三名美容中心女職員涉違反《個人資料保護法》被拘
2020年7月9日,本局接獲個人資料保護辦公室轉介一宗案件,指個資辦自2019年初起接到多名市民投訴,均稱手機收到推銷美容服務的電話,即使已明確拒絕推銷,但仍不斷受到推銷電話滋擾。
根據案件資料顯示,上述推銷電話由兩間推銷公司撥出,涉及四間美容中心;涉案推銷公司更假扮其他美容中心或諮詢公司推銷美容服務,藉以套取更多個人資料。鑑於有關推銷公司及美容中心在推銷過程中涉及收集和處理個人資料行為,但沒有按照《個人資料保護法》的相關規定履行通知義務,且在個資辦依法要求其履行通知義務時竟不加理會。
2020年8月3日,本局前往涉案推銷公司及美容中心進行調查,發現兩間推銷公司在境外利用網絡電話系統致電本澳市民,並使用某電訊營運商的服務器暫存服務儲存其網絡電話系統,本局在電訊營運商的協助下,成功檢獲涉案網絡電話系統設備共七台;另在四間美容中心搜獲一批涉及收集或處理個人資料的電子設備及文件,並將19名美容中心負責人及職員帶返本局協助調查。
本局根據調查所得,以未履行資料保護的義務罪將其中三名美容中心女職員移送檢察院偵辦。
Three beauty salon female employees apprehended for violating Personal Data Protection Act
The Office for Personal Data Protection referred a case to the Judiciary Police on 9th July 2020, stating that they had been receiving complaints from multiple residents since early 2019, all of whom claimed that their mobile phones had received telephone calls promoting beauty services. Despite the fact that they had explicitly rejected the promotion, they were still constantly harassed by cold calls.
Case details revealed that the abovementioned cold calls were made by 2 marketing companies involving 4 beauty salons. To obtain more personal data, the involved marketing companies would even pose as other beauty salons or consulting companies to promote beauty services. The promotion processes conducted by the related marketing companies and the beauty salons involved the act of collecting and handling personal data, but they failed to comply with the relevant obligation of notification as stipulated in Personal Data Protection Act, and even ignored the request made by the Office for Personal Data Protection to comply with the obligation of notification in accordance with the law.
On 3rd August 2020, the Judiciary Police proceeded to the involved marketing companies and beauty salons to conduct investigation. The 2 marketing companies were found to have called local residents by using online telephone system abroad and made use of the temporary server storage services of a telecommunications operator to store its online telephone system. With the assistance of the telecommunications operator, the Judiciary Police successfully seized 7 sets of the involved online telephone system equipment in total. In addition, a batch of electronic equipment and documents involving the collection and handling of personal data was seized in the 4 beauty salons while 19 persons-in-charge and employees of the beauty salons were brought back to the Judiciary Police to assist in investigation.
Based on the results of investigation, the Judiciary Police transferred 3 of the beauty salon female employees to the Public Prosecutions Offices for the offence of non-compliance with the obligation of data protection.
Detidas três empregadas de salões de beleza por violação da “Lei de Protecção de Dados Pessoais”
No dia 9 de Julho de 2020, a PJ recebeu um caso transferido pelo Gabinete para a Protecção de Dados Pessoais (GPDP), indicando que desde o início de 2019 o GPDP tinha recebido denúncias de várias pessoas que relataram o recebimento no seu telemóvel de chamadas telefónicas que promoviam serviços de beleza, que apesar de terem recusado expressamente a promoção, continuaram a ser incomodadas por estes telefonemas.
De acordo com as informações do caso, as chamadas telefónicas acima referidas foram efectuadas por duas empresas de marketing envolvendo quatro salões de beleza. Estas empresas de marketing fingiam ser outros salões de beleza ou empresas de consultoria para publicitar serviços de beleza, com o objectivo de obter mais dados pessoais. É de considerar que no decurso destas operações, as respectivas empresas de marketing e salões de beleza estavam envolvidos na recolha e tratamento de dados pessoais, mas não cumpriram a obrigação de notificação nos termos do disposto na Lei da Protecção de Dados Pessoais, e que ignoraram a solicitação do GPDP, de acordo com a lei, para cumprirem a obrigação de notificação.
No dia 3 de Agosto de 2020, a PJ deslocou-se às respetivas empresas de marketing e salões de beleza para investigação, apurou-se que as duas empresas faziam chamadas telefónicas para pessoas de Macau, por meio de um sistema de Voz sobre Protocolo de Internet (VoIP) que era armazenado utilizando o serviço de armazenamento provisório de um operador de telecomunicações local. Com a colaboração do operador de telecomunicações, a PJ conseguiu apreender sete dispositivos de VoIP envolvidos no caso, e foram encontrados em quatro salões de beleza vários dispositivos electrónicos e documentos relativos à recolha e tratamento de dados pessoais, tendo 19 indivíduos, entre eles responsáveis e empregadas dos salões de beleza, sido levados à PJ para efeitos de investigação.
De acordo com a investigação, três destas empregadas foram presentes ao Ministério Público por crime de não cumprimento das obrigações relativas à proteção de dados.
