香港男子涉詐騙及清洗黑錢就逮
2021年5月7日,一名女事主到本局作出檢舉,指有人在網上對其進行殺豬盤詐騙。女事主聲稱於2021年2月在社交平台上認識一名男子,對方聲稱在海外從事黃金期貨的買賣工作。聊天過程中,對方經常發佈一些奢侈生活的照片,營造為一名成功人士。經過一個月的聊天後,該名男子聲稱可以協助女事主投資買賣黃金,訛稱依照指示操作可輕易於短時間內賺取10%的回報,於是女事主便在對方提供的一個不明投資網站上註冊,按網站客服指示將款項匯款到一些海外的銀行帳戶內。
最初,女事主兩次按照對方指示操作後,成功收取到合共四萬元人民幣的利潤,繼而相信有利可圖,便聽從對方的慫恿,於一個月內將多筆的款項匯款到網站客服指定的海外銀行帳戶內。但其後女事主打算提款時,卻操作失敗,有關的網站亦無法登入,故懷疑被人詐騙,報稱損失約425萬港元及90萬元人民幣。
本局資訊罪案調查處調查後,鎖定其中一個涉案銀行帳戶,但涉案香港男子已離境。直至2024年1月5日早上,本局成功在港珠澳大橋澳門口岸將涉案男子截獲,其供稱於2021年案發前,在香港被人招攬開設銀行帳戶協助“走資”,並在香港銀行開設了三個香港銀行帳戶、開通網上銀行及一張其名下登記的電話卡,以總額6,000港元出售予一名不知明人士。約數星期後,嫌犯得知對方已完成“走資”,便取回其銀行帳戶的使用權,現時涉案的銀行戶口已被其註銷。涉案香港男子否認進行殺豬盤詐騙。
本局根據調查所得,以詐騙(相當巨額)罪及清洗黑錢罪將涉案香港男子移送檢察院偵辦。
Hong Kong man arrested for fraud and money laundering
On 7th May 2021, a female victim came to the Judiciary Police to file a complaint. She indicated that she had fallen prey to a pig-butchering scam online, alleging that she got acquainted with a man on social platform in February 2021, who claimed to be engaged in gold futures trading overseas. Throughout the chat, the man often posted photos of luxury living to portray himself as a successful man. After chatting for a month, the man said that he could assist the female victim to invest in gold trading and falsely claimed that by following instructions, a return of 10% could easily be made in a short time. As such, the female victim registered on an unknown investment website provided by him and remitted money to some overseas bank accounts as instructed by the website’s customer service.
Initially, the female victim had successfully received a total of RMB40,000 in profit by following the instructions of the other party twice. Believing that it was profitable, she was persuaded by the other party to remit multiple amounts of money to the overseas bank accounts designated by the customer service of the website within a month. However, when the female victim wanted to withdraw money later, the operation failed and the relevant website could not be logged in. Therefore, she suspected that she had been defrauded and reported a loss of approximately HKD4,250,000 and RMB900,000.
After investigation by the IT Crimes Division of the Judiciary Police, one of the involved bank accounts was identified, but the involved Hong Kong man had exited Macao. Until the morning of 5th January 2024, the Judiciary Police successfully intercepted the involved man at the Macao Port of the HZM Bridge. He claimed that in 2021 before the case occurred, he was solicited to open bank accounts to assist in “fund transfer” in Hong Kong. He opened three Hong Kong bank accounts in Hong Kong, activated online banking and a phone card registered under his name, and sold them to an unknown person for a total of HKD6,000. Several weeks later, after knowing that the other party had finished the “fund transfer”, the suspect took back the right of use to his bank accounts. The involved bank accounts had now been cancelled by him. The involved Hong Kong man denied committing pig-butchering fraud.
Based on the findings from the investigation, the Judiciary Police transferred the involved Hong Kong man to the Public Prosecutions Office for the offence of fraud (considerably huge amount) and money laundering.
Detido um homem de Hong Kong por burla e branqueamento de capitais
Em 7 de Maio de 2021, uma mulher fez queixa na PJ, dizendo que foi vítima de uma burla de “pig-butchering” online. A queixosa disse que conheceu um homem nas redes sociais, em Fevereiro de 2021, este disse-lhe que fazia compra e venda de objectos em ouro no estrangeiro. Nas conversas, o homem mostrou-lhe, várias vezes, fotos que mostravam que ele tinha uma vida luxuosa e de sucesso. Depois de um mês de conversas, o homem disse que poderia guiá-la a investir na compra e venda de ouro, e alegou que de acordo com as suas instruções poderia facilmente lucrar 10%, em pouco tempo. Assim, a vítima registou-se num site de investimento fornecido pelo homem e, de acordo com as instruções do serviço de atendimento ao cliente do site, enviou dinheiro para algumas contas bancárias no estrangeiro.
No início, a vítima lucrou, em duas ocasiões, um total de 40.000 renminbis, de acordo com as instruções da outra parte, assim acreditou que de facto podia ganhar com aquele sistema, e levada pelo burlão, fez várias remessas, ao longo de um mês, para a conta indicada pelo serviço de atendimento ao cliente do site. Passado algum tempo, quando a vítima quiz levantar o seu dinheiro, não conseguiu aceder à conta nem ao site, percebeu que tinha sido burlada e disse que sofreu um prejuízo de cerca de 4,25 milhões de dólares de HK e de 900.000 renminbis.
A Divisão de Investigação de Crimes Informáticos investigou o caso e identificou uma das contas envolvidas, mas o criminoso, de HK, tinha saído de Macau. Só na manhã de 5 de Janeiro de 2024, conseguiu-se detê-lo no posto fronteiriço de Macau da Ponte Hong Kong-Zhuhai-Macau, este disse que em 2021, antes de actuação, foi recrutado em Hong Kong para abrir contas bancárias que serviam para efectuar “transferências de fundos” e também abriu três contas bancárias em Hong Kong, bem como activou o serviço de banco online e um cartão SIM registado em seu nome, pouco depois, vendeu-os a um indivíduo desconhecido por 6.000 HK$. Passadas várias semanas, o suspeito soube que o outro tinha feita aquela “transferência”, por isso retomou o direito de acesso às suas contas. Naquela altura, as contas bancárias utilizadas na prática tinham sido canceladas pelo detido, que negou ter praticado a burla de “pig-butchering”.
Com base na investigação, o detido foi presente ao MP acusado de burla (valor consideravelmente elevado) e de branqueamento de capitais.
