本澳男子涉簽發空頭支票就逮
2021年5月18日,一名本澳男子向本局檢舉,報稱一名男性朋友向其簽發空頭支票,導致損失200萬港元,本局隨即展開調查。
案情顯示,涉案本澳男子在皇朝區經營餐廳,於2014年11月以急需資金周轉為由,向事主借款200萬港元,並承諾在三個月內歸還,但其一直以各種理由拖延還款,直至2020年9月才向事主簽發了一張200萬港元支票用作還款;事主則於2021年1月發現上述餐廳已停業,故攜同上述支票到銀行兌現,發現因戶口存款不足而無法兌現,涉案男子亦失去聯絡,故報警求助。
2021年6月25日,本局在治安警察局協助下於關閘口岸截獲涉案男子;其承認在明知帳戶沒有足夠存款情況下開立空頭支票,本局以簽發空頭支票(相當巨額)罪將之移送檢察院處理。
Local man arrested for issuing dishonoured cheque
On 18th May 2021, a local man lodged a complaint with the Judiciary Police that a male friend had signed and issued a dishonoured cheque to him, resulting in a loss of HKD2 million. The Judiciary Police initiated an investigation thereupon.
Case details revealed that the involved Macao man, who had operated a restaurant in the NAPE district, borrowed HKD2 million from the victim in November 2014 on the grounds of an urgent need for capital flow, and promised to pay off the money within three months. However, he kept delaying the repayment for various reasons. It was not until September 2020 that a cheque for HKD2 million was signed and issued to the victim for repayment. The victim discovered that the aforesaid restaurant had already ceased operation in January 2021, he therefore went to a bank to cash the abovementioned cheque but only to find that it could not be cashed due to insufficient deposits in the account, and the involved man could no longer be reached. As such, he reported to the police for assistance.
On 25th June 2021, the Judiciary Police intercepted the involved man at the Border Gate checkpoint with the assistance of the Public Security Police Force. The man admitted that he had issued a dishonoured cheque knowing there were sufficient deposits in his account. The Judiciary Police transferred him to the Public Prosecutions Office for the offence of issuance of dishonoured cheque (considerably huge amount).
Detido um homem de Macau por emissão de cheque sem provisão
Em 18 de Maio de 2021, um residente de Macau fez queixa na PJ indicando que um amigo pagou-lhe com um cheque sem provisão, e que sofreu um prejuízo de dois milhões de HK$, a PJ iniciou imediatamente a investigação.
Apurou-se que o suspeito operava um restaurante no NAPE, em Novembro de 2014, pediu emprestado à vítima dois milhões de HK$ por estar em emergência de dinheiro, e prometeu devolvê-los dentro de três meses. Contudo, adiou a devolução com vários pretextos e em Setembro de 2020, passou-lhe um cheque de dois milhões de HK$. Quando a vítima verificou, em Janeiro de 2021, que o referido restaurante tinha fechado, tentou sacar o cheque no banco mas não conseguiu por não haver dinheiro na conta, para além disso não conseguiu contactar o outro, assim fez queixa.
Em 25 de Junho de 2021, com o apoio do CPSP o indivíduo foi detido nas Portas do Cerco, este confessou ter passado um cheque mesmo sabendo que não havia dinheiro suficiente na conta. O detido foi presente ao Ministério Público por emissão de cheque sem provisão (de valor consideravelmente elevado).
