九名男子涉詐騙銀行貸款被捕
2020年8月,本局接獲某本澳銀行報案,指先後發現經某車行辦理的四宗汽車貸款申請文件為偽造,同時上述車行東主與負責貸款申請的銀行分行副行長存在親屬關係,懷疑當中涉及詐騙行為。
本局人員展開深入調查,於2020年9月1日將涉案的四名貸款申請人、車行東主及銀行分行副行長帶返調查,並在車行搜獲涉案車輛買賣交易文件。四名貸款申請人均承認將個人及銀行帳戶資料交給一名地產中介,以便偽造虛假文件來申請貸款,並給予地產中介貸款額15%至20%的手續費作回報。本局在調查過程中再揭發另一名貸款申請人以同樣手法申請貸款,但其申請不獲審批。
本局人員根據線索前往涉案地產公司調查,起出三台電腦及十多萬港元現金,並將涉案地產中介及另一名男中介帶返調查。本局人員在扣押電腦中查獲包括上述五名貸款申請人在內的二十份偽造入息證明及銀行交易記錄等文件,查悉兩名涉案地產中介自2016年起伙同車行東主及銀行分行副行長犯案,先由中介物色需要貸款人士,再偽造貸款文件交給車行東主,然後透過銀行分行副行長處理貸款申請,所獲手續費由車行東主及地產中介平分。
本局以詐騙(巨額)罪及偽造文件罪將九名被捕人士移送檢察院處理。
Nine men arrested for defrauding bank of loans
A local bank reported to the Judiciary Police in August 2020 that the documents of four auto loan applications submitted via a car dealer were found to be falsified. As the owner of the said car dealer and the deputy general manager of the bank branch responsible for the loan applications were relatives, fraud was suspectedly involved.
Having launched in-depth investigation, the Judiciary Police took in the four loan applicants, owner of the car dealer and the deputy general manager of the bank branch for investigation on 1st September 2020. Involved vehicle trading documents were also seized in the car dealer. The four loan applicants admitted to have handed their personal information and bank account details to a property agent, who was remunerated with a handling fee of 15% to 20% of the loan amount to falsify documents for the loan application. During investigation, the Judiciary Police further discovered that another loan applicant was rejected a loan applied in the same manner.
Following clues, the Judiciary Police conducted investigation in the involved property agency, seizing three computers and over HKD 100,000 of cash, while taking in the involved property agent and another male agent for investigation. Twenty falsified proof of income and bank transaction records, including those of the aforesaid five loan applicants, were found in the seized computers. It was found that the two involved property agents had conspired with the owner of the car dealer and the deputy general manager of the bank branch to commit the crime since 2016. The property agents first scouted for persons in need of a loan. They would then falsify loan documents, to be handed to the owner of the car dealer, who would handle the loan applications through the deputy general manager of the bank branch. The handling fees received were equally shared among the owner of the car dealer and the property agents.
The nine arrestees were transferred to the Public Prosecutions Office for the charges of fraud (massive amount) and falsification of documents.

Em Agosto de 2020, a Polícia Judiciária recebeu uma denúncia de um banco sobre a falsificação de documentos no âmbito de 4 requerimentos de crédito automóvel feitos por uma agência de automóveis. Tendo em conta a existência de relações de parentesco entre o dono da dita agência e o vice-presidente da sucursal do banco responsável pelo requerimento dos empréstimos, houve suspeita de envolvimento num esquema de burla.
Na investigação exaustiva, no dia 1 de Setembro de 2020, os nossos agentes levaram 4 requerentes, o dono da agência de automóveis e o vice-presidente às instalações da PJ, e apreenderam, naquela agência, documentos relativos à venda e transacções de automóveis. Os 4 requerentes confessaram ter entregue as suas informações pessoais e das contas bancárias a um intermediário de uma companhia imobiliária, para que este fizesse os requerimentos de empréstimos falsificando documentos, e admitiram ter-lhe pago, como recompensa, quantias que variam de 15% a 20% do valor de crédito. Descobriu-se ainda que um outro requerente tinha tentado utilizar o mesmo modus operandi para contrair empréstimos, mas não conseguiu obtê-lo.
Com base nas pistas obtidas, os nossos investigadores deslocaram-se à referida companhia de imóveis, onde foram apreendidos três computadores e mais de 100.000 HKD em numerário, e levaram o citado intermediário de imóveis e um outro intermediário às instalações da PJ. Conseguiu-se apurar, nos computadores apreendidos onde constam vários documentos falsificados dos referidos 5 requerentes, tais como 20 certidões de vencimento e registos de transacções bancárias e, que em 2016 os referidos 2 intermediários começaram a actuar em conluio com o dono da agência de automóveis e o vice-presidente, sendo que aqueles 2 eram encarregues de angariar pessoas que necessitassem de contrair empréstimos e de falsificar os respectivos documentos para depois entregar ao dono da agência de automóveis, e o vice-presidente era incumbido de lidar com os requerimentos de empréstimos. Todo o dinheiro obtido foi dividido entre o dono e os intermediários.
Os 9 detidos foram presentes ao Ministério Público por burla de valor consideravelmente elevado e falsificação de documentos.
