兩港漢涉虛擬貨幣詐騙集團及清洗黑錢被捕
近日本局接獲香港警方通報,要求協助調查一宗與虛擬貨幣交易平台JPEX有關的特大詐騙案。
本局清洗黑錢罪案調查處及資訊罪案調查處接報後立即展開調查,並持續與香港警方交流情報,確認香港警方正立案調查JPEX詐騙案。資料顯示,JPEX涉嫌訛稱為合法持牌公司,利用場外找換店及網絡紅人進行宣傳,並以不合理的極高回報作招徠吸引投資者。然而,由JPEX所發行的JPC幣不能進行場外交易,流通性極低,加上JPEX可任意更改提取虛擬貨幣的手續費,使投資者無法取回本金。截至2023年9月28日,香港共有2,417人報案,涉款金額約15億港元。
經查,本局人員鎖定JPEX關聯的虛擬貨幣場外交易所的兩名香港男負責人涉案,遂於9月28日採取行動,在新口岸區一酒店截獲兩人。本局人員在兩人身上搜獲約650萬港元籌碼及7萬港元現金,並即時凍結其中一人於本澳兩家娛樂場帳戶內合共約800萬港元的存款。
兩人對本局的調查均拒絕合作,惟據本局調查所得,兩人同為JPEX詐騙案的犯罪集團骨幹成員,負責利用本澳娛樂場帳戶轉移、隱藏及清洗犯罪所得的不法利益。本局以犯罪集團、清洗黑錢及電腦詐騙等三罪將兩人移送檢察院偵辦,並繼續深入調查案件。
有關JPEX詐騙案,本局於2023年9月25日至28日期間先後接獲三名本澳居民報案,指透過社交媒體廣告連結下載由JPEX營運的手機軟件“JPEX WALLET”後,在該虛擬錢包注資購買由其發行的JPC幣及其他虛擬貨幣,其後得悉JPEX並無向香港證監會申領在當地經營虛擬資產交易平台的牌照,且欲提取虛擬貨幣不果,懷疑被騙而報警求助。三人報稱損失合共1,447,205澳門元。
本案中,香港警方目前已拘捕16人,扣押現金及資產總值約9,686萬港元;而本局已拘捕2人,扣押現金及籌碼總值約1,400多萬港元。
Two Hong Kong men involved in virtual currency fraud syndicate and money laundering under arrest
The Judiciary Police received a notification from the Hong Kong police recently, requesting assistance in the investigation of a mega fraud case related to the virtual currency trading platform JPEX.
Upon receipt of the report, the Anti-Money Laundering Division and I.T. Crimes Division of the Judiciary Police launched an investigation immediately, and continued to exchange intelligence with the Hong Kong police, confirming that the latter had currently placed the JPEX fraud case on file for investigation. Information revealed that JPEX was suspected of falsely claiming to be a legitimate licenced company, making use of the over-the-counter currency exchange stores and Internet celebrities for publicity, and attracting investors with unreasonably high returns as a selling point. However, The JPC coins issued by JPEX could not be traded over-the-counter with an extremely low liquidity. In addition, JPEX could change the handling fees for withdrawal of virtual currencies arbitrarily, which made the investors fail to retrieve their capital. As of 28th September 2023, a total of 2,417 persons reported the case in Hong Kong with an involved amount of approximately HKD1.5 billion.
After investigation, the Judiciary Police identified two male Hong Kong persons in charge of a JPEX-related virtual currency over-the-counter exchange as involved in the case, hence action was taken on September 28th to intercept the two individuals in a hotel in ZAPE district. The Judiciary Police personnel found the two individuals in possession of around HKD6.5 million casino chips and HKD70,000 cash, coupled with immediate freezing of the total deposits of approximately HKD8 million held by one of them in two casino accounts in Macao.
The two individuals refused to cooperate with the investigation of the Judiciary Police. Yet, according to the investigative results of the Judiciary Police, the two individuals were both core members of the criminal syndicate involved in the JPEX fraud case, who were responsible for using casino accounts in Macao to transfer, conceal and launder illicit proceeds of crime. The Judiciary Police transferred the two individuals to the Public Prosecutions Office for three offences including criminal syndicate, money laundering and computer fraud, while continuing to conduct an in-depth investigation into the case.
