偵破假結婚案拘五男女
2019年8月,本局接獲舉報指三名巴基斯坦裔兄弟涉嫌與本澳女子假結婚,從而騙取本澳居留權及澳門居民身份證。
本局深入調查發現,案中長兄於2008年娶妻,但又與涉及本案的一名本澳女子發展婚外情,更教唆該名女子與其三弟假結婚,以協助三弟取得澳門居民身份證;該名本澳女子與案中三弟婚後,與案中長兄誕下一子,其後長兄指使三弟登記為該名孩子之生父。本案中的次兄於2009年與另一名涉案本澳女子在巴基斯坦結婚,其於2017年取得澳門永久性居民身份證,翌年便與妻子離婚,且二人在婚姻存續期間申報的共同居所存在極大矛盾。
2021年2月24日,本局分別截獲上述三名巴基斯坦裔兄弟及兩名涉案本澳女子。經訊問後拘留嫌犯,其中有人承認假結婚,假結婚目的是協助對方取得本澳居留權。
本局以偽造具特別價值之文件罪結合第6/2004號法律《非法入境、非法逗留及驅逐出境》規定的偽造文件罪將五名涉案男女移送檢察院偵辦。
Case of sham marriages cracked with five individuals apprehended
In August 2019, the Judiciary Police received a report that three brothers of Pakistani descent were suspected of sham marriages with local women in order to obtain fraudulently the right of abode in Macao and Macao resident ID cards.
In-depth investigation by the Judiciary Police revealed that the eldest brother in this case got married in 2008. However, he had an extramarital affair with a local woman involved in this case, whom he abetted in sham marriage with his third brother to assist him in getting the Macao resident ID card. After getting married to the third brother in this case, the local woman gave birth to a boy for the eldest brother in this case, who then instructed the third brother to register as the birth-father of the child. The second brother in this case married another involved local woman in Pakistan in 2009 and obtained the Macao permanent resident ID card in 2017, a year after which he divorced his wife. Moreover, a significant contradiction existed in the common residence declared by the duo during the course of their marriage.
On 24th February 2021, the Judiciary Police intercepted the abovementioned three Pakistani brothers and the two involved local women respectively. The suspects were detained after interrogation, one of whom admitted to sham marriage in order to assist the other party in obtaining the right of abode in Macao.
The Judiciary Police transferred the five individuals to the Public Prosecutions Office for the offences of falsification of documents of special value combined with falsification of documents stipulated in Law No. 6/2004 “Law on Illegal Entry, Illegal Stay and Deportation”.
Resolvido um caso de falso casamento e detidos 5 indivíduos
Em Agosto de 2019, a PJ recebeu uma denúncia acerca de um falso casamento, no qual estavam envolvidos três irmãos paquistaneses e mulheres de Macau, com vista a obter o direito de residência de Macau e o BIR de forma fraudulenta.
Na investigação, apurou-se que o irmão mais velho se casou em 2008, mas tinha uma relação extraconjugal com uma mulher de Macau, uma dos suspeitos deste caso. Este instigou-a a casar-se falsamente com o seu irmão mais novo, para o ajudar a obter o BIR. Após o casamento, a mulher deu à luz o filho do irmão mais velho e ao irmão mais novo foi pedido para efectuar o registo de perfilhação. Quanto ao irmão do meio, casou-se com outra mulher de Macau no Paquistão em 2009 e obteve o BIRP de Macau em 2017, mas no ano seguinte, o casal divorciou-se e havia uma grande contradição na residência conjugal declarada pelo casal durante o período em que estiveram casados.
No dia 24 de Fevereiro de 2021, a PJ deteve os três paquistaneses e duas mulheres de Macau. Após o interrogatório, uma das mulheres admitiu ter casado por conveniência, a fim de ajudar o tal indivíduo a obter o direito de residência.
Os 5 detidos foram presentes ao MP por falsificação de documento de especial valor em combinação com falsificação de documentos prevista na Lei n.º 6/2004 – Lei da Imigração Ilegal e da Expulsão.
