三男女涉偽造文件被拘
2021年3月,本局按檢察院要求調查一宗假結婚案,案情指涉案女子早年與涉案本澳男子在內地結婚,隨後涉案女子成功申請來澳定居及取得澳門居民身份證;兩人於2017年離婚,涉案女子於2020年獲發澳門永久性居民身份證。經深入調查,有跡象顯示兩人婚後沒有共同生活,涉嫌假結婚。
本局於2021年10月21日分別在兩名涉案男女的住所將其拘捕;兩人均承認犯案,涉案女子為取得澳門居留權,透過另一名本澳男子介紹與涉案男子假結婚,期間涉案男女簽署協議書,擬定涉案女子在取得澳門居留權後,便按協議書條款向涉案男子支付共五萬澳門元報酬。本局根據調查所得拘獲上述介紹人,以偽造具特別價值之文件罪結合第6/2004號法律《非法入境、非法逗留及驅逐出境》所規定的偽造文件罪將三人移送檢察院偵辦。
Three persons arrested for document falsification
Requested by the Public Prosecutions Office, the Judiciary Police conducted investigation into a case of sham marriage in March 2021. Case details revealed that the involved woman, having got married with the involved local man in mainland China some years earlier, subsequently succeeded in applying for residency in Macao and obtained her Macao Resident Identity Card. The couple divorced in 2017, while the involved woman had her Macao SAR Permanent Resident Identity Card issued in 2020. In-depth investigation led to indications of the absence of cohabitation after their suspected sham marriage.
The Judiciary Police apprehended the involved couple respectively at their residences on 21st October 2021. Both admitted to their perpetration. The involved woman had entered into sham marriage with the involved man, introduced to her by another local man, to obtain the right of abode in Macao. During that period, the involved duo signed an agreement, entitling the involved man a reward of MOP 50,000 from the involved woman upon her acquisition of the right to abode in Macao. Based on investigative results, the Judiciary Police arrested the said matchmaker and transferred the trio to the Public Prosecutions Office for the charges of falsification of documents of significant value, as well as document falsification stipulated in Law no. 6/2004 “illegal immigration, illegal stay and deportation”.

Em Março de 2021, a PJ, a pedido do MP, investigou um caso de casamento falso, no qual se dizia que uma mulher, suspeita deste caso, tinha casado com um homem de Macau na China continental, e depois fez o pedido para residir em Macau e obteve com sucesso o BIR de Macau. O casal divorciou-se em 2007 e a mulher obteve o BIRP em 2020. Na investigação, houve indícios que mostravam que os dois não viviam junto durante o casamento, assim, suspeitou-se tratar-se de casamento falso.
No dia 21 de Outubro de 2021, o casal foi detido nos seus apartamentos respectivamente. Os dois confessaram o crime. Para adquirir o direito de residência em Macau, a detida, com a recomendação de um outro homem de Macau, teve um casamento falso com o suspeito e o casal assinou um acordo. De acordo com as cláusulas do acordo, a mulher iria pagar ao suspeito 50.000 patacas como remuneração após a aquisição do direito de residência em Macau. Segundo as informações obtidas na investigação, a PJ deteve o intermediário. Os três indivíduos foram presentes ao MP por falsificação de documento de especial valor em combinação com falsificação de documentos prevista na Lei n.º 6/2004 – Lei da Imigração Ilegal e da Expulsão.