Regarding the JPEX fraud case, the Judiciary Police successively received reports from three Macao residents between 25th and 28th September 2023, who claimed that after downloading the mobile phone software “JPEX WALLET” operated by JPEX through a social media advertising link, they injected funds into the virtual wallet to purchase JPC coins and other virtual currencies issued by JPEX. Afterwards, it was learned that JPEX had not applied for a licence from the Hong Kong Securities and Futures Commission to operate a virtual asset trading platform in Hong Kong, and they attempted to withdraw the virtual currencies but to no avail. Suspected of being defrauded, they reported to the police for assistance. The three residents reported a total loss of MOP1,447,205.
In this case, the Hong Kong police had so far arrested 16 persons, and seized cash and assets with a total value of approximately HKD96.86 million; while the Judiciary Police had arrested two persons with seizure of cash and casino chips worth approximately over HKD14 million.
Detidos dois homens de Hong Kong por envolvimento numa rede de burla relativa a moedas virtuais e branqueamento de capitais
Nos últimos dias, a PJ recebeu uma comunicação da polícia de HK, que pediu a colaboração na investigação de um enorme caso de burla relativo a uma plataforma de transacções de moedas virtuais, conhecida como “JPEX”.
Após recebida a notificação, a Divisão de Investigação de Crimes de Branqueamento de Capitais e a Divisão de Investigação de Crimes Informáticos da PJ iniciaram a investigação imediatamente e continuaram a trocar informações com a polícia de HK para confirmar o caso de burla da “JPEX” instaurado pela polícia de HK. De acordo com as informações obtidas, a “JPEX” alegava falsamente ser uma sociedade com licença legal, utilizava algumas lojas físicas de troca de dinheiro e celebridades da internet para a propagação e publicitava retornos incríveis e extremamente altos para atrair os investidores. No entanto, as transacções sobre as moedas “JPC” emitida pela “JPEX” não podiam ser efectuadas no mercado de balcão e a circulação daquela moeda era muito baixa. Além disso, a “JPEX” podia arbitrariamente alterar as taxas de levantamento das moedas virtuais, levando a que os investidores não conseguissem recuperar os capitais. Finalmente, no dia 28 de Setembro de 2023, 2.417 pessoas fizeram queixa à Polícia de Hong Kong, para um montante envolvido de cerca de 1,5 mil milhões de HKD.
Na investigação, os nossos agentes identificaram dois homens de HK, responsáveis por uma agência de moedas virtuais associada à “JPEX”, e entraram em acção no dia 28 de Setembro, foram detidos os dois suspeitos num hotel no NAPE, na sua posse foram apreendidos cerca de 6,5 milhões de HKD em fichas e 70.000 HKD em numerário, bem como foram imediatamente congeladas as contas de um dos detidos, abertas em dois casinos de Macau, com depósitos totais de cerca de 8 milhões de HKD.
Os dois detidos recusaram-se a cooperar na investigação, mas de acordo com as provas obtidas, eram elementos principais da rede criminosa de burla da “JPEX”, responsáveis por transferir, esconder e lavar os lucros ilegais através das contas dos casinos de Macau. Os dois foram presentes ao MP por associação criminosa, branqueamento de capitais e burla informática. A PJ continua a investigar o caso.
Relativamente ao caso de burla da “JPEX”, entre 25 e 28 de Setembro de 2023, a PJ recebeu sucessivamente as denúncias de três residentes, nas quais diziam que depois de terem descarregado o software de telemóvel “JPEX WALLET” operado pela “JPEX” através de um link publicitado nas redes sociais, depositaram o dinheiro naquela carteira virtual para comprar as moedas “JPC” emitidas pela “JPEX” e outras moedas virtuais, mas posteriormente souberam que a “JPEX” não tinham a licença emitida pela Securities and Futures Commission de Hong Kong para operar uma plataforma local de transacções de activos virtuais, bem como não conseguiram fazer o levantamento de moedas virtuais, assim, acharam que se tratava de uma burla e fizeram queixas na PJ. O prejuízo total dos três denunciantes foi de 1.447.205 patacas.
Neste caso, a polícia de HK deteve 16 pessoas e apreendeu, no total, 96,86 milhões de HKD em numerário e activos, enquanto que a PJ deteve 2 pessoas e apreendeu mais de 14 milhões de HKD em numerário e fichas.
