五男女涉開辦虛假課程詐騙資助被捕
2020年1月初,本局接獲檢察院批示,對一連鎖教育中心以開辦虛假課程詐騙“持續進修發展計劃”資助的案件展開調查。
根據教育暨青年局提供資料,三間分別位於黑沙環區、雀仔園區及南灣區的教育中心於2019年4月至9月期間合謀開辦虛假課程,從而騙取“持續進修發展計劃”資助款項,涉及金額共約176萬澳門元。
本局經深入調查,證實案件至少涉及五名人士,並於2020年7月29日將涉案教育中心三名負責人及一名協助招收學員的本澳女子帶返調查;而案中主腦因早前涉及另一宗同類案件,被採取定期報到的強制措施,其於同日向本局報到時亦接受調查。五名涉案人均否認犯案,但本局查悉涉案教育中心以舉辦商業行政課程為名向教青局申請資助,實際課程內容為音樂或投資技巧;又用以現金回贈來誘騙學員簽署多日課程的出席表,學員根本毋須前來上課;而案中主腦還安排自己於同一時間不同地點教授兩項課程,以騙取更多資助。案件涉及至少20個虛假課程。
本局以偽造文件罪及加重詐騙罪將五名涉案男女移送檢察院偵辦,並對曾收取現金回贈的10名學員進行調查,以及追查其他涉案人士。
Five individuals arrested for grant fraud by holding bogus courses
The Judiciary Police received a dispatch from the Public Prosecutions Office in early January 2020 to launch investigation into a case in which a chain of education centres had been defrauding of grants of the “Continuing Education Development Plan” by holding bogus courses.
According to the information provided by Education and Youth Affairs Bureau (DSEJ), the three education centres respectively located at Areia Preta, Bairro Horta da Mitra and Nam Van conspired to hold bogus courses between April and September 2019, defrauding of grants of the “Continuing Education Development Plan”, totaling around MOP 1.76 million.
In-depth investigation confirmed that at least five individuals were involved. Three persons-in-charge of the involved education centres and a local woman assisting the recruitment of students were taken in for investigation on 29th July 2020. Due to his involvement in another similar case earlier, the mastermind was imposed a mandatory measure of regular reporting. As such, he was also investigated when he reported at the Judiciary Police on the same day. Despite the five involved persons’ denial of perpetration, the Judiciary Police found out that the involved education centres had been applying for grants from DSEJ by nominally holding business administration courses, the contents of which were in fact music or investment skills. Cash rebates were also offered to entice students to sign attendance sheets of courses spanning a number of days, during which attendance was not necessary. The mastermind also plotted to defraud of more grants by arranging himself to teach two courses in different locations at the same time. At least 20 bogus courses were involved in the case.
The Judiciary Police transferred the five individuals to the Public Prosecutions Office for the charges of falsification of document and aggravated fraud, while investigating the 10 students that had received the cash rebates and tracing the other involved persons.
Detidos 5 indivíduos por suspeita de burla na obtenção de financiamento através da abertura de cursos falsos
No início de Janeiro de 2020, a Polícia Judiciária recebeu um despacho do Ministério Público sobre um caso de burla na obtenção fraudulenta de financiamentos no âmbito do “Programa de Desenvolvimento e Aperfeiçoamento Contínuo”, no qual procedeu a uma investigação a uma instituição de ensino em cadeia por suspeita de abertura de cursos falsos.
Das informações da Direcção dos Serviços de Educação e Juventude (DSEJ) resulta que 3 instituições de ensino, respectivamente na zona de Areia Preta, da Horta da Mitra e Nam Van, abriram em conluio, entre Abril de Setembro de 2019, cursos falsos para obter os subsídios no âmbito do referido programa, no valor total de cerca de 1.76 milhões de patacas.
Na investigação exaustiva, descobriu-se que o caso em apreço envolve pelo menos cinco indivíduos. Entre estes, três responsáveis daquelas instituições e uma residente responsável por ajudar em recrutar alunos foram levados, no dia 29 de Julho de 2020, às instalações da PJ para a investigação, ao passo que o cabecilha, que lhe tinha sido aplicado a medida de coacção de apresentação periódica por estar envolvido anteriormente num outro caso do mesmo género, foi sujeito à investigação no mesmo dia da apresentação periódica à PJ. Os 5 suspeitos negaram o crime. Todavia, a PJ conseguiu apurar que tais instituições solicitaram a concessão de financiamento da DSEJ para a realização de cursos de administração comercial, cujo conteúdo na verdade era, música ou técnicas de investimento. Além disso, convenceram ainda os alunos a assinar as listas de presença de vários dias oferecendo-lhes descontos em dinheiro, fazendo assim com que eles não necessitassem de vir às aulas. Apurou-se também que o cabecilha organizou 2 cursos por ele ministrados com mesmo horário mas em diferentes locais, a fim de obter mais financiamentos. No total estavam envolvidos pelo menos 20 cursos falsos.
Os 5 detidos foram presentes ao Ministério Público por falsificação de documentos e burla qualificada, enquanto que a PJ abriu uma investigação sobre os 10 alunos que tinham beneficiado de descontos em dinheiro e sobre eventuais cúmplices.
