本澳男子涉僱用黑工及偽造具特別價值文件被拘
2019年12月,本局接獲一名內地男子報稱被一名本澳男子以合作承接工程為名詐騙20萬元人民幣。
案情顯示,2019年6月事主經朋友介紹認識涉案男子,涉案男子聲稱承接新口岸區某住宅地盤工程,因資金緊絀而遊說事主投資30萬元人民幣,以及物色和介紹14名內地工人,並由涉案男子負責辦理外地僱員身份認別證;其後,其中一名工人被地盤保安員揭發持有偽證,事主遂要求終止合作和要求退款,涉案男子退回人民幣10萬元後借故拖延,事主最終報警求助。
本局經深入調查,確認上述地盤的21名工人中,17人持有澳門居民身份證、職安卡、回鄉證,以及身份證核實記錄均為偽造,有關人士其實是以旅客身份來澳從事工作。本局依法對涉案的三部電腦進行法理鑑證,在其中一部搜獲大量與本案有關的偽證資料圖,故有強烈跡象顯示涉案男子僱用黑工及製作偽證。另外,調查亦得知涉案男子以日薪600元人民幣僱用每名工人,並會收取2,000元人民幣作辦證費用。
本局以偽造具特別價值文件罪及僱用罪將涉案男子移送檢察院處理。
Local man arrested for hiring illegal workers and forging documents of significant value
A mainland Chinese man reported to the Judiciary Police in December 2019 that he had been defrauded of RMB 200,000 by a local man on the pretext of jointly undertaking a construction project.
Case details revealed that the victim had got acquainted with the involved man through a friend in June 2019. The involved man, allegedly short of liquidity for his residential construction project in ZAPE, convinced the victim to invest RMB 300,000 and to recruit and recommend 14 mainland Chinese workers, whose Non-resident Worker’s Identity Cards were to be applied for by the involved man. One of the workers was subsequently revealed by a construction site security guard as the holder of a forged identity document. Consequently, the victim demanded to terminate the cooperation and a refund. Having received a refund of RMB 100,000, the victim was stalled by the involved man, thus reported to the police.
In-depth investigation confirmed that of the 21 workers of the aforesaid construction site, 17 had their Macao SAR Resident Identity Card, Occupational Safety Card, Mainland Travel Permit for Hong Kong and Macao Residents and identity card verification records falsified. They had in fact entered and worked in Macao as tourists. The Judiciary Police conducted statutory forensic examination on the three involved computers, seizing numerous imagery data of forged identity documents related to this case in one of the computers, suggesting compelling indications that the involved man had hired illegal workers and produced counterfeit identity documents. Investigation also revealed that the involved man had hired the workers for a daily wage of RMB 600 each, while receiving RMB 2,000 for processing the identity documents.
The Judiciary Police transferred the involved man to the Public Prosecutions Office for the charges of falsification of documents of significant value and employment.
Detido um residente por contratação de trabalhadores ilegais e falsificação de documento de especial valor
Em Dezembro de 2019, a PJ recebeu a denúncia de um homem da China continental, dizendo que tinha sido burlado em 200.000 RMB por um residente que afirmava poder cooperar em obras de construção civil.
Segundo o apurado, a vítima conheceu, em Junho de 2019, o suspeito através de um amigo. O homem disse-lhe que estava a participar nas obras dum estaleiro habitacional no ZAPE, mas não tinha fundos suficientes, convenceu-o assim a investir 300.000 RMB nas obras e a arranjar 14 trabalhadores na China, caberia ao suspeito o fornecimento dos documentos para os trabalhadores não-residente. Posteriormente, um destes trabalhadores foi descoberto, por um guarda do estaleiro, de possuir um documento falso, a vítima pediu então a terminação da cooperação e o reembolso do dinheiro. O suspeito devolveu 100.000 RMB e adiou com várias desculpas o pagamento do montante remanescente. A vítima acabou por fazer queixa a polícia.
Após averiguações aprofundadas, verificou-se que 17 dos 21 operários desse estaleiro eram portadores do bilhete de identidade de residente de Macau, do cartão de segurança ocupacional na construção civil ou do salvo-conduto para deslocação à China, bem como dos registos de verificação do BIR falsos. Na verdade, os indivíduos entraram em Macau na qualidade de turistas para trabalharem. A PJ procedeu a uma peritagem forense sobre três computadores apreendidos nos termos legais, tendo encontrado, num dos computadores, uma grande quantidade de informações relacionadas com os documentos falsos. Existem fortes indícios de que o suspeito tenha contratado os trabalhadores ilegais e que tenha fabricado os documentos falsos. Soube-se ainda que o detido contratava cada trabalhador com uma remuneração diária de 600 RMB e cobrava também 2.000 RMB para o fornecimento dos documentos.
O detido foi presente ao Ministério Público acusado dos crimes de falsificação de documento de especial valor e de emprego ilegal.
