimir as actividades de troca ilegal de dinheiro (conhecida por burla de troca de moeda), a PJ recorreu ao mecanismo de cooperação, implementado com a Autoridade Monetária, para lançar uma operação conjunta às 15h00 do dia 27 de Março de 2024, mobilizou 15 investigadores criminais que juntamente a 7 oficiais da Autoridade Monetária, efectuaram uma rusga nos arredores dum casino da zona do Cotai e do seu hotel.
Nesta operação, foram identificados oito residentes (6 homens e 2 mulheres) que faziam troca ilegal de dinheiro.
Na investigação e identificação das referidas oito pessoas, apurou-se que elas não estavam envolvidas em crimes, mas havia indícios de que praticaram troca ilegal de dinheiro. Por isso foram acompanhadas pela Autoridade Monetária de acordo com a lei.
De acordo com a Lei n.º 13/2023 (Regime jurídico do sistema financeiro), qualquer indivíduo ou entidade que exercer o comércio de câmbios sem autorização constituiu uma infracção administrativa grave sancionada com multa de 500.000 a 5 milhões de pacatas, e se a actividade afectar de modo grave a estabilidade do sistema financeiro ou perturbar o funcionamento normal do mercado financeiro de Macau, pode ser sujeito a uma multa, até ao máximo de 10 milhões de patacas. A Autoridade Monetária afirmou que vai instaurar um processo contra os infractores de acordo com os dispostos estipulados no Regime jurídico do sistema financeiro.
Em resposta às actividades de troca ilegal de moeda nos casinos e nos seus arredores, a PJ vai continuar a intensificar as patrulhas e rusgas para combatê-las e vai fazer aleatoriamente operações conjuntas com os serviços competentes, fazendo o possível para reprimir essas atividades ilegais.
